Thallium nitrate poisoning is purchased online

According to the first-instance verdict, Wang Yao has searched for materials related to thallium nitrate, colchicine and other poisons many times, and also searched for online materials such as "My husband and children have passed away, can I inherit the property of my in-laws".

According to public information, thallium is a slow-onset highly toxic substance with insidious symptoms. Thallium is colorless and odorless when dissolved in water, and it is not easy to detect after being drunk.

According to the first-instance verdict, in November 2021, Wang Yao spent 465 yuan to buy 3 grams of colchicine online from a trading company in Xi'an. Wang Yao confessed that she tried it too hard and threw it away after buying it, and then went to buy thallium nitrate. At the same time, she said that she had previously swiped a case of someone poisoning with thallium on the video website, and she had the idea of poisoning Yang algae with thallium. In January 2022, Wang Yao purchased 25 grams of thallium nitrate from the above company for 1,700 yuan through WeChat.

According to the first-instance verdict, at the end of January 2022, Wang Yao returned to her hometown with her husband's family for the New Year. Wang Yao confessed that she had no chance to poison a few days before returning to the village, and when she learned that her mother-in-law was going to hold a birthday banquet for Ah Mao, she was very angry and had the idea of putting thallium nitrate for Ah Mao to eat.

On February 4, 2022, just after Amao's first birthday, at noon that day, Wang Yao took advantage of the fact that others were out to eat and there was no one at home, and threw thallium nitrate into the can of Amao milk powder. On the same day, Ah Mao developed symptoms such as diarrhea and fever after eating milk powder and was sent to the clinic for treatment, and then transferred to Fuzhou Children's Hospital for treatment.

Thallium was detected in Amao blood, Yangzao blood, feeding bottles, milk powder, and the toilet in Wang Yao's home.

Ah Mao was in a coma for a while and was diagnosed after a week in the PICU. On February 22, 2022, a young man from the Lin family posted on Weibo to seek medicine. "Prussian blue, the antidote to thallium, is rare." The young man told Red Star News that he then contacted a hospital in Beijing with the help of the Internet and took 10 bottles of medicine.

The child's grandmother, Huang Yue, said that she had never thought that her little granddaughter and youngest son would be poisoned. After the hospital found out that it was thallium poisoning, they told them that it was poisoned artificially, but they didn't believe it, and finally the hospital reported it to the police.

In the early morning of February 28 of the same year, Wang Yao was arrested at his residence. According to the verdict, Wang Yao initially denied poisoning that day, and then confessed to poisoning Ah Mao.

The child, Da Bolin Jianxiong, said that he was arrested together at the time and was later dismissed from suspicion.

Little aunt "unexpectedly" dies

He was identified as suffering from multiple organ failure due to poisoning

After Wang Fang was arrested, he confessed to poisoning his brother-in-law, and the "accidental" death of Mao's father Lin Jianwei was brought out more than half a year ago.

According to the first-instance judgment, on March 10, 2021, Wang Yao spent 775 yuan through WeChat to purchase 5 grams of colchicine online from the above-mentioned trading company. On March 18, Wang Yao went to the store and secretly pinched a small pinch of colchicine and put it in Lin Jianwei's rice bowl. That night, Lin Jianwei had severe diarrhea and went to the clinic for treatment.

At the beginning of June of that year, Lin Jianwei had another gastrointestinal discomfort, and on June 25, Lin Jianwei drank beer at home at night and ate two servings of crayfish, and the next day he went to the hospital for diarrhea and vomiting, treated as appendicitis, and transferred to the First Affiliated Hospital of Fujian Medical University on June 27. Only two days later, Lin Jianwei died after rescue efforts failed, and his body was cremated the next day.

At that time, the Lin family thought it was an emergency illness and did not do an autopsy, but the doctor took Lin Jianwei's blood sample and sent it to Shenzhen for pathogenic microbial examination. Retained blood samples become key evidence for the future.

According to the first-instance verdict, in March 2022, thallium was not detected in Lin Jianwei's ashes, and the content of colchicine in blood isolates (plasma) and (blood cells) in his retained blood samples exceeded lethal blood concentrations.

According to an expert review opinion from a forensic appraisal center, Lin Jianwei died of multiple organ failure caused by colchicine poisoning. According to the materials submitted for testing, it cannot be ruled out that he was poisoned again before his death.

First instance judgment

The eldest aunt was sentenced to death and compensated more than 700,000 yuan

In April 2023, the Fuzhou Municipal People's Procuratorate indicted Wang Yao, and A Mao and Yang Zao filed an attached civil lawsuit. In May 2023, the Fuzhou Intermediate People's Court held a first-instance trial of the case.

One of the focuses of the trial was whether Wang Yao poisoned Lin Jianwei to death a second time, and Wang Yao did not admit to poisoning twice.

According to the first-instance verdict, Wang Yao's defender submitted that there was no evidence to show that Wang Yao injected colchicine again after March 2021, which was a suspension of the crime. In addition, although colchicine was found in blood samples, Lin Jianwei's body was not autopsied, and the cause of death was unknown; The expert review opinion is not an appraisal conclusion and cannot be used as evidence.

In this regard, the court of first instance held that the expert opinion could be accepted as an inspection report. Although Wang Yao did not confess to poisoning Lin Jianwei again, other evidence corroborated each other and formed an evidence chain to confirm his re-poisoning behavior, which is sufficient to determine that Lin Jianwei's death was caused by Wang Yao's poisoning. The available evidence has not found other circumstances that may cause death, and it should be determined that there is a criminal law causal relationship between Wang Yao's poisoning and the result of Lin Jianwei's death.

