Jianli Xintianyuan Food Co., Ltd. is a rice processing enterprise, and the person in charge, Bao Feng, told reporters that on August 1, 2023, he found that the outer packaging of a "Happy Xin Xiang Rice" in a fresh supermarket in Chenzhou City, Hunan Province was extremely similar to the outer packaging of his patent "Huafu Xin Xiang Rice".
After learning about Bao Feng's appeal, the Market Supervision and Administration Office of Zhuhe Town, Jianli City, immediately contacted the staff of the Intellectual Property Unit of the Market Supervision Bureau to guide Bao Feng on how to protect his rights.
The market supervision and administration department contacted the Chenzhou Municipal Administration for Market Supervision and Administration of Hunan Province to coordinate the law enforcement officers of the Chenzhou Municipal Administration for Market Regulation to go to Xintianyuan Food Co., Ltd. on September 21, 2023 to investigate and collect evidence. Through investigation and evidence collection, it was determined that the behavior of the rice processing factory in Chenzhou City had constituted an infringement of the claimant's patent right.
In the end, the market supervision and law enforcement personnel of Hunan and Hubei ordered the respondent to immediately stop manufacturing, using, selling, and promising to sell the infringing products, and destroy 200 infringing products that had not been used.
