Notice on the prohibition of planting tall crops in the Yellow River beach area

In order to thoroughly implement the spirit of General Secretary Xi Jinping's important instructions on issues related to the Yellow River, and to do a good job in the current rectification of the relevant issues of the Yellow River, in accordance with the "Water Law of the People's Republic of China", the "Flood Control Law of the People's Republic of China" and other laws and regulations, the relevant matters are hereby notified as follows:
1. Scope of prohibition
Due to the swing of the river and the safety of flooding, it is necessary to adjust the planting area of tall crops in the tidal area in a timely manner year by year, steadily reduce the planting area of high-stalk crops in the tidal area, and minimize the impact on the safety of river flooding. According to the actual situation of the Inner Mongolia section of the Yellow River, the Yellow River beach area is divided into three management areas, from the center of the main river trough to the outward in order of the main river trough area, the low beach area and the high beach area, among which the area between the river water surface and the boundary line of the main river channel is the main river channel area, the area between the boundary line of the main river channel and the boundary line of the high and low beach is the low beach area, and the area between the high and low beach boundary line and the embankment foot line of the frontal side of the embankment (the section without embankment shall be subject to the river and lake management range line) is the high beach area. The prohibited areas include the main river trough area and the low beach area.
2. Prohibition requirements
It is strictly forbidden to use pesticides, chemical fertilizers, agricultural films, herbicides, etc., in the main trough area of the Yellow River; it is strictly forbidden to plant tall crops in low-shoal areas; and high-shoal areas should actively promote the use of organic fertilizers while reasonably controlling the use of pesticides, chemical fertilizers, and plastic films. In the event of a catastrophic flood, the tall stalk crops that obstruct the flow of floodwater in the high beach area should be removed in accordance with the law during the early warning period.
3. Supervision of law enforcement
District agriculture, animal husbandry and water affairs, emergency management bureaus and other departments should strengthen supervision, severely crack down on the illegal activities of planting tall crops within the prohibited range, and give relevant administrative penalties in accordance with the "Water Law of the People's Republic of China", "Flood Control Law of the People's Republic of China" and other laws and regulations. In case of violation of the prohibition requirements, the violator shall bear legal responsibility, and the losses caused shall be borne by the violator himself, and no compensation shall be made.
4. Reporting
Any organization or individual who finds planting within the scope of the prohibition has the right to dissuade and report to the District Agriculture, Animal Husbandry and Water Affairs Bureau, Emergency Management Bureau and other departments and the subordinate town government (sub-district office); If the report is verified to be true, the relevant departments shall give rewards to the informant. 5. Organizational leadership
All relevant departments should earnestly strengthen organization and leadership, do a good job of explaining the policy of stopping construction for the masses in a thorough and meticulous manner, and take effective measures to ensure the smooth progress of the construction suspension work.
6. This notice shall be implemented from the date of issuance, and the Notice on the Prohibition of Planting of Tall Straw Crops in the Yellow River Beach Area (No. 1) of the People's Government of Wuda District, Wuhai City on March 12, 2021 shall be repealed at the same time.

In order to thoroughly implement the spirit of General Secretary Xi Jinping's important instructions on issues related to the Yellow River, and to do a good job in the current rectification of the relevant issues of the Yellow River, in accordance with the "Water Law of the People's Republic of China", the "Flood Control Law of the People's Republic of China" and other laws and regulations, the relevant matters are hereby notified as follows:
1. Scope of suspension of construction
The main stream of the Yellow River.
Second, the requirements for stopping construction
It is strictly forbidden to reclaim new wasteland and increase the area for planting crops in the main stream of the Yellow River beach area; it is strictly forbidden to illegally reclaim new rivers under various names; it is strictly forbidden to add new cultivated land with confirmed rights and general cultivated land in the beach area; no land in the beach area shall be newly designated as basic farmland or used for land use for the balance of occupation and compensation; no new production embankments shall be built or expanded, no agricultural facilities such as greenhouses and animal husbandry shall be developed, no tall crops and trees shall be planted that obstruct the flow of floodwater, all kinds of embankments shall not be built at will, and no new construction or parking shall be allowed to be fixed, moved, or parked. Temporary buildings and houses, the relocation of people into the beach area is strictly prohibited, and all approved projects under construction and unbuilt in the beach area of the main stream of the Yellow River are suspended.
3. Supervision of law enforcement
The District Bureau of Agriculture, Animal Husbandry and Water Affairs, the District Emergency Management Bureau, the District Urban Management Comprehensive Law Enforcement Bureau, the District Ecological Environment Bureau, the Natural Resources Branch and other relevant departments should strengthen supervision, severely crack down on the illegal acts of new cultivated land, houses and related facilities and the relocated population within the scope of the suspension of construction, and give relevant administrative punishments in accordance with relevant laws and regulations. In case of violation of the requirements for suspension of construction, the violator shall bear legal responsibility, and the losses caused shall be borne by the violator himself, and no compensation shall be made.
4. Reporting
Any organization or individual who discovers illegal acts of adding new cultivated land, houses and related facilities and moving in within the scope of the suspension of construction has the right to dissuade them, and report them to the District Agriculture, Animal Husbandry and Water Affairs Bureau, the District Emergency Management Bureau, the District Urban Management Comprehensive Law Enforcement Bureau, the District Ecological Environment Bureau, the Natural Resources Branch and other departments and the subordinate town government (sub-district office).
5. Strengthen leadership
All relevant departments should earnestly strengthen organization and leadership, do a good job of explaining the policy of stopping construction for the masses in a thorough and meticulous manner, and take effective measures to ensure the smooth progress of the construction suspension work.
6. This notice shall be implemented from the date of promulgation, and the Notice on the Cessation of Construction Activities in the Yellow River Beach Area (No. 2) issued by the People's Government of Wuda District, Wuhai City on March 12, 2021 shall be repealed at the same time.
