Case 1

On February 6, 2019, Hu Moumou, a villager living in Pu'an County, Southwest Guizhou Prefecture, took out a lighter he carried with him and lit the dead grass and set fire to the mountain when he passed by a hillside called "Babadi" on his way home. After the fire spread, Hu Damao continued to walk forward, and when he arrived at the place called "Changqing", he lit the fire again. Hu Moumou thinks, "If all these dead grass are burned, it will be much more convenient to herd cattle in the future!"

Eventually, two fires spread and caused widespread forest fires. According to the appraisal of the Pu'an County Forestry Bureau, the forest fire burned an area of 3,096.4 acres, and the burned forest area was 3,096.4 acres, and all the forest species were soil and water conservation forests in the shelter forest, with a total direct economic value of 3,870,500 yuan.

The Pu'an County People's Procuratorate prosecuted the case of Hu Moumou setting fire to the mountain in accordance with the law. Hu Moumou was sentenced to eight years in prison by the Pu'an County Court for arson. (Contributed by Hai'an Prison)

Case 2

On January 22, 2014, Jin was herding cattle to the Tuanpo Group of Angu Village, Huangsi Town, Fuquan City, and felt bored, so he used the lighter he carried with him to ignite the weeds on the ground for recreation. Jin set fire to the fire five times with a lighter, and after causing the fire, he allowed the fire to spread and did not put it out, nor did he inform others and relevant departments to rescue him, and fled the scene, eventually causing a forest fire with a total fire area of 246.6 hectares.

At about 18:40 the next day, six firefighters, including Yang, Zhang, and Liao, died on the spot due to the change in wind direction when they were digging a fire isolation zone at the nearby dripping rock. Knowing that arson on the mountain would cause a forest fire, Jin deliberately set fire to the hillside many times for recreation, causing a forest fire and causing the death of 6 firefighters. In the end, Jin was sentenced to life imprisonment for arson and deprived of political rights for life. (Contributed by Duyun Prison)

Case 3

At around 14 o'clock on March 20, 2023, He found that the door of the farm machine room was blown down by the wind, so he prepared to go to the back mountain to find a suitable wooden stick to come back to the door, and on the way up, he discarded the remaining unextinguished half of the cigarette at will, causing a forest fire. The forest fire has been burning for 5 days before it was completely extinguished, and the Pu'an County Forestry Bureau commissioned a third-party company to identify the 3.20 forest fire, the fire burned a total area of 24,190.9 acres, resulting in direct economic losses totaling 37,451,707.5 yuan. Case 4

On April 2, 2023, Li Moumou and his family illegally carried fireworks, firecrackers, paper money and other items to Yunbi Village, Baini Town, Zhijin County. In the process of worship, Li Moumou and his family set off fireworks and firecrackers in front of the grave, causing a large area of trees and grass to burn on the uphill slope behind the grave. Due to the dry weather and high winds, the fire quickly spread through the mountain forest. Seeing that the fire could not be controlled, the two hurriedly fled the scene, because the fire was too big, it spread to the back mountain, causing a villager who was working in the back mountain to escape before he could escape and was burned by the fire, a large number of woodlands and shrublands were burned, and the total area of the burned woodland was 95.1584 hectares, causing heavy losses.

Li Moumou constituted the crime of arson, and after the court judgment, Li Moumou was sentenced to three years and three months in prison, and the victim's family was compensated for economic losses. (Contributed by Wang Wu Prison)

Case five

On March 28, 2021, Su Moumou burned waste in his own field and accidentally caused a forest fire in a group of Erdaoyan Village, Panlong Town, Shuicheng District. After investigation and identification, the forest fire burned an area of 102.5774 hectares, and the economic loss was 685,530 yuan. Su Moumou was sentenced to three years in prison for the crime of arson, and publicly apologized to the public for negligence in the municipal media of Liupanshui City. Case 6

At about 10 o'clock on January 30, 2023, when Guo Moumou went to burn weeds in the soil of Dawantian, Songlin Group, Zhuchang Village, Xiaotun Township, Dafang County, he caused a forest fire from Meizigou to Yinggezui. According to the appraisal of the Dafang County Forestry Bureau, the fire burned an area of 6.5739 hectares. The burned forest land was classified as forested land, and the dominant tree species was Pinus yunnanensis. Guo Moumou committed the crime of arson and was sentenced to seven months in prison. Case 7

In January 2023, the criminal Ruan Moumou invited his third uncle Ruan Moumou to lead the way to the grave of his grandmother's grandmother in the "Dingba" slope of Xindong Village, Yandong Town, Liping County. In the process of going to the grave, Ruan Moumou violated the fire prevention ban that prohibits the use of fire in the wild, and illegally burned incense paper to ignite the surrounding weeds, which then caused a forest fire. The burned area was 27.2467 hectares.

Based on the facts, nature, circumstances, degree of harm to society, and expression of remorse for Ruan Moumou's crime, the Liping County People's Court ruled that Ruan Moumou committed the crime of arson and sentenced him to three years imprisonment. (Contributed by Qiandongnan Prison)

Criminal Law of the People's Republic of China:

Article 114 Whoever endangers public safety by arson, flooding, explosion, or the release of poisonous, radioactive, infectious disease pathogens, or other substances or by other dangerous means, but has not caused serious consequences, shall be sentenced to fixed-term imprisonment of not less than three years but not more than ten years.

Article 115 Whoever causes serious injury or death to a person or causes major damage to public or private property by setting fire, breaching water, exploding, or disseminating poisonous, radioactive, infectious disease pathogens, or other substances or by other dangerous means, shall be sentenced to fixed-term imprisonment of not less than 10 years, life imprisonment or death. Whoever commits the crime in the preceding paragraph by negligence shall be sentenced to fixed-term imprisonment of not less than three years but not more than seven years;

Fire Protection Law of the People's Republic of China:

Article 64: Whoever violates the provisions of this Law by committing any of the following acts, which does not constitute a crime, shall be detained for not less than 10 days but not more than 15 days, and may be concurrently fined up to 500 RMB;

(1) Instigating or forcing others to violate fire safety regulations and take risks;

(2) Negligence causes a fire;

(3) Obstructing the alarm after the fire has occurred, or failing to report to the police in a timely manner;

(4) Disrupting the order of the fire scene, or refusing to carry out the command of the fire scene commander, affecting fire fighting and rescue;

(5) Intentionally destroying or falsifying the scene of a fire;

(6) Unauthorized unpacking or use of places or parts that have been sealed by fire and rescue agencies.
