Case 1: A kitchen and bathroom appliance distribution department in Wuda District operated and sold unqualified gas appliances
On May 20, 2024, the Market Supervision Bureau of Wuda District, Wuhai City, imposed an administrative penalty of a fine of 1,000 yuan (4,797 yuan) and confiscation of illegal gains (1,197 yuan) for the illegal acts of a kitchen and bathroom appliance distribution department in Wuda District.
On February 5, 2024, the Market Supervision Bureau of Wuda District, Wuhai City, received a notice of case assignment from the Wuhai Market Supervision Bureau and attached an inspection report, which showed that a kitchen and bathroom household appliance distribution department in Wuda District was suspected of selling the heat load of the left furnace, the CO concentration in the dry flue gas of the right furnace, the size of the embedded opening in the sign, and the quality information in the sign did not meet the GB16410-2020 "Household Gas Cooker" and GB30720-2014 "Energy Efficiency Limit and Energy Efficiency Grade of Household Gas Stove" The party concerned did not apply for re-inspection of the unqualified household gas stove required by the relevant requirements. After investigation, on September 1, 2023, the party purchased a total of 3 household gas stoves of this batch from Zhongshan Weipai Jin Kitchen and Bathroom Electrical Appliances Co., Ltd., with a purchase price of 1,200 yuan/unit, a selling price of 1,599 yuan/unit, and a total value of 4,797 yuan. Except for the 1 unit inspected by the inspection and testing agency, the remaining 2 units have been sold, so the illegal income is 1,197 yuan. The above-mentioned acts of the parties violated the provisions of Article 13 of the Product Quality Law of the People's Republic of China, and constituted an illegal fact of operating and selling unqualified household gas cookers. In accordance with the provisions of Article 49 of the Product Quality Law of the People's Republic of China, the Market Supervision Bureau of Wuda District, Wuhai City, imposed administrative penalties on the parties in accordance with the law.
Case 2: Case of a home appliance business department in Wuda District selling uncertified products
On December 21, 2023, the Wuda District Market Supervision and Administration Bureau made an administrative penalty decision of fining one thousand yuan and confiscating the items involved in the case for the illegal acts of a household appliance business department in Wuda District in accordance with the law.
On October 16, 2023, law enforcement officers from the Wuda District Market Supervision and Administration Bureau supervised and inspected a home appliance business department in Wuda District. During the on-site inspection, it was found that there were 3 household gas stoves, two of which had a QS production license and no 3C certification mark, and one had no QS production license and no 3C certification mark. Law enforcement officers shall seize the above products in accordance with the law. On October 31, 2023, the Wuda District Market Supervision and Administration Bureau filed a case for investigation into the home appliance business department. After investigation, the above three gas stoves were purchased from the Internet by the home appliance business department, and they were placed in the sales area for sale, and the three gas stoves did not have 3C certification marks.
The sale of uncertified gas cookers by the home appliance business department violated the provisions of Article 27 of the Regulations of the People's Republic of China on Certification and Accreditation. constitutes an offence for the sale of uncertified products. In accordance with the provisions of Article 66 of the Regulations of the People's Republic of China on Certification and Accreditation, the Wuda District Market Supervision Bureau imposed administrative penalties on the parties in accordance with the law.
Case 3: A lighting store in Wuda District sells substandard gas cookers
On June 21, 2023, the Wuda District Market Supervision and Administration Bureau made an administrative penalty decision of fining two hundred yuan (280 yuan) and confiscating the items involved in the case for the illegal acts of a lighting store in Wuda District in accordance with the law.
On January 31, 2024, the law enforcement officers of the Market Supervision and Administration Bureau of Wuda District, Wuhai City, supervised and inspected a lighting store in Wuda District, and found a single-stove gas stove on the north shelf in the business premises, the product model is JZT-A2, and the manufacturer is Alinda (Guangdong) Electrical Appliance Manufacturing Co., Ltd., the product has no 3C logo, and the law enforcement officers seized the gas stove in accordance with the law. After investigation, the lighting store purchased a single-burner gas stove with the model JZT-A2 from Alinda (Guangdong) Electrical Appliance Manufacturing Co., Ltd. in the first half of 2023, with a price of 280 yuan, which was not sold. The sale of uncertified gas cookers by the home appliance business department violated the provisions of Article 27 of the Regulations of the People's Republic of China on Certification and Accreditation. constitutes an offence for the sale of uncertified products. Gas cooker is included in the scope of the compulsory certification catalogue of products, inferior quality, no 3C certification of gas cooker has greater quality problems and safety hazards, circulation to the market, consumers are easy to cause safety accidents when using, endangering the safety of life and property of the masses. It is hoped that the investigation and handling of the above cases can play a warning and alerting role for the relevant market operators, and when operating gas cooker supplies, the purchase inspection and acceptance system should be established and implemented, and the gas cooker must be of qualified quality and obtain the CCC certification certificate, marking the CCC certification mark, and also remind consumers to look for the manufacturer's brand and 3C certification certificate when buying gas stoves to prevent their rights and interests from being damaged.
