In November 2021, Yin borrowed 2,400 yuan from a financial company through an online platform for personal consumption, and Yin only repaid the principal and interest of one period, and the remaining loan was not repaid on time. Due to repeated unsuccessful reminders, a financial company sued Yin to the court in July 2023, demanding that Yin repay the loan.
After trial, the court held that the loan contract signed by the plaintiff and the defendant was an expression of the true intentions of both parties, did not violate the provisions of the law, was legal and valid, and both the plaintiff and the defendant should perform their respective obligations in accordance with the contract. After the plaintiff granted the loan to the defendant in accordance with the contract, the defendant should repay the principal and interest on time according to the contract, but after the defendant repaid the first installment of the loan and interest, the balance was not repaid on time, so the defendant should be liable for breach of contract according to the contract. In the end, the court ordered Yin to repay the principal and corresponding interest of the loan of a financial company within a time limit.
The judge reminded: In life, don't blindly compare, pursue enjoyment, and carry out "advanced consumption" and "excessive consumption" for the sake of face.
