A fire broke out at the Kowloon Lighting Factory

After investigation, it was determined that the "5.30" fire accident of Changzhou Jiulong Lighting Factory was a production safety liability accident caused by the fire left behind by workers' illegal smoking.
Recently, after the trial of the Xinbei District People's Court of Changzhou City, Jiangsu Province, Zhu Mouping, the general manager of Jiulong Lighting Factory, Zhu Mouhai (Zhu Mouping's father), and Jiang Moulei and Chen Mouqin, employees who caused the fire caused by illegal smoking, a total of 4 people were investigated for criminal responsibility, and the judgment has taken effect.
The New Taipei District People's Court pronounced the verdict as follows:
Defendant Zhu Mouhai (Zhu Mouping's father) entrusted an unqualified construction team to illegally build the steel structure warehouse that caught fire in the factory from 2017 to 2018 without obtaining construction permit procedures, and refused to make corrections when the law enforcement department required rectification, committing the crime of major liability accident and sentenced to 2 years imprisonment;
During the period when the defendant Zhu Mouping was the legal representative of Changzhou Jiulong Automobile Lighting Factory, he clearly knew that the above-mentioned steel structure warehouse was an illegal building and had been required to rectify by the law enforcement department, but still did not make corrections, resulting in an accident and committing the crime of major liability accident, and was sentenced to 2 years and 6 months imprisonment;
Defendants Jiang Moulei and Chen Mouqin were sentenced to 3 years and 2 months imprisonment for the crime of major liability accidents when they knew that smoking was prohibited in the factory, and they were sentenced to 3 years and 2 months imprisonment when they knew that smoking was prohibited in the factory.
Case review
Jiulong Lighting Factory is mainly engaged in auto parts, motorcycle parts, lamps, decorative parts, plastic products, mold manufacturing and processing.
Before the fire accident, Jiulong Lighting Factory had 13 buildings, of which 4 were brick-concrete structures, 3 were brick-concrete and steel structure mixed forms, and 6 were steel structures. The relevant departments have investigated and dealt with the illegal construction of the Jiulong Lighting Factory, but the enterprise has not rectified.

The building that caught fire was the No. 4 steel structure warehouse, which was invested and constructed by Zhu Mouhai in 2018. On the premise that there were no professional design drawings and relevant administrative licensing procedures, Zhu Mouhai hired an unqualified construction team to build the No. 4 warehouse, and when the accident occurred, he did not go through the formalities such as construction planning permit, construction permit, completion acceptance and fire protection filing.
How the accident happened
At about 14:00 on May 30, 2022, two employees of the semi-finished product warehouse of Jiulong Lighting Factory smoked for about one minute near the door of the freight elevator on the fifth floor of warehouse No. 4, and then discarded cigarette butts at the window near the carton stack on the southeast side of the freight elevator and left, causing a fire.
Zhu Mouping, the main person in charge of the enterprise, notified the on-site management personnel to organize firefighting.
In the end, the No. 4 warehouse overburned and collapsed, resulting in the death of four employees who went to the No. 4 warehouse from different areas of the enterprise to participate in the fire fighting.
Analysis of the cause of the accident
(1) Direct causes
Two employees of the semi-finished product warehouse of Jiulong Lighting Factory violated the company's smoking ban regulations by smoking on the fifth floor of the semi-finished product warehouse, and the fire left behind by smoking ignited the stacking of packaging cartons and spread and expanded.
(2) Indirect causes
1. The safety production system of Jiulong Lighting Factory is not perfect, the daily management is not in place, the smoking ban regulations are not effectively implemented, and there is illegal smoking.
2. Zhu Yinhai, the former person in charge of Jiulong Lighting Factory, and Xu Chunhui, the person in charge of construction, illegally implemented the construction of No. 4 warehouse, and its building components such as columns, beams and floor slabs did not meet the requirements of the fire resistance limit and bearing capacity of the components in the "Code for Fire Protection in Building Design" (GB50016) and the "Technical Code for Fire Protection of Building Steel Structures" (GB51249), and there were serious safety hazards in the building itself.
3. The assembly and welding method of the steel floor slab of the No. 4 warehouse of Jiulong Lighting Factory causes the gap between the upper and lower floors, which can not effectively block the flowing fire formed by the combustion of plastic products, and there is a vertical elevator shaft, which leads to the rapid downward spread of the fire;
4. The safety production training of the employees of Jiulong Lighting Factory was not in place, the fire extinguishing and emergency response plan were not mastered, and the 4 employees who went to the No. 4 warehouse from other areas to participate in the fire failure to evacuate the fire in time.
