Case 1: Wan Mou in Jianshi County, Enshi, is suspected of illegal business operations

Basic facts: On November 20, 2023, the Jianshi County Emergency Management Bureau and the Gaoping Police Station of the County Public Security Bureau, based on reports from the masses, seized 3,481 fireworks and firecrackers illegally operated by villager Wan in a private house in Group 5 of Dadianzi Village, Gaoping Town, Jianshi County, with an amount of up to 174766 yuan and illegal gains of 1,800 yuan. The above-mentioned acts violated the provisions of Article 225 of the Criminal Law of the People's Republic of China and are suspected of constituting the crime of illegal business operation. In accordance with the provisions of the "Notice on Emergency Management, the Ministry of Public Security, the Supreme People's Court, and the Supreme People's Procuratorate on Printing <安全生产行政执法与刑事司法衔接工作办法>and Distribution" (Emergency [2019] No. 54), the Jianshi County Emergency Management Bureau transferred Wan to the public security organs for criminal responsibility in accordance with the law.

Handling situation: At present, the Jianshi County Public Security Bureau is conducting further investigation into the case on suspicion of illegal business operation.

Case 2: Zhang Moumou in Zhijiang City is suspected of illegal business operations

Basic facts: On January 11, 2024, the Zhijiang Municipal Emergency Management Bureau, together with the Zhijiang Municipal Public Security Bureau, seized 29 fireworks and firecrackers from a van van illegally transporting fireworks and firecrackers in Majiadian City, and later seized 160 fireworks and firecrackers and 210 scattered fireworks and firecrackers in Zhang's warehouse. After investigation, Zhang Moumou purchased fireworks and firecrackers worth 113328 yuan from Linli County, Hunan Province from the end of December 2022 to January 11, 2024 without obtaining a fireworks and firecrackers business (retail) license, and shipped them back to Zhijiang City for sale, with a sales amount of about 70,000 yuan. The above-mentioned acts violated the provisions of Article 225 of the Criminal Law of the People's Republic of China and are suspected of constituting the crime of illegal business operation. In accordance with the provisions of the Notice of the Ministry of Emergency Management, the Ministry of Public Security, the Supreme People's Court, and the Supreme People's Procuratorate on Printing <安全生产行政执法与刑事司法衔接工作办法>and Distributing (Emergency [2019] No. 54), the Zhijiang City Emergency Management Bureau transferred Zhang Moumou to the public security organs for criminal responsibility in accordance with the law.

Handling situation: At present, the Zhijiang Municipal Public Security Bureau has filed a criminal case against Zhang Moumou on suspicion of illegal business operation.

Case 3: Bai Moumou, Yunyang District, Shiyan City, is suspected of dangerous operations

Basic facts: On January 15, 2024, the Yunyang District Emergency Management Bureau found that resident Bai Moumou illegally stored 1,065 boxes (plates) of fireworks and firecrackers products in the backyard warehouse of a company in Bailang Town, Yunyang District, without permission. The above-mentioned acts violated the provisions of Article 134-1 of the Criminal Law of the People's Republic of China and are suspected of constituting the crime of dangerous operation. According to the provisions of the "Notice of the Ministry of Emergency Management, the Ministry of Public Security, the Supreme People's Court, and the Supreme People's Procuratorate on Printing <安全生产行政执法与刑事司法衔接工作办法>and Distribution" (Emergency [2019] No. 54), the Emergency Management Bureau of Yunyang District, Shiyan City, transferred Bai Moumou to the public security organs for criminal responsibility in accordance with the law.

Handling situation: At present, the Yunyang District Public Security Bureau of Shiyan City is conducting further investigation into the case.
