Regulations on the Promotion of Civilized Behavior in Haixi Mongolian and Tibetan Autonomous Prefecture

(Adopted at the 28th meeting of the Standing Committee of the 14th People's Congress of Haixi Mongolian and Tibetan Autonomous Prefecture on August 28, 2020 and approved at the 25th meeting of the Standing Committee of the 13th Qinghai Provincial People's Congress on May 26, 2021)

Chapter I: General Provisions

Article 1: These Regulations are drafted on the basis of relevant laws and regulations, combined with the actual conditions of the state, so as to cultivate and practice the Core Socialist Values, to inherit and carry forward the fine traditional Chinese virtues, to guide and promote civilized behavior, to increase citizens' ideological awareness, moral standards, and civilized literacy, to promote the progress of social civilization, to promote high-quality development, and to create a high-quality life.

Article 2 These Regulations shall apply to the promotion of civilized behavior and related work within the administrative area of this state.

"Civilized behavior" as used in these Regulations refers to conduct that complies with the provisions of the Constitution, laws, and regulations, is guided by the Core Socialist Values, adheres to socialist morality and public order and good customs, leads social customs, and promotes social civilization and progress in the new era.

Article 3: Efforts to promote civilized behavior shall adhere to the principles of Party committee leadership, government leadership, social co-governance, and public participation, and establish and complete long-term effective working mechanisms that combine rule of law and rule of ethics, cultivation and governance, and self-discipline and other discipline.

Article 4: The Steering Committee for the Construction of Spiritual Civilization at or above the county level in an autonomous prefecture shall coordinate efforts to promote civilized behavior within its administrative region.

The offices of the Steering Committee for the Construction of Spiritual Civilization at or above the county level in the autonomous prefecture are responsible for the daily work of promoting civilized behavior, formulating and organizing the implementation of work plans and plans for the promotion of civilized behavior, guiding the construction of civilized practice centers in the new era, establishing and improving the responsibility system and evaluation system for the promotion of civilized behavior, and organizing and carrying out activities such as publicizing and commending civilized behavior.

Article 5: The people's governments at or above the county level in autonomous prefectures shall include the promotion of civilized behavior in their national economic and social development plans and annual plans, formulate relevant policies and measures, and include the necessary funds in the fiscal budgets at the same level, so as to promote the promotion of civilized behavior and the coordinated development of the economy and society.

Article 6: The people's governments at or above the county level in autonomous prefectures and their departments, township (town) people's governments, and neighborhood offices shall perform their duties to promote civilized behavior in accordance with law, and strengthen the construction of civilized townships (towns) and civilized villages (communities).

Village (resident) committees shall give play to the role of basic-level mass autonomous organizations, and assist in carrying out efforts to promote civilized behavior in accordance with law.

Article 7 The promotion of civilized behavior is the common responsibility of the whole society.

State organs, groups, enterprises and public institutions, grassroots mass autonomous organizations, other organizations and individuals shall actively participate in the promotion of civilized behavior in light of their own actual conditions, and have the right to put forward opinions and suggestions on the promotion of civilized behavior, dissuade and report uncivilized behavior, and complain and reflect on the failure to perform their duties to promote civilized behavior. Records of uncivilized conduct in the form of lawful photographs, audio recordings, or video recordings may be submitted to the administrative law enforcement departments.

Civilized units, civilized families, staff of Party and government organs, enterprises and public institutions, deputies to people's congresses, members of the Chinese People's Political Consultative Conference, advanced and exemplary figures, service personnel in public places, public figures, civilized guides, and so forth shall lead social trends with a civilized image.

Article 8: The offices of the Autonomous Prefecture Steering Committee for the Establishment of Spiritual Civilization at the county level or above shall announce to the public the methods and channels for accepting reports and complaints. Departments that receive reports, complaints, and opinions and suggestions shall promptly investigate and handle them in accordance with law, and inform the relevant units and individuals of the results.

The identity information of informants and complainants shall be kept confidential.

Chapter II: Basic Norms of Civilized Behavior

Article 9: Citizens shall firmly establish the concept of the state, love the Party, the country, and socialism, conscientiously preserve national security, dignity, and honor, and actively participate in patriotic education and practice activities.

