
Hengyang City Urban Dog Management Measures
Chapter I General Provisions
Article 1 In order to standardize dog breeding behavior, maintain environmental health and social order, and protect citizens' health and personal safety, these Measures are formulated in accordance with the provisions of the "Law of the People's Republic of China on Public Security Administration Penalties", "Animal Epidemic Prevention Law of the People's Republic of China", "Regulations on the Management of Urban Appearance and Environment of Hengyang City", "Patriotic Health Regulations of Hengyang City" and other relevant laws and regulations, combined with the actual conditions of this City.
Article 2: These Measures apply to urban built-up areas within the administrative region of this Municipality and to areas designated and announced by the people's governments of cities and counties (cities and districts) for urbanization management.
Where military organs, public security organs, emergency management departments, zoos, scientific research institutions, and other units need to keep dogs for work, they shall be carried out in accordance with the relevant provisions of the State.
Article 3 The management of dog breeding shall follow the principles of combining government supervision, self-discipline of dog owners, participation of grass-roots organizations and social organizations, and supervision by the whole people.
Article 4 The people's governments (management committees) of cities and counties (cities and districts) shall establish coordination mechanisms for the management of urban dog breeding, organize departments such as for public security, urban management, agriculture and rural areas, health and health, market supervision and management, and finance to carry out urban dog breeding management work in accordance with their respective duties, and ensure the funds for dog breeding management at the same level.
Article 5: Public security organs are in charge of urban dog breeding management, responsible for dog registration, filing and review, disposing of stray dogs, hunting and killing rabid dogs, investigating and dealing with acts such as dogs harassing the people, raising dogs without a license, illegally carrying dogs out of the house, establishing a dog information management system, and other duties provided for by laws and regulations.
The urban management department is responsible for investigating and dealing with dog breeding that affects the appearance and environmental health of the city; investigating and dealing with the illegal occupation of roads for dog business activities; guiding and supervising the establishment of dog prohibition signs in public places such as parks and squares, as well as other duties stipulated by laws and regulations.
The agricultural and rural departments are responsible for the prevention and control of zoonotic diseases such as rabies, the immunization supervision and epidemic monitoring of dogs, the supervision of epidemic prevention in the detention center, and other duties stipulated by laws and regulations.
The health department is responsible for the prevention, publicity and education of rabies and other infectious diseases and the monitoring of the epidemic situation, and is responsible for the management of rabies vaccination and the diagnosis and treatment of rabies patients, as well as other duties stipulated by laws and regulations.
The market supervision and management department is responsible for the registration of dog business entities, supervising the relevant business activities of dog trading venues and other duties stipulated by laws and regulations.
The housing department is responsible for guiding and supervising the participation of property service enterprises in the management of dog breeding and other duties stipulated by laws and regulations.
The financial department is responsible for the funding guarantee for the management and construction of dog breeding and other duties stipulated by laws and regulations of the government at the same level.
Article 6 Residents' committees and villagers' committees shall assist the people's governments (management committees) at all levels in this Municipality in doing a good job of dog breeding management, and may convene residents' meetings and villagers' meetings to formulate conventions in accordance with law on matters related to the management of dog breeding in their respective areas of residence, and organize supervision and implementation.
Residential community property service enterprises should cooperate with relevant departments to carry out dog management work, and standardize the management of dog breeding in the community.
Encourage relevant industry associations, animal protection organizations, and other social organizations to participate in dog management, training services, publicity and education, and other such work in accordance with law.
Article 7 Dog breeders shall raise dogs in accordance with law, scientifically and civilly, and must not harm the societal public interest or the lawful rights and interests of others. At the same time, it is also forbidden for any unit or individual to abuse or injure dogs without reason.
Article 8: Any unit or individual has the right to dissuade conduct that violates these Measures, and may report and complain through the 12345 citizen service hotline or directly to the relevant functional departments. After receiving a report or complaint, the relevant functional departments shall register and promptly handle them, and inform the informant or complainant of the handling situation within five working days.
Article 9: Public security organs establish a dog management service information system, and public security, agriculture and rural areas, and other such departments shall promptly enter information related to dog management formed in the course of performing their duties into the system to bring about information sharing.
Chapter II: Registration and Immunization
Article 10 Where a dog owner is a natural person, he shall meet the following conditions:
(1) Have a local household registration or legal proof of residence;
(2) Have full capacity for civil conduct;
(3) Have a fixed residence;
(4) Have a dog immunization certificate;
(5) The list and breeds of dogs raised meet the requirements;
(6) There are no relevant acts and records of abandonment or abuse of dogs;
(7) Other requirements provided for by laws, regulations, and rules.
