The "Regulations on International Cruise Ships Docking and Replenishing at the Ports of the People's Republic of China" was adopted at the 29th executive meeting of the State Council on March 22, 2024, and is hereby promulgated to take effect on June 1, 2024.

Regulations on the docking and replenishment of international cruise ships in the ports of the People's Republic of China

Article 1 These Provisions are formulated in order to improve the level of convenience for international cruise ships in ports of the People's Republic of China and promote the high-quality development of the cruise economy.

Article 2 The term "international cruise ship" as used in these regulations refers to foreign cruise ships and cruise ships of the People's Republic of China that sail on international routes.

These provisions shall apply to the activities of international cruise ships to obtain materials and related services required for their operation during their call at ports of the People's Republic of China.

Article 3 The State shall establish and improve systems and norms adapted to the port replenishment of international cruise ships, encourage international cruise ships to dock and replenish at ports of the People's Republic of China, protect the lawful rights and interests of international cruise operators, port replenishment materials and related service providers, and create a stable, fair, transparent and predictable business environment.

Article 4: The relevant departments of the State Council and the relevant local people's governments at or above the county level shall implement the Party and State's line, principles, policies, and decision-making arrangements, adhere to the overall national security concept, and strengthen information sharing, coordination, and service guarantees for international cruise ship docking and replenishment efforts.

The competent departments of development and reform and transportation under the State Council and the people's governments of relevant coastal provinces, autonomous regions and municipalities directly under the Central Government shall, in accordance with the layout of ports across the country, promote the construction of supporting facilities for international cruise ships to dock and replenish, expand service functions and enhance service capabilities.

The General Administration of Customs, in conjunction with the relevant departments of the State Council, will innovate the management model, improve the level of electronic, intelligent and standardization, optimize the customs clearance process, improve the efficiency of customs clearance, and reduce the cost of customs clearance.

The competent departments of industry and information technology, public security, finance, commerce, culture and tourism, emergency management, taxation, market supervision and management, tobacco monopoly, immigration management and other departments under the State Council shall do a good job of relevant work within the scope of their respective duties, and formulate policies and measures to facilitate the supply of international cruise ships at ports as needed.

The people's governments of the provinces, autonomous regions and municipalities directly under the Central Government where international cruise ships call at ports of call shall strengthen the organization and leadership of the port replenishment work, formulate policies and measures for the facilitation of supply in their respective regions on the basis of soliciting the opinions of the people's governments of the cities where the ports are located, and support and supervise the subordinate departments and units to perform their duties.

Article 5 The relevant departments of the State Council and the relevant local people's governments at or above the county level shall, in light of the actual situation, comprehensively use big data, artificial intelligence and other technical means to implement classified management of supplies at ports, improve the management measures such as customs clearance and warehousing of different types of materials, and promote the construction of international cruise material supply guarantee centers.

Article 6 Ship bunkering enterprises shall, in accordance with the relevant provisions of the State, carry out bonded oil supply business, enhance the supply capacity, and provide convenient and efficient services for international cruise ships that call at the port for replenishment.

Article 7 Port operators, shore power supply enterprises, and international cruise ship operators shall establish and improve coordination mechanisms, improve the management, use, maintenance and maintenance systems and operating procedures of shore power supply and receiving facilities, and ensure that international cruise ships calling at ports for supply use shore power in accordance with relevant regulations and safety standards。

Article 8 In accordance with the relevant laws and regulations and the provisions of the contract, the suppliers of supplies and related services for international cruise ships shall supply food, daily necessities, medicines, medical equipment, emergency rescue materials, ship spare parts and other materials required for the operation of international cruise ships, and provide relevant services.

If the supply materials for international cruise ships are restricted from leaving the country by the state, or exceed the quantity of international cruise ships for their own use, they shall go through customs formalities in accordance with the relevant regulations of the People's Republic of China on export goods;

If the materials taken off or unloaded by international cruise ships are restricted by the state, they shall go through customs formalities in accordance with the relevant regulations of the People's Republic of China on imported goods;

Article 9 The drugs and medical devices that need to be purchased from the territory of the People's Republic of China for international cruise ships shall be supplied by enterprises with the qualifications for the operation of drugs and medical devices.

If the drugs to be purchased by international cruise ships belong to the state under export license management, an application shall be submitted to the relevant competent department in accordance with the provisions of relevant laws and administrative regulations. The relevant competent departments shall promptly review the application, make a decision to approve or not permit, and inform the applicant.

Article 10 Duty-free tobacco products purchased from the territory of the People's Republic of China for international cruise ships shall be supplied by enterprises with duty-free tobacco product business qualifications. Duty-free tobacco products business enterprises shall, in accordance with the relevant provisions of the state, supply duty-free tobacco products for the personal use of international cruise ship staff and passengers on international cruise ships in reasonable quantities.

Article 11 The people's governments of the provinces, autonomous regions and municipalities directly under the Central Government where international cruise ships call at ports shall, on the basis of soliciting the opinions of the people's governments of the cities where the ports are located, formulate a list of commonly used low-risk materials for international cruise ships to call at their ports, and clearly allow ports within their respective administrative regions to supply the types and quantities of commonly used low-risk materials related to international cruise operations.

Providers of transportation, storage, and supply services for commonly used low-risk materials shall establish and improve a safety management system commensurate with the degree of danger of the relevant materials.

Article 12 Domestic materials supplied to international cruise ships may be exported in accordance with general trade or exported as inbound and outbound means of transport, and export tax rebates shall be handled in accordance with the relevant provisions of the State.

The Customs shall clarify the corresponding regulatory requirements for the materials exported in accordance with the general trade mode as specified in the preceding paragraph, and strengthen risk management;

Article 13 The materials required for the supply of international cruise ships at the port may be stored in special customs supervision areas or bonded places in accordance with the relevant provisions of the Customs. Customs shall provide facilitation conditions for the storage, distribution, transshipment, distribution, loading and unloading of relevant materials.

Article 14 Unless otherwise stipulated by the State, tariff quotas and licenses shall not be subject to tariff quotas or license management for international cruise ships that supply overseas materials at the port.

Unless otherwise stipulated by the state, if an international cruise ship docks at the port to replenish overseas materials, the same container can arrive at the port in the designated area and leave the port after unpacking, reloading, dismantling, and consolidation, and the specific measures shall be formulated by the General Administration of Customs.

Article 15 International cruise operators, supply materials and related service providers shall not endanger China's national security or harm the public interest, and shall abide by China's laws and regulations in port replenishment activities;

Those who violate these provisions and infringe upon the legitimate rights and interests of international cruise operators, port supply materials and related service providers shall bear legal responsibility in accordance with law.

Where the staff of the government and its relevant departments violate these provisions by dereliction of duty, abuse of power, or twisting the law for personal gain in the performance of relevant duties, they shall be held accountable in accordance with laws and regulations.

Article 16: These Provisions take effect on June 1, 2024.
