"The lake is sparkling, and the fish and shrimp are swimming freely" is a vivid portrayal of the scenery of Cuiping Lake. Cuiping Lake is the largest artificial freshwater lake in Fujian Province, known as the "Fujian Thousand Island Lake", the mother lake of the Gutian people, and a national 4A-level tourist attraction, and won the title of National Ecological Aquaculture Demonstration Zone. In order to further improve the ecological industry chain of Cuiping Lake, Gutian County Aquaculture Farm releases a large number of fish fry into the waters of Cuiping Lake every year, but many criminals take this as a "business opportunity" and take advantage of the dead of night to drive boats to cast nets to illegally fish for economic benefits, and eventually they are "caught".
Between December 2022 and August 2023, defendant Huang Moumou and three others took a wooden boat to the waters of Cuiping Lake several times at night, and poached fish in the waters of Cuiping Lake by placing fishing nets and ground cages and sold them to obtain illegal economic benefits. The Gutian County People's Procuratorate prosecuted Huang and three others for theft. Eventually, the three were sentenced by the court for theft.

In order to protect the fishery resources and ecological environment of Cuiping Lake, since 2011, the waters of Cuiping Lake have been put into and cultivated by the Gutian County Aquaculture Farm, a state-owned enterprise owned by the whole people, and are clearly positioned as breeding organic fish, and the label of quality and safety traceable aquatic products has been hung up, so as to realize the traceability management of quality and safety information throughout the whole process of traceability of source traceability, verifiable whereabouts and accountability. In 2012, the county government issued the "Notice on the Protection of Fishery Resources of Cuiping Lake", indicating that no unit or individual may engage in aquaculture activities and illegal fishing in the waters of Cuiping Lake without permission.

Article 340 of the Criminal Law of People's Republic of China: Whoever violates the laws and regulations on the protection of aquatic resources by fishing aquatic products in prohibited areas, during prohibited fishing periods, or by using prohibited tools and methods, and the circumstances are serious, shall be sentenced to fixed-term imprisonment of not more than three years, short-term detention, controlled release or a fine.
Article 29 of the Fishery Law of the People's Republic of China: The State shall protect aquatic germplasm resources and their living environment, and establish aquatic germplasm resources protection areas in the main growth and breeding areas of aquatic germplasm resources with high economic value and genetic breeding value. Without the approval of the fishery administrative department of the State Council, no unit or individual shall engage in fishing activities in the aquatic germplasm resources protection zone.
Article 30 of the Fishery Law of the People's Republic of China: It is forbidden to use methods that damage fishery resources, such as exploding fish, poisoning fish, and electrocuting fish. It is forbidden to manufacture, sell, or use prohibited fishing gear. It is forbidden to fish in closed areas and during closed fishing periods. It is forbidden to use nets smaller than the minimum mesh size for fishing. No more than a prescribed proportion of juveniles should be caught. The sale of illegally caught fish is prohibited in closed areas or during closed fishing periods.