Article 10: Citizens shall preserve ethnic unity, respect each other, conscientiously practice social ethics with civility and courtesy, helping others, caring for public property, protecting the environment, and abiding by discipline and law as the main content, professional ethics with dedication to work, honesty and trustworthiness, fairness, enthusiastic service, and dedication to society as the main content, family virtues with respect for the old and love for the young, equality between men and women, harmony between husband and wife, diligence and thrift, and mutual assistance among neighbors as the main content, and personal virtues with patriotism, courtesy, and obedience, diligence and kindness, generosity, integrity, and self-improvement and self-discipline as the main content.

Article 11: The following norms of conduct shall be observed in the maintenance of public order:

(1) Dress appropriately, behave in a civilized manner, and must not make loud noises or use foul language;

(2) Waiting for services to line up in turn, take the elevator first out and then enter, and go up and down the stairs to the right;

(3) The use of public seats is reasonable and orderly, and seats must not be preempted or occupied;

(4) It is forbidden to throw objects from the building;

(5) In the event of an emergency, obey the on-site command and cooperate with the emergency response;

(6) When organizing indoor and outdoor activities such as square dances, theatrical performances, physical exercise, and commercial marketing, reasonably select the time, venue, and audio equipment, and must not interfere with the normal life, work, and study of others;

(7) Other norms of civilized behavior for maintaining public order.

12th in the care of public facilities, shall comply with the following code of conduct:

(A) shall not occupy, embezzlement or intentional damage road traffic, culture and sports, environmental sanitation, landscape and other public facilities, shall not step on public seats;

(2) Shall not occupy, block, or close evacuation passages, safety exits, fire escapes, or barrier-free facilities;

(3) Do not intentionally damage elevators, gas pipelines and other special equipment and fire-fighting facilities;

(D) shall not be on the exterior walls of buildings, structures and municipal public facilities, pipelines and other facilities and trees posted, nailed, graffiti, depicted;

(5) Shall not climb or cross fences, fences, hedges and other facilities, shall not climb branches, pick flowers and fruits, trample on lawns, dinners, barbecues, damage flower beds and hedges in urban gardens and green spaces;

(F) other civilized norms of behavior for public facilities.

Article 13: In caring for public environmental sanitation, the following codes of conduct shall be observed:

(A) in accordance with the provisions of the classification of garbage, shall not be discarded or incinerated at will;

(2) Take care of the city's appearance and environment, and shall not spit or defecate;

(C) the collection, transportation and disposal of kitchen waste shall comply with the relevant provisions, shall not be bare storage or discharge of kitchen waste in public places into rainwater pipes, sewage drainage pipes, rivers, ditches, landscaping, etc.;

(4) Sacrifices must not be burned during the time period and in the area prohibited by the people's government at or above the county level in the autonomous prefecture;

(5) Abide by the relevant regulations on smoking control, and shall not smoke in places where smoking is prohibited;

(6) Straw, fallen leaves, garbage and other substances that produce smoke and dust pollution shall not be burned in the open air, and fireworks and firecrackers shall not be set off in the time period and area prohibited by the people's government at or above the county level in the autonomous prefecture;

(G) shall not violate the provisions of the city appearance management, unauthorized in public places, buildings, structures on the exterior wall and municipal public facilities set up billboards, advertising light boxes, etc.;

(8) Engaging in production and business activities such as setting up stalls shall not affect the safe passage of pedestrians, shall not affect traffic, and shall not disturb the order of the city's appearance and environment;

(9) Perform obligations related to the prevention and treatment of infectious diseases, actively cooperate with the implementation of prevention, control and emergency measures, and truthfully provide relevant information;

(10) Maintain the hygiene of public toilets, use toilets in a civilized manner, and care for and rationally use environmental sanitation facilities;

(11) Other civilized norms of behavior that care for public environmental sanitation.

