Chapter I: General Provisions
First in order to strengthen and standardize the management of geographical names, to meet the needs of economic and social development, people's lives and international exchanges, the inheritance and development of excellent Chinese culture, these regulations are formulated.
Article 2 These Regulations shall apply to the naming, renaming, use, cultural protection and related management activities of geographical names within the territory of the People's Republic of China.
Third place names in these Regulations include:
(1) the name of the physical geographic entity;
(2) the name of the administrative division;
(3) The name of the location of the villagers' committee or residents' committee;
(4) the names of urban parks and nature reserves;
(5) The name of the street or lane;
(6) The names of residential areas and buildings with important geographical significance;
(7) The names of transportation, water conservancy, electric power, communications, meteorology, and other facilities with important geographical significance;
(8) The names of other geographic entities with important geographical significance.
Fourth place names management should adhere to and strengthen the leadership of the Party. The naming or renaming of administrative divisions at or above the county level, as well as the naming, renaming, and use of geographical names, involving major matters such as national territorial sovereignty, security, foreign affairs, and national defense, shall be reported to the Party Central Committee in accordance with relevant regulations.
The management of geographical names should be conducive to safeguarding national sovereignty and ethnic unity, promoting the core values of socialism, promoting the modernization of the national governance system and governance capacity, and inheriting and developing the excellent Chinese culture.
Geographical names should remain relatively stable. Without approval, no unit or individual shall decide to name or change the name of the place without authorization.
Fifth naming, renaming, use, cultural protection of geographical names shall comply with laws, administrative regulations and relevant provisions of the State, reflect the local geographical, historical and cultural characteristics, respect the wishes of the local people, convenient production and life.
Sixth people's Governments at or above the county level shall establish and improve the coordination mechanism for the management of geographical names, guidance, supervision and supervision of the management of geographical names.
Seventh civil affairs department of the State Council (hereinafter referred to as the Administrative Department of geographical names under the State Council) is responsible for the unified supervision and management of the national geographical names work.
Foreign affairs, public security, natural resources, housing and urban-rural construction, transportation, water conservancy, culture and tourism, market supervision, forestry and grassland, language work, press and publication and other relevant departments of the State Council, within the scope of their respective responsibilities are responsible for the management of relevant geographical names.
The administrative departments of geographical names of the local people's Governments at or above the county level are responsible for the management of geographical names in the administrative region. Other relevant departments of the local people's Governments at or above the county level shall, in accordance with the division of responsibilities prescribed by the people's Governments at the same level, be responsible for the management of relevant geographical names in their respective administrative areas.
Eighth local people's Governments at or above the county level geographical names administrative departments in conjunction with the relevant departments to prepare the administrative area of the geographical names programme, approved by the people's Governments at the same level after the implementation of the organization.
Chapter II naming and renaming of place names
Nineth place name by the proper name and common name two parts. The naming of geographical names shall comply with the following provisions:
(1) The meaning is clear, healthy, and does not violate public order and good customs;
(2) Conform to the actual region, scale, nature, and other characteristics of the geographic entity;
(3) Use the standard spoken and written language of the country and avoid the use of rare characters;
(D) generally not in the name of the person, not in the name of the leader of the country as the name of the place;
(E) not to foreign names, place names as place names;
(F) not to the name of the enterprise or the name of the trade name as a place name;
(7) The names of well-known domestic physical geographic entities and the names of administrative divisions at or above the county level within the country should not be duplicated, and homophony should be avoided;
(8) The names of townships and towns within the same provincial-level administrative area, the names of villagers' committees and residents' committees within the same county-level administrative area, the names of streets and alleys in the same built-up area, and the names of residential areas and buildings with important geographical significance in the same built-up area should not be duplicated, and homophony should be avoided;
(9) Do not use the names of well-known domestic physical geographic entities, historical and cultural heritage sites, and geographic entities beyond the scope of the administrative region as the proper name of the administrative division;
(10) The names of transportation, water conservancy, electric power, communications, meteorology and other facilities with important geographical significance shall generally be unified with the geographical names of the localities.
