When an employer implements the minimum wage standard, it should exclude: overtime wages, special allowances for medium shifts, night shifts, high temperatures, low temperatures, underground, toxic and harmful, and welfare benefits for workers stipulated by the state.

20 regions: monthly minimum wage≥ 2,000 yuan

According to the Minimum Wage Regulations, different administrative regions within provinces, autonomous regions and municipalities directly under the Central Government may have different minimum wage standards.

Judging from the minimum wage standards in all regions of the country, there are 18 regions with the first monthly minimum wage standard of 2,000 yuan and above.

- What are the benefits of a rise in the minimum wage? -

1. Overtime pay With the increase of the minimum wage, the minimum calculation base of overtime wages and social security premiums should also be increased. The calculation of overtime wages shall be at least based on the minimum wage, and the overtime wages on weekdays, rest days, and statutory holidays shall be at least 1.5 times, 2 times, and 3 times the minimum wage standard converted according to the number of hours or days.

2. Unemployment insurance benefits Unemployment insurance benefits are also linked to the minimum wage. If the employer or the individual has paid contributions for one year but less than ten years, the unemployment insurance benefit is 70% of the minimum wage. For more than 10 years, it is 80% of the minimum wage. Therefore, once the minimum wage is raised, the benefits during the period of unemployment will also be increased accordingly.

3. Wages during the probationary period According to Article 57 of the Opinions of the Ministry of Labor on Several Issues Concerning the Implementation of the Labor Law of the People's Republic of China, after the formation or establishment of labor relations between the worker and the employer, the employer shall pay the employee a wage not lower than the minimum wage standard if he or she provides normal work during the statutory working hours during the probation, proficiency and probationary period. After the minimum wage is raised, the probationary wage received at the minimum wage will also be increased.

4. Take paid leave Under normal circumstances, the company will have some paid leave, such as annual leave, sick leave, maternity leave, work-related injury leave, etc., if the basic salary is set according to the minimum wage standard, then you can only get the minimum wage when taking paid leave.

Article 12 of the Interim Provisions on Payment of Wages stipulates that if the employer suspends work or production within one wage payment cycle due to reasons not attributable to the employee, the employer shall pay the employee wages according to the standard stipulated in the labor contract. If the wage payment cycle exceeds one period, if the worker provides normal work, the labor remuneration paid to the worker shall not be lower than the local minimum wage standard.

- Can the probationary salary be lower than the minimum wage? -

According to Article 15 of the Regulations for the Implementation of the Labor Contract Law:

During the probationary period, the salary of the employee shall not be lower than 80% of the minimum wage of the same position in the employer or 80% of the salary agreed in the labor contract, and shall not be lower than the minimum wage standard of the place where the employer is located.

In other words, the salary during the probation period can be discounted by up to "20%. However, if the salary for the probationary period is not expressly stipulated in the employment contract, then it should be paid according to the salary agreed in the contract and cannot be discounted arbitrarily.

- The minimum wage is adjusted at least once every few years -

According to Article 10 of the Minimum Wage Provisions, after the promulgation and implementation of the minimum wage standard, if the relevant factors specified in Article 6 of these Provisions change, it shall be adjusted in a timely manner. The minimum wage is adjusted at least once every two years.

The minimum wage is adjusted at least once every two years. In determining and adjusting the monthly minimum wage standard, reference should be made to factors such as the minimum cost of living for local employees and their dependents, the consumer price index for urban residents, the social insurance premiums and housing provident fund paid by individual workers, the average wage of employees, the level of economic development, and employment status.