Article 14 In maintaining road safety and order, the following codes of conduct shall be observed:

(1) Vehicle drivers and pedestrians shall pass in accordance with the traffic signal instructions and obey the command of the traffic police;

(2) Driving vehicles shall give way to pedestrians, and actively avoid the elderly, the disabled, pregnant women, children, as well as police cars, fire trucks, ambulances, engineering rescue vehicles and other priority vehicles performing emergency tasks;

(3) Driving a vehicle shall not smoke, shall not use mobile communication tools in a hand-held manner, shall not throw objects outside the vehicle, and shall regulate the use of lights and horns;

(4) Take public transportation to obey the order of riding, get off first and then get on, do not play the sound of electronic devices, do not hinder the driver's safe driving, and take the initiative to give up seats to the elderly, weak, sick, disabled, pregnant and other passengers who need care;

(5) Regulate the parking of vehicles, and shall not occupy emergency passages, sidewalks, blind roads and other prohibited parking areas and disabled parking spaces;

(6) Bus and taxi drivers use civilized language, standardize services, and shall not dump passengers, deceive passengers and refuse to ride;

(7) Logistics, catering and distribution enterprises shall implement the road traffic safety prevention responsibility system, and take measures to promote the relevant personnel of the enterprise to abide by traffic order and travel in a civilized manner;

(8) Other norms of conduct for maintaining road safety and order.

15th in civilized tourism, shall comply with the following code of conduct:

(1) Respect local historical and cultural traditions, customs, religious beliefs, and etiquette taboos;

(2) Caring for the memorial facilities of heroes and martyrs and historical and cultural figures, and must not destroy or deface them;

(3) Protect cultural relics and historic sites, scenic spots, tourist facilities and other tourism resources, abide by the provisions of scenic spots and scenic spots, and shall not climb in violation of regulations;

(4) Respect the rights of others, take photos in a civilized manner, must not occupy public facilities for a long time, and respect the labor of service personnel;

(5) Maintain the safety of scenic spots, and shall not use fire in the wild;

(F) commodity operators and service providers shall not provide tourists with goods and services that are contrary to national customs and habits, detrimental to human dignity, and contrary to social morality, operate in good faith, and shall not be fraudulent or forcibly sold;

(VII) travel agencies should be in the travel contract to provide for the specific content of civilized tourism, tour guides should abide by professional ethics, maintain professional image, civilized and honest service;

(H) other norms of conduct for civilized tourism.

Article 16: The following norms of conduct shall be observed in preserving online civility:

(1) Respect intellectual property rights, and must not illegally use others' original online works;

(2) Must not publish or disseminate vulgar, obscene, or other negative information;

(3) They must not engage in other activities online that violate public order and good customs or harm the lawful rights and interests of others;

(4) Internet café operators shall implement the provisions of the real-name system, and must not accept minors online;

(5) Other norms of conduct for the civilized use of the internet.

Article 17: The following codes of conduct shall be observed in maintaining medical order:

(1) Medical and health establishments shall strengthen the establishment of professional ethics for medical personnel, and formulate and implement norms for the civilized practice of medicine;

(2) Medical personnel shall abide by the code of conduct for medical services, respect patients, use civilized language, keep patients' privacy and personal information confidential, and must not infringe upon patients' lawful rights and interests;

(3) Seek medical treatment in a civilized manner, respect medical personnel, cooperate in carrying out diagnosis and treatment activities, rationally handle medical disputes, express reasonable demands in accordance with law, and must not disrupt the normal medical order;

(4) Other norms of conduct for maintaining medical order.

Article 18: The following norms shall be observed in the construction of civilized villages and towns:

(1) Strengthen the establishment of basic-level autonomous organizations, lawfully drafting and improving village rules and conventions that conform to the Core Socialist Values, and increasing the capacity for self-education, self-management, and self-service;

(2) Actively carry out comprehensive environmental improvement and protect the natural, historical, and humanistic features of villages and towns;

(3) Improve the basic public cultural service system in rural areas, inherit and protect outstanding ethnic and folk culture, and enrich the cultural life of the masses;

(4) Caring for the empty nest elderly, left-behind children, the disabled, and the minor children of migrant workers;

(五)倡导移风易俗,从简从俭civilization办理婚丧喜庆事宜;

(6) Other codes of conduct for building civilized villages and towns.

