Flying in the sky, running on the ground, swimming in the water.... Many people love "wild meat" and hunt wild animals to satisfy their appetites, but did you know that this behavior has broken the law?
On August 14, the Huairou Court's Environmental Resources Court formed a seven-member collegial panel to hear a civil public interest lawsuit attached to the criminal case of illegal hunting. Bi Yanying, deputy to the Municipal People's Congress and vice president of the School of International Relations, Yang Fengxia, Liang Yanling, and Zheng Linxia, deputies to the District People's Congress, Zou Xiquan, a member of the District Political Consultative Conference, and staff from the Landscaping Bureau and the Township Judicial Office were invited to observe the trial.
The public prosecution alleged that the defendant Li Moumou illegally hunted 1 Chinese impala in a village in Huaibei Town, Huairou District. After identification, the impala involved in the case is a national second-class key protected wild animal, with an overall value of 50,000 yuan. During this period, defendant Li XX illegally hunted 3 wild rock squirrels, 1 wild roe deer, and 1 wild civet cat on his own contracted land and an orchard in a village in Huaibei Town, Huairou District. After identification, the species involved in the case were all wild animals protected by the national "three haves", with a total value of 4,650 yuan.
Wildlife resources belong to the state and are an important part of the ecological environment, and defendant Li XX illegally hunted wild animals without obtaining a hunting license, and his conduct violated hunting laws and regulations and the state's management system for the protection of wildlife resources, destroying the ecological balance and species diversity, and causing harm to the national interest and the social public interest.
In the course of the trial, the court conducted a courtroom investigation and courtroom debate on the facts of the crime alleged by the public prosecution, organized the prosecution and defense to fully present evidence and debate the facts and evidence of the case, and issued prosecution and defense opinions, so as to protect the procedural rights of the parties in accordance with law. Defendant Li Moumou pleaded guilty and accepted punishment in court, "I realize that my behavior has violated the law, and I will never commit it again in the future, and I will also publicize the importance of ecological and environmental protection to my neighbors." ”
After trial, the Huairou Court held that the defendant Li Moumou illegally hunted and killed rare and endangered wild animals under national key protection, violated hunting laws and regulations, and used prohibited tools to hunt in the hunting ban area and during the hunting ban period, destroying wildlife resources, and the circumstances were serious. In view of the fact that defendant Li XX truthfully confessed the facts of the crime after arriving at the case, he voluntarily pleaded guilty and accepted punishment. Based on the facts, nature, and circumstances of defendant Li's crime, as well as the degree of harm to society, he was sentenced to one year imprisonment, suspended for one year, and fined 5,000 yuan for the crimes of endangering precious and endangered wildlife and illegal hunting; compensation of RMB 54,650 for the loss of wildlife resources; The media at or above the municipal level publicly apologize to the public. After the verdict was announced, defendant Li XX indicated that he would not appeal. The case has not yet entered into force.

After the trial, the Huairou Court and the Huairou Procuratorate jointly held a symposium on environmental resources trial work, and reached a consensus from the aspects of deepening the concept change, extending the trial function of environmental resources, building a professional trial team, and internal and external coordination and linkage, and continuing to base itself on the functional positioning of the important carrying place of the capital and the ecological conservation area, and contributing to the beautiful Huairou where man and nature coexist in harmony.
Bi Yanying, deputy to the Beijing Municipal People's Congress and vice president of the School of International Relations, said that through observing the trial on the spot, he deeply realized the importance of the judicial organs playing the role of the last bastion of fairness and justice in ecological and environmental protection. Environmental public interest litigation plays a unique and irreplaceable role in ecological protection. The Huairou Judiciary has done a good job of practical exploration. It is hoped that the Huairou Court will continue to increase the publicity of environmental resources trials and raise the awareness of environmental resources protection in the whole society.
