The services provided by the confinement nanny centre in this contract shall be agreed by both parties to be complied with after both parties agree to set the terms. For the purposes of this contract, the term "confinement center" refers to the provider who provides all or part of the services listed in Article 4, and is not limited to the name of the confinement center.

Article 1 The rights and obligations of both parties shall be in accordance with the terms of this contract; If there is no agreement in this contract, it shall be determined in accordance with relevant laws, regulations or the principle of good faith.

The special agreement between Party A and Party B shall be more effective than the terms of this standard contract.

Article 2 When Party A and Party B sign this contract, they shall clearly indicate the date and period of the scheduled admission to the confinement center, and the weeks before and after the scheduled date shall be valid.

The actual effective date of the contract is subject to the date of admission to the confinement center.

Article 3 Party B's buildings shall comply with the relevant provisions of the Construction Law and the Fire Protection Law on public safety, and its equipment shall meet the standards for the establishment of postpartum care institutions.

Article 4 Party B shall provide the following services

1. Equipped with physicians or nursing staff to assess the health status of the mother or baby.

2. The place where the baby lives, breastfeeding, washing work, milk powder or other related items are provided.

3. Places where the mother lives, meals, clothing and washing.

4. Maternity care and infant care and health recovery courses.

5. Provision of books, newspapers and magazines.

Please refer to the appendix for details of the contents and charges of the above services.

Article 5 The reservation deposit of this contract shall be RMB (lowercase) _______ (uppercase).

Article 6 In order to take into account the safety and rest of the mother and the baby, the visiting time for the mother is from _____ a.m. to ______ a.m. and from ______ p.m. to ______ p.m. every day, and the time for visiting the baby is from _______ a.m. to _______ a.m. every day.

Article 7 In order to take into account the safety and rest of the mother and baby, Party B shall not allow the salesman to enter and sell goods to the mother.

Article 8 Party B shall fulfill its obligations for the care and safety management of mothers and infants. Party B shall not hand over the baby to anyone without the written consent of Party A. When Party A is not a mother, the written consent of the mother shall be obtained, and if the baby is taken away by Party A alone. However, if it is shown that it is contrary to public order and good customs to be taken away by Party A, Party B shall notify the public security organ to assist in handling it.

When the mother is discharged from the hospital, the baby should be discharged from the hospital at the same time, and if there is a need to extend the baby's care, the content and fees of the baby's care should be agreed separately.

Article 9 In the event of an emergency, serious illness or other emergency accident involving a mother or baby, Party B shall immediately send the mother or baby to the hospital for treatment, and at the same time take appropriate rescue measures according to its equipment, and immediately notify the emergency contact person.

Article 10 Before the actual effective date of the contract mentioned in the second paragraph of Article 2, if the mother or baby is unable to accept Party B's services due to death, illness, poor health or other reasons not attributable to Party A, Party A may terminate the contract, and Party B shall refund all the reservation deposit paid by Party A.

In addition to the above reasons, Party A may terminate the contract before the actual effective date of the contract referred to in Paragraph 2 of Article 2. However, Party B can only confiscate the reservation deposit paid by Party A, and shall not claim other damages.

Article 11 During the existence of the contract, if the mother or baby must be discharged from the hospital due to death, illness, poor health or other reasons not attributable to Party A, Party A may terminate the contract, and Party B shall offset the reservation deposit as part of the hospitalization expenses, and charge according to the services that have been incurred, and shall not charge any additional fees.

Article 12 Before the actual effective date of the contract mentioned in Paragraph 2 of Article 2, if Party B is unable to perform the contract due to natural disasters, wars and other reasons not attributable to Party B, Party A may terminate the contract, and Party B shall refund all the reservation deposit paid by Party A.

Before the actual effective date of the contract referred to in Paragraph 2 of Article 2, if Party B cannot prove that there are any reasons in the preceding paragraph, resulting in the inability to perform the contract, Party A may terminate the contract, and Party B shall double the deposit paid by Party A, and Party A may also claim damages if Party A can prove that it has suffered other damages as a result.

Article 13 During the existence of the contract, if it is unable to continue to accept Party B's services due to reasons attributable to the mother or baby, Party B may terminate the contract and charge according to the services that have been incurred without any additional fees.

In the above case, after Party B requests Party A to terminate the contract, _______% of the total cost of the number of days during the scheduled stay in the confinement center shall be regarded as the total amount of damages. However, it shall not exceed % of the total cost.

Article 14 During the existence of the contract, if it is impossible to continue to perform the contract due to reasons attributable to Party B, Party A may terminate the contract, and may request that after the termination of the contract, _______% of the total cost of not reaching the number of days during the scheduled stay in the confinement center be used as damages, and if Party A can prove that it has suffered other damages as a result, Party A may separately claim damages.

Article 15 Party B shall be liable for compensation for the damage caused to the mother or baby due to the safety or health danger of the services provided by Party B.

Article 16 When Party B is liable for damages in accordance with the provisions of Article 15, the maximum amount of compensation to each person shall not exceed RMB _______.

If the claimant for damages can prove that Party B was intentional or negligent, it is not subject to the above maximum amount of compensation.

Article 17 Dispute Resolution

1. The formulation and interpretation of this Agreement and the resolution of disputes arising during its implementation or related to this Agreement shall be governed by the laws currently in force of the People's Republic of China.

2. Disputes arising from the performance of this contract shall be settled by both parties through negotiation or mediation by relevant departments; If negotiation or mediation fails, it shall be resolved in accordance with the following methods (only one can be selected):

(1) Submit to the ________ Arbitration Commission for arbitration;

(2) Filing a lawsuit with the ___________ People's Court in accordance with the law.

Article 18 After the conclusion of this contract, the fees may be increased or decreased or the content of the contract may be changed by mutual agreement.

Article 19 This contract shall be kept in duplicate by both parties A and B, and Party B shall not take it back for any reason.
