At the same time, it adheres to the concept of "linkage and integration" and improves the participation mechanism of "social coordination". The court set up a special "specially invited mediation room", established a "specially invited mediation + judicial confirmation" working model, and actively connected with grassroots organizations such as township comprehensive management centers, people's mediation committees, judicial offices, and police stations, and built a hierarchical and progressive multiple dispute resolution system for grassroots mediation, pre-litigation diversion and resolution, and efficient post-litigation resolution, striving to find the best way to resolve conflicts and disputes and improve the efficiency of conflict and dispute mediation. At the same time, it actively explores the dispute resolution model of "mediation + withdrawal", and invites park staff, enterprise representatives, and employee representatives to participate in mediation during litigation, so that mediation is given priority and due diligence should be adjusted. Since 2023, the court has judicially confirmed 28 cases involving enterprises, effectively reducing the burden of corporate litigation. In 2024, in the case of a service contract dispute between a service company in Guizhou and a technology company in Guizhou, the court immediately appointed a people's mediator after receiving the complaint, and with the joint efforts of the court and the people's mediator, a technology company in Guizhou voluntarily promised to pay off the service fee of 66,000 yuan, and a service company in Guizhou also took the initiative to give up the interest of 13,000 yuan, successfully stopping the dispute before the lawsuit, which not only safeguarded the legitimate rights and interests of the enterprise, but also effectively reduced the burden on the enterprise.
Practicing Active Justice to Help Enterprises Rescue a "New Chapter"
Efficient handling of all kinds of enterprise-related cases is another measure taken by the big data court to resolve conflicts and disputes involving enterprises and reduce the burden of enterprise litigation. Adhere to the problem-oriented, take the assessment of the impact of production and operation of enterprise-related cases as the traction, formulate plans for long-term unresolved cases involving enterprises, and complete them within a time limit, effectively accelerate the progress of handling enterprise-related cases, continue to enhance the accuracy and effectiveness of service enterprises, and make every effort to eliminate the adverse impact of long-term inability to conclude litigation cases on the operation of enterprises. Since 2023, the court has accepted 68 litigation cases involving enterprises, and concluded 56 cases, with a completion rate of 82.35%, of which the application rate of summary procedures has reached 85%, focusing on reducing the time and cost of enterprise dispute resolution, so that enterprises can truly feel the efficient "trial speed". In addition, in the case of an application for preservation of an enterprise, the court prudently freezes the basic bank account of the enterprise, and in principle does not freeze the account determined by the enterprise to be used for the payment of wages, so as to support the reasonable replacement of the preserved property, and strive to achieve the organic unity of legal and social effects. For example, in a lease contract dispute case, a hotel company in Guizhou applied for the seizure and freezing of an account in the name of a housing development company in Guizhou. Later, because the real estate development company voluntarily used its other fixed assets as guarantees, considering that the bank account in the name of the real estate development company belonged to the supervision account of commercial housing pre-sale funds and needed to be used for the development and construction of real estate projects, it was finally decided to replace the preserved property, so as to minimize the impact of the preservation procedure on the normal business activities of the enterprise, and create a harmonious and mutually understanding business environment based on the rule of law.
