What are the conditions for the payment of the high temperature allowance?

Enterprises, public institutions, individual economic organizations and other employers shall pay high temperature allowance to employees if they arrange for their workers to work in the open air in hot weather (the maximum daily temperature reaches 35°C or above) and cannot take effective measures to reduce the temperature of the workplace to below 33°C (excluding 33°C). The temperature shall be subject to the meteorological station (station) issued by the provincial meteorological department.

Anhui Province stipulates that the standard of high temperature allowance is not less than 15 yuan per person per working day, which is the minimum standard. Employers should establish a high-temperature allowance system, and reasonably determine the scope and specific standards of high-temperature allowance for their own units through collective negotiation in combination with the characteristics and specific conditions of production and operation.

What are the rules that must be followed?

Employers shall not deduct or reduce employees' wages due to the suspension of work or shortening working hours due to high temperatures, and shall not reduce employees' wages due to increasing high temperature allowances. The minimum wage does not include a high temperature allowance.

During hot weather

What protective measures should employers take?

First, if the maximum daily temperature reaches more than 40 °C, outdoor operations should be stopped on that day.

Second, when the maximum daily temperature reaches above 37°C and below 40°C, the employer shall arrange for the employee to work outdoors for no more than 6 hours throughout the day, and the continuous operation time shall not exceed the national regulations, and shall not arrange outdoor work within 3 hours during the highest temperature period.

Third, when the maximum daily temperature reaches above 35°C and below 37°C, the employer shall shorten the continuous working time of the workers by changing shifts and taking breaks, and shall not arrange overtime for workers working outdoors and in the open air.

Fourth, employers shall not arrange for pregnant female employees and minors to engage in outdoor and open-air operations during hot weather above 35°C.

Fifth, the employer shall provide sufficient heatstroke prevention and cooling beverages that meet the health standards for workers working in hot weather. Heatstroke prevention and cooling drinks shall not be used to offset the high temperature allowance.

If an employee finds that the employer has violated the relevant regulations, he or she has the right to report and complain to the local social security, health, emergency management and other departments, as well as to the trade union organization.