Article 11 Where a dog breeder is a unit, the following conditions shall be met:
(1) Used for the care of key storage, construction sites, financial rooms and other special sites for other lawful purposes;
(2) Have a sound dog management system, and have a special person responsible for management;
(3) Have facilities and conditions for leashing or enclosure, such as kennels, kennels, and fences;
(5) There are no relevant acts and records of abandonment or abuse of dogs;
(6) Other requirements provided for by laws, regulations, and rules.
Article 12: It is forbidden to keep large dogs or fierce dogs. A list of prohibited dogs and breeds are listed in the annex.
Article 13: Dog owners shall, within 15 days of acquiring dogs, go to the place designated by the public security organs at the place of residence to register their dogs.
To apply for dog registration, the following materials shall be provided:
(1) Proof of the identity of the dog owner;
(2) Proof of the dog owner's domicile;
(3) Proof of effective dog immunization;
(4) Breed, age, main physical characteristics and full-body color photographs of the dog's side;
(5) Fill in the "Commitment to Civilized Dog Breeding according to Law".
Article 14: Public security organs and their entrusted institutions shall establish electronic archives of registered dogs and enter them into the dog management service information system. The electronic file records the following:
(1) The dog owner's identity certificate, address and contact information;
(2) Breed, age, main physical characteristics and full-body color photographs of the dog's side;
(3) The number of the dog registration certificate, the time of issuance, the period of validity, and the reissuance, reissuance, or replanting of the dog registration certificate, intelligent dog tag, and electronic identification mark;
(4) Dog immunization certificate number and dog immunization status;
(5) Other matters that public security organs provide shall be recorded.
Article 15 Where the dog breeder's domicile is changed, he shall, within 30 days from the date of occurrence of the change, go to the public security organ where the new residence is located or the dog registration service place set up by the dog owner with the dog registration certificate to handle the change registration. Where other registration matters are changed, the change shall be registered with the original registration organ within 15 days from the date of the change.
Where a registered dog is sold or donated to another person or handed over to a place where the dog is kept for inspection, the original dog owner, dog buyer or recipient shall go through the transfer registration within 15 days.
Where a dog breeder loses his dog registration certificate, he shall, within 15 days from the date of loss, go to the original registration office to apply for a replacement dog registration certificate.
Where a dog dies or is lost, the dog owner shall go to the original registration office to deregister within 15 days from the date of death or loss of the dog.
Where a lost dog that has been deregistered is recovered, it shall go through the registration formalities again within 15 days from the date of recovery.
Article 16: Public security organs implement a management system for smart dog tags and electronic identification for dogs, and when handling dog registration formalities, handle smart dog tags and electronic identification at the same time. Dogs should wear smart dog tags when leaving the house.
According to the principle of convenience, the rabies vaccination of dogs, the issuance of smart dog tags and the implantation of electronic identification should be carried out in the same place.
The cost of smart dog tags and electronic identification shall be borne by the dog owner. Where smart dog tags or electronic identification are damaged or lost, the dog owner shall promptly apply for reissuance or replanting.
Article 17 A dog owner shall, within 15 days after obtaining a dog or at the expiration of the immunization interval, bring the dog to an animal diagnosis and treatment institution approved by the agricultural and rural departments to conduct health examinations and immunization injections of the dog, and obtain an animal immunization certificate supervised by the animal health supervision institution.
Agricultural and rural departments shall supervise animal diagnosis and treatment institutions and enter dog immunization into the dog management service information system.
Article 18 Where the relevant competent departments of cities, counties (cities), dog breeders, property management units, or dog diagnosis and treatment institutions discover that dogs have rabies or are suspected of having rabies or other serious zoonotic infectious diseases, they shall immediately report to the agricultural and rural departments.
Agricultural and rural departments shall immediately entrust professional institutions to diagnose dogs suspected of having rabies; for dogs confirmed to have rabies, harmless treatment measures shall be taken in accordance with law.
Where a sick dog is treated harmlessly, the original registration authority shall cancel the registration of the dog.
Article 19 Dog breeders shall use deep burial of dog corpses that have died of illness or whose cause of death is unknown to be treated in a high dry wasteland far from their homes, water sources or roads, or handed over to a professional harmless treatment institution for centralized disposal.
