Measures for Rewarding Citizens for Reporting Acts Endangering National Security

The Measures for Rewarding Citizens for Reporting Acts Endangering National Security (hereinafter referred to as the "Measures") are based on encouraging citizens to report acts endangering national security, and refine and clarify the conditions, methods, standards, and procedures for state security organs to implement rewards for reporting. Among them, it is stipulated that the whistleblower shall meet three conditions at the same time to receive a whistleblowing reward:

1. There is a clear target for reporting, or specific leads or circumstances on conduct endangering national security;

2. The reported matter has not been known to the state security organs in advance, or although it has been grasped by the state security organs, the information provided by the informant is more specific and detailed;

III. The content of the report has been verified as true by the state security organs, and has played a role in preventing, stopping, and punishing conduct endangering national security.

Combined with the practice of rewarding state security organs for whistleblowing, the Measures clarify that the implementation methods of rewards include spiritual rewards and material rewards, and delineate four levels of reward standards according to the degree of role played by the whistleblower and the size of the contribution:

1. Where they play a certain role in preventing, stopping, or punishing conduct endangering national security, and make a certain contribution, a reward of up to 10,000 yuan is to be given;

2. Where they play an important role or make important contributions to preventing, stopping, and punishing conduct endangering national security, a reward of 10,000 to 30,000 yuan is to be given;

3. Where they play a major role or make a major contribution to preventing, stopping, or punishing conduct that seriously endangers national security, a reward of 30,000 to 100,000 RMB is to be given;

IV. Where they play a particularly major role in preventing, stopping, or punishing conduct that seriously endangers national security, or make a particularly major contribution, a reward of 100,000 yuan or more is to be given.

Citizens may report to the state security organs in the following ways:

●Call the 12339 hotline of the state security organ to accept reports;

●Log in to the website of the State Security Organs' Internet Report Acceptance Platform www.12339.gov.cn;

●Delivery of letters to state security organs;

●Report to the state security organ in person;

●Report to the state security organs through other state organs or the informant's unit;

●Other ways to report.

With regard to legal liability, the Measures clarify six situations in which the staff of state security organs may be held accountable, four situations in which the whistleblower may be held accountable, and two situations in which the whistleblower's unit may be held accountable. It clearly stipulates that whistleblowers shall not deliberately fabricate facts in the name of reporting to falsely accuse or frame others, shall not obtain bonuses by deception, shall not maliciously report or create incidents or interfere with the work of state security organs in the name of reporting, and shall not divulge state secrets or work secrets learned in the report.