Laws and administrative regulations have other provisions on the naming rules of geographical names, from its provisions.
Tenth place names named according to law, due to changes in administrative divisions, urban and rural construction, natural changes and other reasons resulting in place names that do not match, should be renamed in a timely manner. The renaming of geographical names shall comply with the provisions of Article 9 of these Regulations.
Place names that have important historical and cultural value and reflect the historical context of China shall generally not be renamed.
11th organs, enterprises and institutions, grass-roots mass autonomous organizations, etc. to apply for naming, renaming shall submit an application. The application shall include the following materials:
(1) The plan and reasons for naming or changing the name;
(2) Basic information such as the location, scale, and nature of the geographic entity;
(C) the Administrative Department of geographical names under the State Council shall submit other materials.
The naming and renaming of administrative divisions shall be in accordance with the provisions of the "Regulations on the Administration of Administrative Divisions", and a risk assessment report, an expert demonstration report, and a report soliciting the opinions of the public shall be submitted. Naming and renaming of other geographical names, should take into account factors such as social impact, professionalism, technicality and closeness with the lives of the masses, organize and carry out comprehensive assessments, expert demonstrations, solicit opinions and submit relevant reports.
12th approval of the naming and renaming of geographical names shall comply with the following provisions:
(1) The naming or renaming of well-known domestic physical geographic entities that have important historical and cultural value, embody the historical context of China, and have a major social impact, or that involve two or more provinces, autonomous regions, or municipalities directly under the Central Government, and the naming or renaming of residential areas involving the direction of national boundaries and the boundaries of islands, islands and reefs at sea, as well as natural geographic entities and the locations of villagers' committees and residents' committees in boundary treaties and protocols, shall be applied for by the people's governments of the relevant provinces, autonomous regions, and municipalities directly under the Central Government; report to the State Council for approval; The naming and renaming of uninhabited islands, sea areas, and seabed geographic entities shall be approved by the competent department of natural resources under the State Council in conjunction with relevant departments; The naming and renaming of other physical geographic entities shall be approved in accordance with the provisions of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government;
(2) The naming and renaming of administrative divisions shall be approved in accordance with the provisions of the Regulations on the Administration of Administrative Divisions;
(3) The naming or renaming of the locations of villagers' committees and residents' committees other than those provided for in the first paragraph of this article shall be approved in accordance with the provisions of the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government;
(4) The naming and renaming of urban parks and nature reserves shall be approved in accordance with relevant state provisions;
(5) The naming and renaming of streets and alleys shall be approved by the people's governments of municipalities directly under the Central Government, cities and counties;
(F) has an important geographical significance of residential areas, building naming, renaming, by the municipalities, cities and counties of the people's Governments of housing and urban-rural development departments to solicit the opinions of the people's Governments at the same level of geographical names administrative departments after approval;
(7) The naming and renaming of transportation, water conservancy, electric power, communications, meteorology and other facilities with important geographical significance shall solicit the opinions of the relevant local people's governments at or above the county level where they are located according to the circumstances, and shall be approved by the relevant competent departments.
13th place name naming, renaming, by the approval authorities from the date of approval within 15 days in accordance with the following provisions submitted for the record:
(A) the relevant departments of the State Council approved the geographical names submitted to the State Council for the record, the filing materials sent to the Administrative Department of geographical names of the State Council;
(B) the local people's Governments at or above the county level approved the geographical names submitted to the people's Government at the next higher level for the record, the filing materials sent to the administrative departments of geographical names of the people's Governments at the next higher level;
(C) the local people's Governments at or above the county level geographical names administrative departments approved by the geographical names submitted to the people's Governments at the next higher level of geographical names administrative departments for the record;
(D) other relevant departments approved by the geographical names submitted to the competent administrative departments of geographical names of the people's Governments at the same level for the record.
14th in accordance with the provisions of these Regulations, the people's Governments at or above the county level or by the local people's Governments at or above the county level geographical names administrative departments approved by the geographical names, from the date of approval within 15 days, by the people's Governments at the same level of geographical names administrative departments to the public; Other relevant departments of the people's Governments at or above the county level approved place names, from the date of filing for the record within 15 days, by the competent administrative departments of geographical names of the people's Governments at the same level to the public.