Chapter III Dog Breeding Specifications
Article 20 Dog owners shall abide by the following provisions:
(1) Dog breeders shall go to the local public security organs for dog registration and obtain a dog registration certificate and a dog license;
(2) The list and breeds of dogs raised comply with regulations, and it is prohibited to raise large dogs and fierce dogs;
(3) When carrying a dog out of the house, the dog shall be leashed with a dog leash within 2 meters, and the dog shall be worn with a dog tag and muzzle for the dog. Except for anti-drug dogs, search and rescue dogs, guide dogs, support dogs and other working dogs, it is forbidden to carry dogs into indoor public places and outdoor public places such as parks and squares with signs prohibiting animals from entering, and it is prohibited to carry dogs on public transportation other than small taxis, and where small taxis are taken, the consent of the driver shall be obtained;
(4) Keeping dogs must not interfere with the normal lives of others, and when carrying dogs out of the house, they shall avoid the elderly, the disabled, pregnant women and children, and must not allow dogs to intimidate others, and must not drive dogs to harm others;
(5) Dog breeders shall periodically go to animal epidemic prevention institutions to immunize dogs in accordance with regulations, and apply for rabies vaccination certificates for dogs;
(6) Raising dogs must not affect the city appearance and environmental hygiene, and the feces produced by dogs on urban roads and other public places shall be cleaned up immediately;
(7) Must not forge, alter, or buy or sell documents related to dog management;
(8) Dogs must not be abused or abandoned, and it is forbidden to organize and participate in dog fighting and other acts of injuring dogs;
(9) Must not occupy the common area of public corridors and other buildings to set up kennels, place dog cages and other utensils;
(10) Other responsibilities and obligations provided for by laws, regulations, and rules.
Article 21: Those who bring ordinary dogs that are not registered in this city into this city shall hold a valid dog immunization certificate. Where the period of stay is intended to exceed three months, the dog registration formalities shall be completed within 10 days from the date of entry into the city in accordance with the provisions of these Measures.
Article 22: Managers of public places such as parks, public green spaces, restaurants, shopping malls, and other public places may restrict the areas and times for dogs to enter on the basis of actual conditions, and shall set up conspicuous signs at the entrance, indicating the areas and times where dogs are prohibited from entering, except for blind people carrying guide dogs and physically disabled people carrying support dogs.
Residents' committees, villagers' committees and residential area owners' committees may demarcate the area of activity of dogs in their residential areas in accordance with the relevant conventions.
Corresponding environmental sanitation facilities shall be set up in the area where dogs are active, as well as notice boards indicating the scope of the area, opening hours, warning matters, and other such content.
Chapter IV: Operation, Inspection, and Rescue
Article 23 Those engaged in dog breeding, sales, diagnosis and treatment, grooming, training, exhibition, foster care and other business activities shall abide by the following provisions and accept the supervision of the relevant administrative departments:
(1) Sites shall comply with animal epidemic prevention conditions and environmental protection requirements, and shall be equipped with facilities such as washing, disinfection, and harmless treatment of sewage and sewage in accordance with regulations;
(2) Immunization and quarantine of dogs in accordance with regulations;
(3) Take effective measures to prevent dogs from disturbing public order, and must not take dogs out of breeding places except for immunization, diagnosis and treatment, training, breeding and sales;
(4) Where dogs are found to be infected or suspected of being infected, isolation and control measures shall be immediately employed, and promptly reported to the agricultural and rural departments, and must not be transferred or sold without authorization;
(5) Those engaged in dog diagnosis and treatment activities shall do a good job in health and safety protection, disinfection, isolation and death of dogs in diagnosis and treatment activities, or the removal of dog tissues and organs, as well as the waste generated by dog diagnosis and treatment and grooming, for harmless treatment.
It is forbidden to engage in dog-related business activities on urban roads and sides, bridges, underpasses, squares and other public places in violation of regulations.
It is forbidden to set up places for engaging in dog business as provided for in paragraph 1 of this Article in residential areas or office buildings.
Article 24: Municipal and county (city) district people's governments (management committees) provide places for dog inspection through organizational construction, purchase of services, or other means. The establishment of dog inspection sites shall meet the requirements of animal epidemic prevention conditions.
Dog inspection sites are responsible for receiving, inspecting and disposing of seized, abandoned, ownerless dogs and dogs that have not applied for a dog registration certificate in accordance with regulations, take necessary immunization and medical measures for dogs retained for examination, and harmlessly dispose of dogs with rabies or dogs whose cause of death or cause of death is unknown.
Article 25 Where a dog retained for inspection can be identified as a dog owner, the dog owner shall be immediately notified to claim it; if it cannot be ascertained or no one claims it within 30 days of overdue time, it shall be treated as a ownerless dog. The dog owner shall bear the costs of breeding, medical treatment and other expenses incurred by the dog at the inspection site.
For dogs that are delivered without ownership, individuals and units that meet the qualifications for dog breeding are allowed to adopt them.
Article 26: Support relevant industry associations, animal protection organizations, and animal diagnosis and treatment establishments in participating in rescue activities such as the retention and adoption of dogs.
Chapter V: Legal Liability
Article 27: Public security organs shall establish archives of records of illegal dog breeding, and where dog breeders are repeatedly reported or punished, and where dogs are injured, they shall conduct key supervision over their dog breeding activities. If the dog owner fails to effectively restrain the dog in accordance with the provisions of these Measures, causing the dog to endanger traffic safety and causing a traffic accident, he shall bear the corresponding civil liability in accordance with law, and the dog owner shall bear the responsibility for the casualty of the dog.