Article 19: In maintaining community civility, abide by the following norms of conduct:

(1) Shall not be illegally built, and shall not encroach on public spaces such as passages and green spaces;

(2) Shall not privately connect water, electricity, gas, communications and other lines;

(3) Effective measures shall be taken to control the volume and avoid interfering with the normal life, work, and study of surrounding residents in activities such as decoration, gatherings, meals, catering services, fitness, singing and dancing;

(4) Standardize and orderly parking vehicles, and charge vehicles at designated locations;

(5) Keeping pets in accordance with the provisions of the license, quarantine, clean up feces, take safety measures, to avoid obstructing or harming others;

(6) Other norms of conduct for maintaining community civility.

Article 20 In the construction of civilized units, the following norms shall be observed:

(1) Strengthen education on ideals and beliefs, raising ideological awareness, moral standards, and civilized literacy;

(2) People-oriented, guide industry employees to enhance their sense of civilized service, and promote high-quality and standardized services;

(3) Establish volunteer service teams, extensively carry out volunteer services, and actively participate in social public interest activities;

(4) Codes of conduct for other civilized units.

Article 21: In the construction of civilized campuses, the following norms are to be observed:

(1) The competent departments of education and their educational institutions shall incorporate civilized behavior norms into the content of education and teaching, and establish and improve the campus civilization convention;

(2) Strengthen the construction of teachers' ethics and style, respect and care for students;

(3) Must not disseminate speech that violates national laws, regulations, or educational policies, or has a negative impact on students;

(4) Prevent student bullying and build safe campuses;

(5) Other codes of conduct for building civilized campuses.

Article 22: The following norms are to be observed in the construction of civilized families:

(1) Cultivating good family education and family practices such as respect for the elderly and love for the young, mutual respect and love, equality between men and women, diligence and thrift, and harmony among neighbors;

(2) Perform the obligation of support, care for and visit the elderly;

(3) Parents or other guardians are to lawfully perform guardianship duties for minors and other wards who should be under guardianship in accordance with law, and lawfully perform their obligations to raise and educate them, and must not condone their children's negative conduct;

(4) Other norms of conduct for building civilized families.

Article 23 Units and individuals raising dogs shall abide by the following norms:

(1) Applying for licenses, obtaining dog licenses, and injecting vaccines in accordance with regulations;

(2) When traveling with dogs, you need to carry a dog registration certificate or dog license, and the length of the dog chain for small dogs shall not exceed 2 meters, and the length of the chain for large dogs and fierce dogs shall not exceed 1.5 meters, and shall be led by a person with full civil capacity, and shall not allow or drive the dog to intimidate or harm others;

(3) When traveling with dogs, you need to carry cleaning utensils and remove dog feces in a timely manner;

(4) Dogs must not be abused or abandoned;

(5) Do not take dogs on buses and other urban public transportation, and take dogs on passenger taxis, with the consent of the driver;

(6) It shall not affect the normal work and rest of others, and when the barking of dogs affects others, effective measures shall be taken to stop it;

(7) Other civilized dog code of conduct.

Military, police, search and rescue, scientific research and other special dogs and guide dogs carried by blind people or assistance dogs carried by severely disabled people are excluded.

Article 24: Conscientiously increase awareness of ecological protection and public health safety, change customs, eradicate the bad habit of indiscriminately eating wild animals, and must not purchase or eat wildlife that laws and regulations prohibit the trade or consumption of.

Advocate economical dining, advocate the implementation of a separate meal system for meals, and promote the use of chopsticks and spoons. Consumers order food on demand, striving to be the disseminator of green and economical consumption, and catering enterprises should provide convenience for consumers to order food on demand and according to the quantity.

Chapter III: Promotion and Safeguards

Article 25: People's governments at or above the county level in autonomous prefectures and their relevant departments shall establish and complete systems for commendations, awards, care and assistance for civilized behavior.

Advanced individuals who have received titles such as moral models or outstanding volunteers, or who have received commendations at the county level or above for their civilized conduct, shall be recorded in their personal files or personal credit records and included in the Public Credit Information platform.

