According to the 1818 Golden Eye report, the ideal L6 owner Xiao Ding had a problem on the 9th day of picking up the car, and the ideal side said that the motor needed to be replaced after testing. According to the report, the landing price of this car is about 260,000 yuan, Xiao Ding and the ideal side have negotiated many times, and the other party's plan is to replace the motor for free and send some customer care, and Xiao Ding wants to "return the car".
In this regard, Manager Xu of Li Auto Hangzhou Yuhang Service Center responded that because it does not meet the "three guarantees" return and exchange policy, there is no way to return and exchange cars for users. Considering that the user is a new car, from the perspective of user experience, we are also actively helping users apply for some care programs, but there is no final consensus with the customer.

Xiao Ding, the owner of the car, believes that the "Zhejiang Automobile Three Guarantees" in Zhejiang Province stipulate that the quality problems of major parts such as engines can be returned within 60 days, and the engine of the oil car is equivalent to the motor of the tram. Ideally, the engine is not the same as the electric motor.
If the main parts of the motor fail on the 9th day of pick-up, does the consumer have the right to return the vehicle? Fu Jian, director of Henan Zejin Law Firm, told the Red Star News reporter that in the case of the ideal L6, if the motor of the vehicle does fail, and this failure affects the normal use and safety performance of the vehicle, the consumer has the right to ask the manufacturer or seller to repair or replace it accordingly. However, the specific identification process needs to be carried out in accordance with the relevant technical standards and testing procedures. The "Three Guarantees" regulations on automobile products are mainly based on the Law of the People's Republic of China on the Protection of Consumer Rights and Interests and the Provisions on the Liability for Repair, Replacement and Return of Household Automobile Products. These regulations clarify the liability for repair, replacement, and return of household car products in the event of quality problems within a certain period of time, as well as related compensation provisions.
Zhao Liangshan, a senior partner at Shaanxi Hengda Law Firm, believes that the "Provisions on the Responsibility for Repair, Replacement, and Return of Household Automobile Products" will be implemented from January 1, 2022, commonly known as the "Three Guarantees Regulations". Article 20 of the "provisions" stipulates that within 60 days from the date of validity of the three guarantees or within 3,000 kilometers of mileage (whichever comes first), due to the quality problems of the main parts of the engine, transmission, power battery and driving motor, consumers can choose to replace the engine, transmission, power battery and driving motor with the three guarantees certificate. The implication of the law is that if there is a problem with the motor, the motor can only be replaced.
In addition, according to the provisions of the "Zhejiang Automobile Three Guarantees", the failure of the steering system, the failure of the braking system, the cracking of the body, the fuel leakage, the failure of the safety device, the spontaneous combustion of the vehicle or the loss of control of the vehicle due to other quality problems, or the main parts of the engine and transmission have product quality problems, the vehicle can be replaced or returned, and the relevant scope of return and exchange does not involve the "motor". Therefore, there is no legal basis for requesting the return and replacement of the whole vehicle just because of the motor problem.
Relevant regulations of "Zhejiang Automobile Three Guarantees".
The Red Star News reporter inquired and found that the full name of "Zhejiang Automobile Three Guarantees" is "Measures for the Implementation of the Law of the People's Republic of China on the Protection of Consumer Rights and Interests in Zhejiang Province", which was promulgated and implemented by the Standing Committee of the Zhejiang Provincial People's Congress on May 1, 2017. Article 27 of the Measures states that within 60 days from the date on which the seller issues a uniform invoice for the sale of motor vehicles, or within 3,000 kilometers of mileage (whichever comes first), there is a failure of the steering system, a failure of the braking system, a crack in the body, a fuel leak, a failure of the safety device, spontaneous combustion of the vehicle or other quality problems caused by the loss of control of the vehicle, or the main parts of the engine or transmission have product quality problems. Sellers or producers of household automobile products shall, at the request of consumers, replace or return the whole vehicle, and compensate for losses in accordance with law.
In addition, in addition to the provisions of the state to implement the repair, replacement, return (hereinafter referred to as the three guarantees) of the goods, the provincial administrative department for industry and commerce shall, in conjunction with the provincial quality and technical supervision, commerce and relevant industry authorities, according to the actual provisions of the province to implement the three guarantees of the commodity catalogue and the corresponding commodity three guarantees of validity period, three guarantees of responsibility.
According to an expert from the Zhejiang Provincial Consumer Protection Committee, the "Zhejiang Automobile Three Guarantees" was promulgated and implemented on May 1, 2017, when new energy vehicles had not yet emerged, so there were no regulations on new energy vehicles, only the definition of oil vehicles, and the new regulations will be revised this year.
