At that time, Zhang Lianfeng was playing cards outside and lost a lot of money. He remembered that he hadn't completely deleted Qiao Yunyun's naked chat video, so he chose to use the naked chat video to ask Qiao Yunyun for money again. Qiao Yunyun ignored him.

Zhang Lianfeng was annoyed and angry, he found the accounts of Uncle Qiao Yunyun and Uncle San on the short video platform, and sent Qiao Yunyun's naked chat video to the two. At this point, Qiao Yunyun's family understood what happened to Qiao Yunyun.

The first case of indecent assault on an adult female in Yichang City

On June 7, 2023, at the suggestion of his family, Qiao Yunyun chose to report the case. Qiao Yunyun told the police that from June 1 to 4, Zhang Lianfeng repeatedly asked her for money on the grounds of sending videos of her naked chats to others.

After being summoned by telephone, Zhang Lianfeng took the initiative to go to the police station for investigation and admitted the facts related to his extortion. The public security organs handled the case as an administrative case in advance and imposed a penalty of 15 days of administrative detention on Zhang Lianfeng.

However, in the process of handling this case, the public security organs found that Zhang Lianfeng was also suspected of coercing Qiao Yunyun under the pseudonym "Li Hua" to chat with him naked through QQ video from October to November 2022, and then tried to rape Qiao Yunyun unsuccessfully at a hotel in Yidu on January 11, 2023. On July 18, 2023, the Yidu Municipal Public Security Bureau filed a case for investigation, and on September 11, the case was transferred to the Yidu Municipal Procuratorate for review and prosecution.

After review, the Yidu City Procuratorate believes that the criminal suspect Zhang Lianfeng used the method of deception and coercion to ask the victim to video chat naked and touch sensitive parts of the body for the purpose of satisfying sexual stimulation, and his behavior violated Article 237 of the Criminal Law, and he should be investigated for criminal responsibility for the crime of compulsory indecency. Criminal suspect Zhang Lianfeng violently raped a woman, and his conduct violated article 236 of the Criminal Law, and he should be investigated for criminal responsibility for the crime of rape.

When Zhang Lianfeng committed the violation, the hotel cleaning staff had already heard Qiao Yunyun's call for help at the door, and the staff of the hotel customer service department also quickly came to the scene. Therefore, Zhang Lianfeng's act of stopping the infringement was caused by factors other than will, and even if the harmful consequences did not occur, it was the factors outside the will that outweighed the factors that actively terminated it. Based on the actual circumstances at the scene of the crime, it is reasonably inferred that Zhang Lianfeng's rape should be an attempted crime. Criminal suspect Zhang Lianfeng extorted property from others for a relatively large amount, and his conduct violated article 274 of the Criminal Law, and he should be investigated for criminal responsibility for the crime of extortion.

After the Yidu City Procuratorate initiated a public prosecution, on January 15, 2024, the Yidu City Court made a first-instance judgment that the defendant Zhang Lianfeng was sentenced to six years in prison and fined 2,000 yuan for the crimes of forcible indecency, insult, rape, and extortion.

Zhang Lianfeng was dissatisfied with the verdict and appealed. On April 1, 2024, the Yichang Intermediate People's Court made a second-instance judgment and upheld the original judgment.

Lu Yinsheng, the prosecutor handling the case, told Fangyuan: "Relevant guiding cases and judicial interpretations clearly define the act of 'indecency with minors' in the air, but there is no clear provision that the target of the crime is an adult woman." Based on this, we held several joint meetings to discuss whether the 'target of crime' could be extended and whether the boundaries of the protection of women's rights and interests should be relaxed, and then gradually eliminated the differences and formed a relatively consistent determination opinion, which was finally adopted by the court. ”

It is understood that this case is the first case of conviction of an adult female in Yichang City, effectively filling the legal gap in the crackdown on such crimes that infringe on women's personal rights and interests.

During the handling of the case, the prosecutor of the Yidu City Procuratorate learned that Qiao Yunyun's family environment was relatively poor, and because of long-term harassment, he suffered from severe depression and moderate anxiety disorder, so he took the initiative to help him, contacted the legal aid center, and assigned a female lawyer to provide him with support in writing criminal attached civil complaints, collecting evidence, appearing in court to respond to the lawsuit, and replying, and also coordinated with the Women's Federation to appoint professional psychological counselors to carry out psychological counseling for him, and arranged special follow-up visits to help Qiao Yunyun return to normal life.

After the lawsuit, the court of first instance ruled that Zhang Lianfeng should compensate Qiao Yunyun for medical expenses, lost work expenses and other losses of more than 15,000 yuan. Due to Zhang Lianfeng's inability to perform, Lu Yinsheng transferred judicial aid clues to the Third Procuratorate Department of the court, and continued to follow up on the progress of the handling.