Chapter III Use of Geographical Names
15th place names should be used standards, norms.
The Roman alphabet spelling of place names is based on the "Chinese Pinyin Scheme" as a unified standard, in accordance with the rules formulated by the administrative department of geographical names under the State Council in conjunction with the relevant departments of the State Council.
In accordance with the provisions of these Regulations, the approval of the place name is a standard place name.
Standard geographical names shall conform to the norms for the examination and approval of the pronunciation of geographical names and the norms for the translation and writing of Chinese characters for geographical names in minority languages and foreign Chinese geographical names.
16th geographical names administrative departments of the State Council to establish a unified national geographical names information database, published standard geographical names and other information, give full play to the national geographical names information database in the service of the masses of life, social governance, scientific research, national defense construction and other aspects of the positive role, improve the level of service informatization, intelligence, facilitation, convenient for the public to use.
17th local people's Governments at or above the county level between the administrative departments of geographical names and other relevant departments should establish and improve the mechanism for the co-construction and sharing of geographical names information resources.
18th within the following scope must use standard geographical names:
(A) place name signs, traffic signs, advertising plaques and other signs;
(2) Information published through newspapers, periodicals, radio, television, and other news media, as well as public platforms such as government websites;
(3) Legal documents, identity certificates, commercial housing pre-sale permits, real estate ownership certificates and other types of official documents and certificates;
(4) Dictionaries and other tools, as well as teaching materials, teaching aids, and other learning publications;
(5) Maps that are open to the public;
(F) laws and administrative regulations shall use other situations of standard geographical names.
19th standard place names and related information should be marked on the place name signs. No unit or individual shall set up, dismantle, move, alter, obscure, or damage the place name sign without authorization.
20th local people's Governments at or above the county level shall strengthen the setting and management of place name signs.
21st municipalities, cities and counties of the people's Governments of geographical names administrative departments and other relevant departments shall, within the scope of their respective responsibilities, according to the standard geographical names to prepare standard addresses and set signs.
22nd standard geographical names publications by the geographical names agency is responsible for the collection and publication. Among them, the names of administrative divisions shall be collected and published by the departments responsible for the specific management of administrative divisions.
Chapter IV cultural protection of geographical names
23rd people's Governments at or above the county level shall, from the history and reality of the mainland geographical names, strengthen the public welfare publicity of geographical names culture, organize research and inheritance of geographical name culture.
24th people's Governments at or above the county level shall strengthen the protection of geographical names and cultural heritage, and meet the requirements of the cultural heritage of geographical names included in the scope of protection of intangible cultural heritage.
25th local people's Governments at or above the county level geographical names administrative departments shall, within the administrative area has important historical and cultural value, reflecting the Chinese historical context of the geographical names of the census, do a good job of collection, recording, statistics, etc., the development of protection directory. Included in the list of protected geographical names really need to be renamed, the local people's Governments at or above the county level shall formulate corresponding protection measures in advance.
26th local people's Governments at or above the county level shall do a good job in the management of geographical names archives. Specific measures for the management of geographical names archives, formulated by the Administrative Department of geographical names under the State Council in conjunction with the State archives administrative department.
27th State encourages citizens, enterprises and social organizations to participate in the protection of geographical names culture.
Chapter V: Supervision and Inspection
28th higher level of the people's Governments of geographical names administrative departments should strengthen the lower level of the people's Governments of geographical names administrative departments of geographical names management guidance, supervision. Other relevant departments of the people's Governments at higher levels shall strengthen the guidance and supervision of the management of geographical names of the corresponding departments of the people's Governments at the lower levels.
29th administrative departments of geographical names of the people's Governments at or above the county level and other relevant departments shall, in accordance with law, strengthen the naming, renaming, use, supervision and inspection of cultural protection.
The people's Governments at or above the county level shall strengthen the capacity building of geographical names management.
