This case occurred in Qiannan, Guizhou, the man's name is Luo Shixin, born in 1993, from Duyun City, Guizhou Province. He and his girlfriend Yang Yilin (pseudonym) met in February 2018.

In August of the same year, after Yang Yilin proposed to break up, Luo Shixin saw that there was no hope of reconciliation, so he killed the other party by cruel means.

According to Luo Shixin's confession, he and his girlfriend Yang Yilin knew each other for 5 months, and after an argument, his girlfriend proposed to break up with her. "I wanted to meet her on October 30, 2018 and she disagreed. I said that two days is my birthday, and you come to spend my birthday with me. ”

Luo Shixin recalled that under his repeated persuasion, Yang Yilin finally agreed to eat together.

On November 1, Luo Shixin and his girlfriend had dinner and wanted each other to spend the last night with him. After his repeated pleading, Yang Yilin finally agreed.

While sleeping in the hotel that night, Luo Shixin tried to hug Yang Yilin, but was refused, and then he threatened, "If you don't want to, I will kill you." ”

After the two rested in the hotel room for half an hour, Yang Yilin went out to buy water and called her stepfather Mo to pick her up. Luo Shixin was afraid that Yang Yilin would leave at this time, so he followed him.

At about 22:00 that night, when he reached a gas station, Luo Shixin saw that there was no hope of reconciliation, so he had the idea of killing Yang Yilin. Under the pretext of hugging her one last time, he grabbed her neck with his right hand and covered her mouth with his left hand, dragging her to the open space next to the gas station.

Luo Shixin picked up the stone and slammed Yang Yilin's head many times, and used a knife to cut and stab the woman's right wrist, abdomen and other parts, and finally saw that she no longer moved, so she drove away from the scene.

When fleeing to 53 kilometers of the Wang'an Expressway in Chengheng County, Luo Shixin stopped in the emergency lane for about two hours because the vehicle ran out of fuel. When he was about to get up and leave, he met a high-speed traffic policeman, who, under interrogation, confessed to his behavior of fleeing after killing people.

As for the tools used in the crime, Luo Shixin said that it was a knife that he had bought before to scrape his nails.

During the court trial, Luo Shixin's defender argued that Luo Shixin had turned himself in and compensated Yang Yilin's relatives 50,000 yuan after the incident, and that he was sincere in his remorse, and that he was also a first-time offender and a crime of passion.

At the same time, he also claimed that the victim and the defendant had lived together for half a year, but they said that they would leave, causing the defendant to feel that he had been deceived of his feelings, youth, and money, and that the victim had a certain fault for triggering the case.

The court found that the victim's opinion that there was a certain degree of fault in causing the case did not conform to the principles of freedom of love and freedom of marriage, so it was not adopted. However, Luo Shixin actively compensated the victim's relatives for economic losses after the incident, showed remorse, and the case was caused by emotional disputes, which is different from the crime of seeking wealth and killing people, and should reflect the criminal justice policy of blending leniency with severity, and the defense opinion that the defendant is a first-time offender and a crime of passion is consistent with the facts ascertained, and this court adopts it.

In the end, Luo Shixin was convicted of intentional homicide, sentenced to life imprisonment, and demanded compensation of 50,000 yuan for the victim's relatives.
