A few days ago, with the help of the "three linkage" platform of the judicial office, the police station and the law firm, Chengjiaqiao Street worked together to resolve a dispute over the wages of migrant workers caused by the arrears of the project payment. This dispute is another dispute successfully mediated after the establishment of the "three linkage" mechanism in Chengjiaqiao Street, and it is a vivid practice of the "Fengqiao experience" at the grassroots level.
Not long ago, the Chengjiaqiao Street Urban Transportation Center continued to receive migrant workers' wage orders from the "12345 Citizen Service Hotline", which were transferred to the Labor Dispute Mediation Center of the Chengjiaqiao Street Affairs Acceptance Service Center for mediation. The labor dispute mediation center tried to mediate after receiving the work order, but failed to do so due to the large gap.
In desperation, the labor dispute mediation center had no choice but to transfer the thorny dispute to the judicial office for mediation. After careful study and judgment, the staff believes that if multiple parties sit down and have a good talk, there is a possibility that the mediation will be successful.
Since the dispute involved two layers of legal relations, namely, the relationship between the subcontractor and the construction party for the performance of the project and the relationship between the construction party and the payment of labor remuneration for the workers, and at the same time, as two related disputes, the settlement of the arrears of wages depended on the settlement of the project payment, so the direction of mediation was changed to first mediate the conflict between the contractor and the construction party.
After consultation, the Chengjiaqiao Street People's Mediation Committee organized mediation many times, but the parties on both sides always insisted on their own words and could not reach a consensus.
The mediation suddenly reached an impasse, and Chengjiaqiao Street decided to adopt the "three linkage" contradiction resolution mechanism, and the multiple participants jointly mediated this difficult dispute.
Therefore, led by the Chengjiaqiao Judicial Office, the "three linkage" platform was requested to start the mediation of the dispute again, and the "three linkage +" model was explored, and other departments of the street were introduced to participate in the mediation.
Soon, under the leadership of the Chengjiaqiao Judicial Office, mediators, police, lawyers and other parties patiently preached the law and policy from their own business perspectives, hoping that both parties would properly resolve the conflict in accordance with the law and avoid the secondary conflict caused by the delay in payment of the project money.
After a long face-to-face communication, the subcontractor and the construction party finally let go of the knot and agreed to negotiate the differences. Under the guidance of the lawyer, the people's mediator also drafted the mediation agreement on the spot, submitted it to the two parties for discussion and revision, and finally reached an agreement on the payment of the remaining project money. After the two parties signed the agreement, the police once again reminded the construction party to pay the arrears of labor remuneration to the workers immediately after receiving the payment.
In the end, relying on the platform of "three linkages", Chengjiaqiao Street successfully nippled in the bud this group contradiction that may be on the verge of breaking out, and received good political, social and legal effects.
In the mediator's subsequent return visit, it was learned that the migrant workers who were asking for wages had successfully received the labor remuneration they deserved, and the migrant workers repeatedly thanked all parties in the street for their help and happily set off home for the New Year.
