Abstract: In May 2014, special actor Chang Yinsheng (stage name Chang Jiaolin) was suspected of raping a woman in her 20s, Wang Qing (pseudonym). Chang Yinsheng, born in 1963, is a special actor who has starred in the movies "Yan Security Incubator" and "The Republic Will Not Forget". Before the incident, Chang Yinsheng was the deputy director of the International Commercial Film television station, the editor-in-chief of the International Calligraphy and Painting Channel, the general manager of the Xingyi International Film and Television Media Culture Company, and the art consultant of the Beijing Tianxi Calligraphy and Painting Institute.

Wang Qing said that she met Chang Yinsheng in the winter of 2013, and the two were just ordinary friends and had a few meals. On May 25, 2014, Wang Mou of the Beijing Tianxi Calligraphy and Painting Institute contacted Wang Qing and said that he hoped that she and Chang Yinsheng would have a dinner together at the Calligraphy and Painting Institute, and Wang Qing gladly went to the appointment without much thought.

At 9 o'clock that night, she went to the bathroom after eating, and when she came out, she was hugged by Chang Yinsheng and taken to a bedroom next to the bathroom, and then Chang Yinsheng tried to forcibly have sex with Wang Qing but failed. In the meantime, Chang Yinsheng used his mobile phone to take nude photos of some parts of Wang Qing's body, and the whole process lasted for more than 20 minutes.

After trial, the court of first instance found that Chang Yinsheng took advantage of the opportunity of the victim Wang Qing's drunkenness to forcibly have sexual relations with him in the Beijing Tianxi Calligraphy and Painting Institute, during which Time Chang Yinsheng forcibly took nude photos of some parts of Wang Qing. In the end, Chang Yinsheng was sentenced to 3 and a half years in prison for attempted rape. After the first-instance judgment, Chang Yinsheng was not satisfied and appealed to the Second Intermediate Court.

In this case, Wang Mou and Feng Mou of the Beijing Tianxi Calligraphy and Painting Institute, who helped sabotage the scene of the crime, were also sentenced. The court of first instance found that at about 22:00 on May 25, 2014, Wang Mou threw the underwear wang Qing was wearing in the garbage can of the calligraphy and painting institute after Wang Qing told him that he had been raped by Chang Yinsheng, and then instructed Feng to throw the underwear into the drainage ditch outside the calligraphy and painting institute. Feng eventually hid his underwear under a black rubber pad near the door of the flat room on the south side of the Calligraphy and Painting Institute.

Wang Once confessed that after eating that night, he entered the house where the incident occurred, stepped on vomit when he entered the house, rubbed his feet on a towel-like thing on the ground, and later found that it was a pair of underwear, and he did not think much about it and threw the underwear in the garbage can on the south side of the gate. Later, he called Feng and asked him to throw his underwear farther away. Feng said that Wang asked him to throw the underwear in the garbage can into the drainage ditch outside the courtyard, and after he found the underwear, he saw that there was a black cushion on the south side of the garbage can, so he hid the underwear under the mat.

The court held that Wang and Feng helped the parties to destroy evidence, and their actions constituted the crime of helping to destroy evidence. The court sentenced Wang to 1 year and two months in prison and Feng to 11 months in prison for the crime of helping to destroy evidence in the first instance. After the first-instance judgment, Wang appealed. The Second Intermediate People's Court held that Wang and Feng's act of hiding the victim's underwear seriously interfered with the investigation work of the judicial organs and met the constituent elements of the crime of helping to destroy evidence.
