Xiangxi Prefecture investigated and dealt with a case of inferior seeds operated by a company, and the germination rate was only 53%

In January 2023, the Xiangxi Prefecture Agriculture and Rural Bureau will conduct sampling and inspection of the corn variety "Mouyu No. 10" produced for sale by Hunan Industry Technology Co., Ltd. After testing, the germination rate of corn seeds in this batch was only 53%, and it was judged to be unqualified. After investigation and verification, the parties produced a total of 12,480 kilograms of the batch of seeds, sold 10,040 kilograms, and the illegal income was 271,080 yuan, and the party's behavior was suspected of constituting a crime. In July 2023, the Xiangxi Prefecture Agriculture and Rural Bureau transferred the case to the public security organ for investigation and punishment.

In January 2023, the Agriculture and Rural Committee of Hechuan District, Chongqing City, confirmed that the "Haixiangnuo 18" corn hybrid seeds operated by an agricultural materials management department in Hechuan District were fake seeds according to the results of seed supervision and random inspection. In accordance with the "Seed Law of the People's Republic of China" and relevant regulations, 372 bags of seeds involved in the case were confiscated, 1,078 yuan of illegal gains were confiscated, and a fine of 60,000 yuan was imposed.

An agriculture and rural bureau then made an administrative penalty decision on business department B, giving it an administrative penalty of confiscating illegal gains and imposing a fine of 300,000 yuan ten times the value of the goods. The business department of B believed that the 10 times fine should be borne by company A, so it sued company A to the court with a complaint. During the trial, it was ascertained that after an Agriculture and Rural Bureau applied for a case, Company A used technical means to eliminate the QR code on the "Shihai 836" corn seed packaging bag. After trial, the court of first instance held that Article 48 of the Seed Law of the People's Republic of China prohibits the production and operation of fake and inferior seeds. The departments in charge of agriculture and rural affairs, forestry and grasslands, and relevant departments shall crack down on illegal acts of producing and operating fake and inferior seeds in accordance with the law, protect the legitimate rights and interests of farmers, and maintain the market order of fair competition. Defendant Company A, as a crop seed production enterprise, illegally sold fake seeds to the plaintiff B's business department, and used technical means to eliminate the QR code on the seed packaging bag during the investigation and punishment of the fake seed "Shihai 836" corn seed by the administrative authority, which was a bad act. Company A's illegal acts caused the administrative agency to impose an administrative penalty on Business Department B, and accordingly, the court upheld the claim of Business Department B that Company A should bear a fine of 10 times. After the first-instance judgment was rendered, Company A appealed, and in the second-instance trial, the two parties reached a settlement.

The case of selling fake and shoddy soybean seeds in Xinyang, Henan Province, caused a loss of about 400 yuan

Recently, the Public Security Bureau of Huaibin County, Xinyang City, Henan Province successfully cracked a major case of selling fake and shoddy soybean seeds, arrested 2 criminal suspects, effectively purified the order of the agricultural materials market, and fully escorted spring production.

In June 2023, the national bean series "Dongnong No. 76" and "Dongnong No. 7" soybeans planted by Zhang, Gao, Liu, Zheng and other large grain growers in Gucheng, Luji, Sankongqiao, Xinli and other townships in the county were almost unharvested due to seed problems in the later stage, with a loss of about 400 yuan.

On March 7, 2024, the Huaibin County Public Security Bureau received clues about a fake seed case handed over by the County Agriculture and Rural Bureau.