Article 28: Where the provisions of these Measures are violated and any of the following conduct is committed, the public security organs are to punish them:
(1) Violating the provisions of Article 12 and Article 20 (2) of these Measures, failing to go through registration and raising a prohibited dog, the public security organ shall order correction within a time limit;
(2) Where the provisions of the first paragraph of Article 13, Article 15, Article 20 (1) and Article 21 of these Measures are violated, and the breeding of dogs has not been registered, the public security organs shall order corrections within a time limit;
(3) Whoever, in violation of the provisions of item (3) of Article 20 of these Measures, fails to use a dog leash to lead a dog, does not wear a dog tag or mouth mask for the dog, or carries a dog into a prohibited place, shall be ordered to make corrections by the public security organ;
(4) Whoever, in violation of the provisions of article 20 (4), (9) and article 23, paragraph 1 (3) and 3 of these Measures, keeps a dog and interferes with the normal life of others, shall be given a warning; whoever fails to make corrections after the warning or allows the dog to intimidate others shall be fined not less than 200 yuan but not more than 500 yuan; whoever drives a dog to harm another person shall be detained for 5 to 10 days and shall also be fined not less than 200 yuan but not more than 500 yuan; if the circumstances are less serious, he shall be detained for not more than 5 days or fined not more than 500 yuan. Where a crime is constituted, criminal responsibility will be pursued in accordance with law;
(5) For those who violate the provisions of article 20 (7) and forge, alter or buy or sell documents related to dog management that are not quarantine certificates or quarantine marks, they may be detained for not less than 10 days but not more than 15 days, and may also be fined not more than 1,000 yuan; if the circumstances are less serious, they may be detained for not less than 5 days but not more than 10 days, and may also be fined not more than 500 yuan.
Article 29: Where the provisions of these Measures are violated and any of the following conduct is committed, the urban management law enforcement departments are to give punishment:
(1) Where the provisions of subparagraph (6) of Article 20 of these Measures are violated, order corrections to be made; where corrections are refused, a fine of between 50 and 100 yuan shall be imposed;
(2) Whoever, in violation of the provisions of the second paragraph of Article 23 of these Measures, operates in a place where business is prohibited, shall be ordered to make corrections; if he refuses to make corrections, he shall be fined not less than 50 yuan but not more than 500 yuan.
Article 30: Where the provisions of these Measures are violated and any of the following conduct is committed, the competent departments for agriculture and rural affairs of local people's governments at the county level or above are to give punishment:
(1) Violating the provisions of Article 17, Article 20 (5) and Article 23( Paragraph 1 (2) of these Measures, and ordering a dog not to be immunized in accordance with regulations; if it refuses to make corrections, the animal health supervision institution shall handle it on its behalf, and the required disposal expenses shall be borne by the offender, and a fine of not less than 200 yuan but not more than 1,000 yuan shall be imposed;
(2) Whoever, in violation of the provisions of Article 19 of these Measures, arbitrarily disposes of a dog's body without following the provisions, shall be ordered by the competent department of agriculture and rural affairs of the local people's government at the county level or above to carry out harmless treatment, and the required disposal expenses shall be borne by the offender, and may be fined between 3,000 and 30,000 yuan;
(3) Whoever, in violation of the provisions of subparagraph (7) of Article 20 of these Measures, transfers, forges or alters quarantine certificates or quarantine marks, the competent departments for agriculture and rural affairs of local people's governments at the county level or above shall confiscate the illegal gains and quarantine certificates and quarantine marks, and impose a fine of not less than 5,000 yuan but not more; and shall also impose a fine of not less than 3,000 yuan but not more than 30,000 yuan;
(4) Whoever, in violation of the provisions of subparagraph (4) of the first paragraph of Article 23 of these Measures, fails to perform the obligation to report the animal epidemic situation and adopts corresponding measures, shall be ordered to make corrections by the competent departments for agriculture and rural affairs of local people's governments at the county level or above and may be fined not more than 10,000 yuan; if they refuse to make corrections, they shall be fined between 10,000 and 50,000 yuan.
Article 31: Where relevant competent administrative departments and their staff abuse their powers, neglect their duties, or engage in favoritism or malpractice in the course of dog breeding management work, they are to be given administrative sanctions in accordance with law; where a crime is constituted, criminal responsibility is to be pursued in accordance with law.
Chapter VI Supplementary Provisions
Article 32 Dogs that have been raised before the implementation of these Measures and are included in the list of large dogs and fierce dogs shall be handled by the dog breeders themselves within 90 days from the date of implementation of these Measures. If it is not handled within the time limit, the public security organ will handle it on its behalf, and the necessary expenses shall be borne by the dog owner.
Article 33: These Measures take effect on the date of promulgation.
