If individual parties make false statements for illegal purposes, it is not only difficult to "win the lawsuit", but also may receive a "fine" from the court, and may even constitute the crime of false litigation. A few days ago, the district people's court decided to fine the plaintiff who made a false statement during the trial of a traffic accident liability dispute case with a fine of 3,000 yuan.
In June this year, the District People's Court held a hearing on a dispute between plaintiff Wang and defendant Liu and an insurance company over a motor vehicle traffic accident. During the trial, plaintiff Wang claimed that the vehicle driven by defendant Liu mou had collided with his vehicle, resulting in damage to the vehicle and needed to be repaired. Wang mou said that he was a driver of an online car, and because the repair of the vehicle could not be operated, resulting in losses from suspension, he demanded that the second defendant compensate for the losses caused by the 14 days of repairing the car for a total of 4900 yuan. An insurance company believed that the repair time was too long and raised objections, but Wang insisted that the repair time he claimed was true, and the two sides argued.
After the trial, the judge held that the vehicle was not seriously scraped and that the repair time was doubtful. In order to ascertain the facts of the case, the driving trajectory information and photos of Wang's vehicle were retrieved, and it was found that his vehicle was actually only parked in the repair shop for 4 days, and other times were operated within the city.
After repeatedly informing Wang of the legal consequences of truthful statements and false statements, he still insisted that the repair was not operated during the 14-day period. Finally, after the judge showed him the driving record and photos, he admitted that he had not made a truthful statement and wrote a letter of remorse to the judge on the spot.
In the end, the District People's Court ordered an insurance company to pay the plaintiff a total of 1138 yuan for a 4-day outage loss. At the same time, for the plaintiff's deliberate misrepresentation, which affected the normal litigation order, and still refused to make a truthful statement after repeated interpretations, a decision was made to impose a fine of 3,000 yuan in accordance with article 63 of the Several Provisions of the Supreme People's Court on Evidence in Civil Proceedings, and the plaintiff paid the fine in a timely manner after receiving the notice.