Article 26: The people's governments at or above the county level in autonomous prefectures and their relevant competent departments shall strengthen the planning, construction, maintenance, management, and financial safeguards for the infrastructure for the promotion of civilized behavior.

Article 27: All levels of people's government in the autonomous prefecture, as well as neighborhood offices and village (resident) committees, shall strengthen the establishment of public libraries, primary and secondary school libraries, neighborhood (township) and village (community) libraries, mobile sites, and other reading facilities for the whole people, organize and carry out reading activities for the whole people, cultivate citizens' reading habits, and promote the improvement of citizens' civilized literacy.

Article 28: Promote the integration of patriotic education throughout the entire process of national education and the establishment of spiritual civilization, carry out education on basic national conditions, history and culture, democracy and rule of law, national security, ethnic unity, and the reunification of the motherland, and strengthen the construction, protection, and use of patriotic education bases, national defense education bases, and revolutionary commemorative facilities.

Educational administrative departments, the Communist Youth League, primary and secondary schools, and so forth should establish a system of working contacts with patriotic education bases, organize and formulate plans for educational activities, and focus on cultivating patriotic feelings among young people.

Article 29: The people's governments at all levels of the autonomous prefecture shall encourage the implementation of the following civilized behaviors:

(1) Acting bravely, saving lives and helping the wounded, providing emergency assistance, and donating blood without compensation;

(2) Voluntarily donating human cells, tissues, organs, and remains;

(3) Participating in public interest activities such as helping the elderly and orphans, helping students and the disabled, helping the poor and disaster relief, and providing medical assistance;

(4) Participating in volunteer service activities such as culture and education, ecological and environmental protection, social governance, and civilized persuasion;

(5) Set up caring service points to provide outdoor workers and other persons in need of assistance with convenient services such as drinking water, meal heating, and resting and toileting;

(6) Participate in the publicity and protection of natural and historical cultural heritage;

(7) Other civilized behaviors that should be encouraged.

Article 30: People's governments at the autonomous prefecture or county level or above and their relevant departments shall establish and complete mechanisms for joint disciplinary action against uncivilized conduct.

Development and reform departments shall strengthen and regulate the management of Social Credit Information, and promote the establishment of a social credit system.

Administrative law enforcement departments shall establish mechanisms for sharing information on law enforcement of uncivilized conduct.

All types of industry associations shall formulate rules and regulations for their respective industries, establish industry self-discipline mechanisms, and guide members to operate in a civilized and honest manner.

Article 31: State organs, social groups, enterprises, and public institutions shall include norms of civilized behavior in the content of training, organize and carry out themed activities, and set up signs for civilized reminders.

Article 32: Mass media such as radio, television, newspapers and periodicals, online platforms, and mobile phone clients shall actively carry out efforts to publicize civilized behavior, publicize and praise advanced deeds of civilized behavior, and criticize and expose uncivilized behavior in accordance with law.

Public place management units shall carry out publicity and guidance on civilized behavior through display screens, publicity boards, etc.

Encourage the use of airplanes, trains, long-distance buses and other means of public transportation to publicize the norms of civilized behavior.

Article 33: Departments in charge of networks shall strengthen governance of cyberspace, purify the online environment, and promote the establishment of online civility.

Network operators shall operate networks in accordance with law, disseminate health information, preserve network security, conduct education and training for network practitioners, strengthen management of network users' production, reproduction, publication, and dissemination of information, and where violations of laws and regulations are discovered, they shall immediately stop transmission, store relevant records, and report to the competent departments for networks.

34th city management departments should improve the city appearance and environmental management network, reasonable set up convenient posters, strengthen the classification of domestic waste, sewage treatment facilities and the construction of public toilets, uncivilized behavior in urban management to strengthen supervision, timely stopping, according to law.

Article 35: Public security organs and judicial organs shall, in the course of carrying out public security precautions and handling conflicts and disputes, strengthen education on the rule of law, and stop and correct uncivilized conduct.

The traffic management department of the public security organs shall, in conjunction with the relevant departments, build and improve the road monitoring system, keep the traffic safety facilities such as road traffic lights, traffic signs, and traffic markings clear, eye-catching, accurate, and intact, strengthen the publicity of civilized travel, and promptly stop uncivilized traffic behavior.