The defense counsel once argued that Lin Jianwei had drunk beer and taken cephalosporins before his death, and that the improper medication for his death could not be ruled out. The court held that the act of poisoning itself was sufficient to cause death, and even if the above-mentioned acts had an impact on the outcome of his death, it was not enough to block the causal relationship between Wang Yao's act of poisoning and the result of the victim's death.

Regarding poisoning Ah Mao, Wang Yao once argued that after accidentally shaking all the thallium nitrate into the milk powder can, he was worried that Ah Mao would die if he ate it, so he dug out half of it. In this regard, the court held that after searching for information such as the lethal amount of thallium nitrate several times, he still poisoned him knowing that thallium was dead, and Wang Yao should be found guilty of intentional homicide and an attempt to commit a crime.

The court sentenced Wang Yao to death for intentional homicide in the first instance. In the part of the attached civil lawsuit, the court supported the compensation of more than 700,000 yuan.

Mr. Chen, a person close to the trial of the case, said that Wang Yao had a strong desire to exonerate himself, repented in court, and wept bitterly. Mr. Chen revealed that Wang Yao failed to seek the Lin family's understanding.

But Yang Zao agreed that Lin Jianxiong did not know about it. She called the brothers "in a good relationship", and her brother could not imagine that his wife would do such a thing.

The entanglement behind serial poisoning

As for the cause of poisoning, the first-instance verdict shows that according to the testimony of witnesses, Wang Yao and Lin Jianwei's family have a conflict of interest and emotional conflict in real estate. Wang Yao poisoned Lin Jianwei because he was dissatisfied with the store and wanted to fight for more benefits; The poisoning of Ah Mao was due to dissatisfaction with the fact that the property rights of the store were inherited by Ah Mao after Lin Jianwei's death, and had a conflict with his brother-in-law Yang Zao.

In this regard, Lin Jianxiong explained that his parents verbally said that the old house and store were given to his younger brother, and the better house by the river was given to him, and the two suites were more than 100 square meters.

In Lin Jianxiong's description, Wang Yao has a very strong personality, and he used to ask for a storefront, but his family didn't buy it. Huang Yue's testimony showed that she heard her sister say that Wang Yao had said that the store should be half for one person.

Lin Jianxiong's testimony shows that Wang Yao believes that his mother-in-law is partial to his brother-in-law's family. Yang Zao also admitted frankly that the relationship between the two concubines is not good, but they live separately and do not meet much.

Lin Jianxiong said frankly that he and Wang Yao got engaged and got a certificate in less than a month after a blind date, and there is not much emotional foundation, but after giving birth to three children, there will be "bonds". He was very busy with business, he went out early and returned late, and sometimes when he didn't go home, Wang Yao would lose his temper with him and vent his dissatisfaction.

Yang Zao said that he and Lin Jianwei also knew each other on a blind date, but their relationship was good. Yang Zao had never found that there would be such a big contradiction when the family was not separated. Afterwards, she recalled that her husband had told her to "go to Nanping", and she regretted not leaving.

In the eyes of the villagers, Wang Yao is beautiful, tall, white-skinned, "literate", and has few words.

Two years after the poisoning:

According to the first-instance verdict, after evaluation, nearly a year after the incident, Ah Mao thallium was poisoned with serious sequelae such as quadriplegia, and it was identified as a first-degree serious injury, constituting a first-degree disability.

The appraisal certificate issued nearly a year after the case showed that Ah Mao still had problems such as poor consciousness content, backward gross motor development, unsteady head up, inability to turn over, and poor control ability. The hospitalization certificate of Fuzhou Children's Hospital in Fujian Province diagnosed him with severe pneumonia, sequelae of toxic encephalopathy, symptomatic epilepsy (secondary epilepsy), etc.

When the reporter met Ah Mao, she had just been discharged from the hospital. The 3-year-old is limp and has stiff fingers, her head droops down when she sits upright, and she doesn't react much to the outside world, Huang Yue said she "laughs when she's in a good mood." According to the nanny, the feeding can only be broken and fed, and it takes an hour to eat a meal.

Lin Jianxiong said that in fact, Mao's organs, including his lungs, have failed. She had no resistance, could not go out, accidentally caught a cold and fever, and had to go to the ICU eight times out of ten hospitalizations.

The pain of one death and one serious injury in this family continues to this day. Recently, Ah Mao was hospitalized with pneumonia again and was admitted to the ICU again. Huang Yue said that she had asked many hospitals, but there was no good treatment. In the past two years, I spent about five or six hundred thousand yuan for Ah Mao, not counting the cost of a nanny.

The Lin family is still waiting for the second-instance verdict. Lin Jianxiong said that considering the issue of property distribution, he chose not to divorce Wang Yao first.

The reporter learned that shortly after Ah Mao was poisoned, Yang Zao returned to his parents' home, and after that, Ah Mao was taken care of by the Lin family by a nanny. Yang Zao said that since her husband's death, she has had conflicts with the Lin family, and she cannot stay in the Lin family after the relationship broke down. She now has to work to earn a living, and she can't afford to take Ah Mao, but she only visits the nanny occasionally every month, and rarely meets the Lin family.
