However, for some projects that require special operations and projects that enter related industries, they also need to obtain a license to carry out business activities, and the problem of "easy to apply for a license and difficult to handle a certificate" is more prominent.
In order to solve the problem of "quasi-camp difficulties", since 2015, the State Council has selected 116 and 47 enterprise-related business license matters to be piloted in two batches in Pudong, Shanghai, and gradually copied and promoted to the whole country on the basis of summarizing the pilot experience, and achieved full coverage of the matters in 2019.
Recently, the State Council issued a notice to implement the full coverage list management of enterprise-related business licensing matters nationwide from July 1 this year. How is this round of "separation of licenses and licenses" reform different from the previous one? How to benefit market players? How to further stimulate market vitality?

Recently, Ms. Cao from Taiyuan, Shanxi Province, came to the Government Service Hall of Wanbailin District to apply for the "Individual Business License" and the "Food Small Business Store Filing Certificate". After more than 20 minutes, she got these two documents.
In the past, Wanbailin District implemented "tandem approval" for the masses to open small food stores, and the clerks needed to go to the license registration window to apply for the "Business License of Individual Industrial and Commercial Households", and then go to the market access window to apply for the "Food Small Business Store Filing Registration Certificate". The formalities were cumbersome, and the masses ran back and forth. Since May 18 this year, the local implementation of the "separation of licenses and licenses" and "parallel approval" reform, individual industrial and commercial households to handle food stores only need to "go to a window, fill out an application, make a commitment, take less than half an hour", the staff said, "Take the lease contract of the house, I brought my ID card to do real-name authentication, called the number to receive the form, you can come and handle." At the same time, if you need to apply for food (small business store filing), the long view of the door, the close-up view to a piece of A4 paper printed out, a copy of the business license, as well as my ID card, you can directly handle. ”
The large number of certificates and the difficulty of handling certificates are one of the problems that many market entities have prominently reflected. Since 2012, the State Council has made overall plans to promote the reform of the administrative examination and approval system and the reform of the commercial system, changing 87% of the pre-approval matters for enterprise registration to post-approval or cancellation, reducing the administrative examination and approval matters of the department by 44%, and successively carrying out a series of reforms such as "first license and then certificate" and "three certificates in one". In particular, the pilot reform of "separation of licenses and licenses" has been deployed, and efforts have been made to promote the solution of the problem of quasi-camping difficulties.
At present, after a comprehensive clearance, a total of 523 business licenses involving enterprises have been carried out, basically covering 30% of the 1381 industry sub-categories in the current Classification of National Economic Industries. From the initial reform pilot to the gradual promotion to the whole country, through the reduction of certificates after the license and the simplification of approval, to promote the solution of the problems of "more certificates" and "difficulty in handling certificates" before the operation of market entities, the burden of enterprise work has been continuously reduced, the enthusiasm for innovation and entrepreneurship has been released, and the development vitality of market entities has been effectively stimulated.
Xiong Maoping, deputy director of the State Administration for Market Regulation, said that the five pilot free trade zones of Shanghai, Tianjin, Guangdong, Guangxi and Chongqing have significantly reduced the local enterprise-related business licenses to less than 5, and Zhejiang has cancelled all local enterprise-related business licenses. Since the reform pilot on December 1, 2019, 413,400 new enterprises have been established in the national pilot free trade zone, and 201,800 households have benefited from the reform, accounting for 48.81%, which has really reduced the burden of certification for enterprises.
Of course, in addition to stimulating the vitality of market players, the reform of separation of licenses and licenses has also accelerated the transformation of government functions. "The convenience of lowering the threshold for market access will be given to enterprises, and the challenge of supervision during and after the event will be left to the government", and relevant regions and departments have also carried out many innovative explorations in credit supervision and smart supervision. In addition, since the reform of "separation of licenses and licenses", we have vigorously promoted the reduction of links, materials, time limits and fees for the approval of enterprises, so that enterprises can make independent decisions and innovate and develop in a fair, transparent and convenient environment.
Xiong Maoping said that from the pilot situation, some high-frequency business matters, such as the issuance of health permits in public places, the filing and registration of foreign trade operators, the qualification identification of construction enterprises, food production and operation licenses, and the registration of advertisements, accounted for more than 50%, and the effect of enterprises enjoying policy dividends was obvious. Third-party assessments show that 85 percent of the surveyed companies believe that the degree of facilitation of licensing after the reform is relatively high.
The State Council issued a notice proposing that from July 1, 2021, the full coverage list management of enterprise-related business licensing matters will be implemented nationwide, and the reform of the approval system will be promoted in accordance with four methods, such as direct cancellation of approval, approval for filing, implementation of notification commitments, and optimization of approval services, and at the same time, further increase the reform pilot in the pilot free trade zone.
Zhao Longfei, head of the Government Function Transformation Office of the General Office of the State Council and the Coordination Bureau of the State Council Review and Reform Office, introduced that compared with the previous rounds of reform, the current round of deepening the reform of "separation of licenses and licenses" is first of all to further expand the scope and promote the practice of full coverage list management to the whole country, and secondly, to implement the reduction of certificates after licenses and simplify examination and approval with greater efforts.
Zhao Longfei said that the number of examination and approval items directly cancelled nationwide has reached 68, 15 items of examination and approval have been changed to filing, 37 items of notification commitments have been implemented, and some practical reform measures such as decentralization of authority, streamlining of materials, and reduction of time limits have been determined one by one for optimizing examination and approval services. On this basis, the FTZ has further intensified its reform, adding 14 pilot cancellation approvals, changing approvals to 15 for the record, and implementing 40 notification commitments.
Specifically, there are 68 matters involving enterprises that directly cancel the examination and approval, including foreign trade, engineering construction, transportation and logistics, intermediary services and other fields. After the cancellation of the approval, the enterprise can obtain a business license to carry out business.
The 15 business license matters related to enterprises that have been examined and approved for the record include trade circulation, education and training, medical treatment, food, finance and other fields. The implementation of the notification commitment of 37 items related to the business license of enterprises, including agriculture, manufacturing, production services, daily consumption, telecommunications, energy and other fields. After the implementation of the notification commitment, the relevant competent departments should list the conditions for the business license that are quantifiable and operable and do not contain the bottom clauses in accordance with the law, clarify the regulatory rules and the consequences of violating the commitment, and inform the enterprise at one time. Where an enterprise voluntarily makes a commitment and submits materials as required, an examination and approval decision shall be made on the spot.
Only if we can control it, can we let it go and put it well. Deepening the reform of separation of licenses and licenses, how to strengthen supervision during and after the event? Zhao Longfei introduced that the document clarifies the specific measures to strengthen supervision during and after the event for each enterprise-related business license matter. It is required that all regions and relevant competent departments improve regulatory rules in accordance with the reform method, improve regulatory methods in combination with the characteristics of the industry, and clarify the regulatory responsibility subjects for specific matters to ensure that they can be opened, received and managed well. At the same time, it is also required that the registration authorities and the competent departments of the industry cooperate to strengthen the exchange and sharing of information, timely grasp the situation of newly established enterprises, dynamically adjust the scope of supervision, and prevent the emergence of a regulatory vacuum.
