After trial, it was ascertained that from 2010 to 2016, defendant Tian Wen took advantage of her position as director of the Liuzhou Municipal Bureau of Land and Resources, deputy secretary of the Liujiang County CPC Committee, and county magistrate of the Liujiang County People's Government, and other positions to seek benefits for relevant units and individuals in project contracting, land development, participation in and promotion of shantytown transformation, examination and approval of certificates, etc., and accepted a total of 3.973 million yuan in money from Wen Heyu, Li Zhengya and others.
The Liuzhou Intermediate People's Court held that defendant Tian Wen, as a state functionary, took advantage of his position to seek benefits for others and illegally accepted a total of 3.973 million yuan of other people's property, and his conduct constituted the crime of accepting bribes, and the amount was particularly huge. The charges charged by the public prosecution were convicted.
In view of the fact that Tian Wen was able to truthfully confess to the same kind of relatively serious crime that the judicial organs had not yet grasped after her return to the case, and voluntarily withdrew most of the stolen funds obtained from bribery, and had statutory and discretionary mitigating circumstances, the court made the above judgment in accordance with law on the basis of the facts, nature, and circumstances of Tian Wen's crime and the degree of harm to society.