Article 36 The competent departments of transportation shall strengthen the education of bus and taxi drivers on civilized behavior norms, improve the professional ethics and civilized quality of employees, and improve the level of civilized services.

The people's governments at or above the county level in autonomous prefectures shall quantify the content, location, tasks and hours of civilized traffic volunteer services, so as to enhance citizens' awareness of civilized traffic and reduce uncivilized traffic behavior.

Article 37: The competent departments for health and their medical establishments shall promote the establishment of civility in the medical and health industry, include the civilized practice of medicine in the norms of medical and health management work, strengthen the establishment of medical ethics and medical style for medical personnel, optimize service processes, promote communication between doctors and patients, and maintain a positive environment for medical treatment. Organize training on emergency on-site rescue knowledge to improve citizens' ability to carry out first aid.

Article 38: Civil affairs departments shall raise the level of community governance, advance the establishment of civilized communities, and guide civilized visits, memorials, and memorial activities.

Article 39: Departments in charge of ecological and environmental protection, water conservancy, forestry, and grasslands shall, on the basis of the scope of their duties, promptly stop uncivilized conduct such as impacting the cleanliness of rivers, damaging greenery, and polluting the air, water, and soil.

Article 40: Government service window units, medical institutions, financial institutions, scenic spot management bodies, public service enterprises, and so forth shall play a role in demonstrating civilized services, providing convenient, efficient, civilized and courteous services.

Caring seats shall be set up in public places such as stations, airports, medical institutions, large shopping malls, tourist attractions, and parks, as well as public transportation.

Large-scale shopping malls, cultural and sports venues, squares, tourist attractions, parks, and so forth shall follow provisions to build public restrooms, barrier-free toilets, and keep them open and tidy.

Crowded places shall set up barrier-free facilities and mother and baby rooms in accordance with provisions.

Article 41: Units hosting or undertaking all types of activities shall formulate plans for safeguarding civility, improve corresponding safeguard measures, and strengthen publicity and education on civility for participants.

Chapter IV: Legal Responsibility

Article 42 If a dog goes out of the house without using a leash and does not take other safety measures, the public security organ shall order it to make corrections and impose a fine of 200 yuan;

Article 43 Anyone who smokes in a place or area where smoking is prohibited and does not heed dissuasion to smoke shall be ordered by the competent department of health and other relevant departments to stop smoking in accordance with the scope of their duties and shall be fined 50 yuan, and if they refuse to do so, they shall be fined 200 yuan.

Article 44: Where the provisions of Article 11 (6) or Article 19 (3) of these Regulations are violated, the public security organs are to give warnings, and those who do not make corrections after the warnings are to be fined between 200 and 500 RMB.

Article 45 Where a unit or individual sets off fireworks in an area or place where fireworks and firecrackers are prohibited, the public security organ shall order rectification and impose a fine of not less than 100 yuan but not more than 200 yuan on the individual, and a fine of not less than 1,000 yuan but not more than 3,000 yuan on the unit.

Article 46: Where logistics or catering distribution enterprises violate the provisions of these Regulations by failing to implement road traffic safety prevention responsibilities, causing a serious impact on road traffic, the traffic management department of the public security organ shall give a talk to the person in charge of the enterprise and order corrections to be made within a set period of time;

Article 47: Where uncivilized actors insult, push, threaten, or retaliate against informants, complainants, or dissuasors, the relevant administrative law enforcement departments shall punish them in accordance with law.

Where administrative law enforcement personnel are obstructed from performing their duties in accordance with law, or maliciously carrying out uncivilized conduct continuously or multiple times, the public security organs shall handle it in accordance with law.

Article 48: Where state organs and their staffs do not perform or incorrectly perform their duties in efforts to promote civilized behavior, the competent department at the level above, the supervisory organ, or the unit to which they belong shall order corrections, and depending on the severity of the circumstances, the responsible leaders and directly responsible personnel shall be sanctioned.

Article 49: Where other laws and regulations provide otherwise for conduct violating these Regulations, follow those provisions.

Chapter V: Supplementary Provisions

Article 50: These Regulations take effect on July 1, 2021