30th place names administrative departments and other relevant departments of the people's Governments at or above the county level to supervise and inspect the management of geographical names, have the right to take the following measures:
(A) to inquire about the parties, to investigate the situation related to the management of geographical names;
(2) Inspecting and reproducing relevant materials;
(C) the implementation of on-site inspections of places suspected of illegal acts of geographical names;
(D) inspect items related to suspected geographical name violations;
(5) Other measures provided for by laws and administrative regulations.
When the competent administrative departments of geographical names of the people's Governments at or above the county level and other relevant departments exercise the functions and powers provided for in the preceding paragraph, the parties shall assist and cooperate, and shall not refuse or obstruct.
31st administrative departments of geographical names of the people's Governments at or above the county level and other relevant departments found in the supervision and inspection of the naming, renaming, use, cultural protection of problems, shall promptly put forward rectification proposals, issued a notice of rectification, according to law to the relevant departments to deal with the recommendations; When necessary, relevant responsible persons suspected of violating the provisions of these Regulations may be given a talk to and reported to the public.
32nd administrative departments of geographical names of the people's Governments at or above the county level and other relevant departments may entrust a third-party agency to assess the naming, renaming, use, cultural protection and other circumstances of geographical names.
33rd any unit or individual found in violation of the provisions of these Regulations, may be reported to the competent administrative departments of geographical names of the local people's Governments at or above the county level or other relevant departments. The department receiving the report shall handle it in accordance with law. The relevant departments shall keep the informant's relevant information confidential.
Chapter VI: Legal Responsibility
34th local people's Governments at or above the county level place names approval organs in violation of the provisions of these Regulations for naming, renaming, by the administrative organs at the next higher level ordered to correct, the approval of the responsible leaders and other directly responsible personnel shall be punished according to law.
35th local people's Governments at or above the county level geographical names approval organs do not submit for the record or not submitted on time for the record, by the Administrative Department of geographical names under the State Council or the Administrative Department of geographical names of the people's Government at the next higher level to notify the approval organ, deadline to submit; and where the report is not made within the time limit, the directly responsible personnel are to be given sanctions in accordance with law.
36th article in violation of the provisions of the fourth, ninth, tenth and twelfth articles of these Regulations, without authorization to name names, renamed, by the administrative organs with the right of examination and approval shall be ordered to rectify within a time limit; and where corrections are not made within the time limit, they are to be banned, and the violating units are to be circulated for criticism.
37th in violation of the provisions of article 18th of these Regulations, not used or not standardized use of standard geographical names, by the local people's Governments at or above the county level geographical names administrative departments or other relevant departments ordered to rectify within a time limit; where corrections are not made within the time limit, the offending unit is to be circulated for criticism, and the relevant competent departments are to be notified to handle it in accordance with law; The legally-designated representative or principal responsible person, directly responsible managers and other directly responsible personnel of the illegal unit are to be fined between 2,000 and 10,000 RMB.
38th unauthorized setup, demolition, moving, alteration, blocking, damage to the place name signs, by the place name sign setting, maintenance and management departments ordered to correct and responsible personnel fined more than 1,000 Yuan and 5,000 Yuan.
39th third-party institutions on the naming, renaming, use, cultural protection and other circumstances issued a false assessment report, by the local people's Governments at or above the county level geographical names administrative departments to give a warning, there are illegal gains, confiscation of illegal gains; If the circumstances are serious, it is prohibited to engage in the assessment of geographical names within 5 years.
40th public employees in the management of geographical names have abuse of power, dereliction of duty, favoritism, sanctions shall be given in accordance with law.
Chapter VII Supplementary Provisions
41st rules and procedures for naming and renaming geographical entities of geographical entities and celestial geographic entities outside the jurisdiction of the State Council shall be formulated by the competent administrative department of geographical names under the State Council in conjunction with relevant departments.
Article 42 The naming and renaming of commemorative facilities and sites shall be handled in accordance with the relevant provisions of the State.
43rd Administrative Department of geographical names under the State Council may, in accordance with the provisions of these Regulations, formulate specific implementation measures.
Article 44: These Regulations take effect on May 1, 2022.
