Announcement of compensation and resettlement plan

(Announcement [2024] No. 18)

In order to protect the needs of land use for public interests, in accordance with the "Land Management Law of the People's Republic of China", "Regulations on the Implementation of the Land Management Law of the People's Republic of China" and other laws and regulations, as well as the relevant provisions of the "Opinions of the General Office of the People's Government of Shandong Province on Standardizing the Management of Land Expropriation" (Lu Zheng Ban Zi [2022] No. 13), it is decided to expropriate the collective land of Dongdianzi Village of Fuzhuang Sub-district Office. The People's Government of Luozhuang District, Linyi City, organized relevant departments such as natural resources, finance, agriculture and rural affairs, human resources and social security, as well as the Fuzhuang Sub-district Office, to formulate a land acquisition compensation and resettlement plan for Dongdianzi Village of the Fuzhuang Sub-district Office based on the results of the land survey and the results of the social stability risk assessment. The announcement is as follows:

1. The purpose of the land to be expropriated

Plot 1 is intended to be used for the construction of industrial projects in the high-end equipment manufacturing area, and the use is industrial land, and the above plots are all located within the development scope approved by the Shandong Provincial People's Government in the "Reply to the Land Acquisition and Development Plan of Luozhuang District of Linyi City in 2023" (Lu Zheng Tu Zi [2023] No. 364).

The land to be expropriated for the above plots meets the needs of the public interest as stipulated in the fifth paragraph of Article 45 of the Land Management Law of the People's Republic of China.

2. The location, type and area of the land to be expropriated

This time, it is proposed to expropriate the land of Dongdianzi Village, Fuzhuang Sub-district Office, located in the west of Fuzhuang Sub-district, with a total area of 4.3248 hectares, including:

0.0398 hectares of agricultural land (0.0326 hectares of water and water conservancy facilities, 0.0072 hectares of transportation land);

4.2850 hectares of construction land (4.2850 hectares of industrial and mining land).

3. Compensation standards for land to be expropriated

The land compensation and resettlement fee to be levied shall be implemented in accordance with the comprehensive land price standard for the land expropriated in Luozhuang District, Linyi City, approved by the Shandong Provincial People's Government's "Reply on the Comprehensive Land Price of the Acquisition Area in Shandong Province" (Lu Zheng Zi [2023] No. 144). The land to be expropriated is located in the Class IV area, and the compensation standard is 1.05 million yuan/hectare. The total compensation and resettlement fee for land expropriation is 4,541,040 yuan.

The compensation standards for above-ground attachments and seedlings of the land to be expropriated shall be implemented in accordance with the standards stipulated in the "Reply to the Approval of the Compensation Standards for Above-ground Attachments and Seedlings for Land Acquisition in Linyi City" (Lu Natural Resources [2022] No. 56) issued by the Department of Finance of Shandong Province and the Department of Natural Resources of Shandong Province.

The compensation and resettlement of rural residences (or industrial and mining enterprises) involved in the land to be expropriated shall be implemented in accordance with the compensation and resettlement plan formulated by the People's Government of Luozhuang District, Linyi City in accordance with the relevant provisions of the state.

Fourth, the placement opinions

After consultation with the collective economic organization of Dongdianzi Village, Fuzhuang Sub-district Office, the following methods will be adopted for the resettlement of the agricultural population involved in the land to be expropriated.

(1) Monetary placement. After the expropriation of land compensation and resettlement fees is allocated to the village committee of Dongdianzi Village, Fuzhuang Sub-district Office, the specific distribution plan shall be discussed and decided by the members of the collective economic organization of the village.

(2) Social security placement. According to the standard of 281,475 yuan/hectare, the social security subsidy funds were allocated by the financial department of Luozhuang District to the special account for social security funds, totaling 1,217,323 yuan. In accordance with the relevant regulations and procedures, Fuzhuang Sub-district shall guide the Dongdianzi Village Committee of Fuzhuang Sub-district Office to organize and convene a villager representative meeting or villager general meeting, study and formulate a social security plan for land-expropriated farmers, and report it to the Luozhuang District Human Resources and Social Security Bureau for the record. After the expropriation of the land is approved in accordance with the law, the social insurance agency of Luozhuang District shall handle the insurance matters according to the pension insurance plan of the land-expropriated farmers.

5. Arrangements for compensation registration

The land owner, user and other relevant rights holders of the land to be expropriated shall, within 5 days after the end of the announcement, go to the Fuzhuang Street Land Office with the relevant ownership certification materials to register for compensation and sign the land acquisition compensation and resettlement agreement.

If the compensation registration and land acquisition compensation and resettlement agreement are not signed within the prescribed time limit, the "Land Ownership Survey Confirmation Form" and the "Land Use Right and Ground Attachments and Seedlings Survey Confirmation Form" (Annex 1) shall be used as the basis for compensation and resettlement.

6. Other matters

This announcement will be issued at the same time in the streets, villages and villager groups where the rural collective economic organizations involved in land expropriation are located and the land acquisition information public inquiry system of Shandong Province. The publicity period of this announcement is 30 days.

If the members of the rural collective economic organization to expropriate the land are not satisfied with the plan or have suggestions for amendment, they shall give written feedback to the competent department of natural resources of Luozhuang District, Linyi City before the end of the publicity; If it is not submitted within the time limit, it will be deemed to have waived the hearing.
