Recently, the Municipal People's Government issued the newly revised "Implementation Rules for the Management of Online Taxi Reservation Services in Wuxi" (Xi Zheng Gui [2024] No. 2), which will be officially implemented on March 1, 2024.

Background of the revision

In 2016, the city issued the "Implementation Rules for the Management of Online Taxi Reservation Services in Wuxi (Trial)", which has played an important role in promoting the development of the online car-hailing industry, standardizing business service behaviors, and ensuring operational safety and the legitimate rights and interests of passengers.

By the end of 2023, there are 41 online ride-hailing platform companies licensed in the city (including Jiangyin and Yixing), with 26,500 vehicles and 54,600 drivers. As an important part of the taxi industry, online car-hailing carries an important function of serving the masses of people to travel conveniently.

With the economic and social development, the online car-hailing industry has undergone profound changes, and the relevant national and provincial policies and regulations have been updated many times, and the limitations of the original "Detailed Rules" have become increasingly prominent. To this end, the municipal government included the revision of the "Detailed Rules" in the 2023 legislative plan, and formed a revised draft after repeated research and demonstration by the transportation and judicial administrative departments, and careful drafting and polishing. On December 25, 2023, the 33rd executive meeting of the municipal government deliberated and approved the revised "Detailed Rules".

The "Detailed Rules" are divided into five chapters: General Provisions, Licensing Management, Business Services, Supervision and Management, and Supplementary Provisions, which have been increased from the original 25 to 37 articles, with a clearer overall structure, more suitable provisions for the actual situation of the city, and more operable policies and measures.

Support the development of the ride-hailing industry

◆ Adjust the standard of online car-hailing vehicles to "new energy vehicles with a wheelbase of not less than 2,650 mm and a cruising range of not less than 400 kilometers under comprehensive working conditions, or non-new energy vehicles with a taxable purchase price of more than 150,000 yuan", highlighting the positioning of green development and "high-quality service and differentiated operation".

◆ Strengthen the supporting guarantee of online car-hailing, require that online car-hailing service facilities be included in the territorial spatial planning system, and rationally arrange supporting service facilities such as waiting for customers, parking and resting, and vehicle charging.

◆ Encourage the role of industry associations to guide industry self-discipline and standardize operations.

◆ Support the application of intelligent networked vehicles and promote scientific and technological innovation in the online car-hailing industry.

Deepen the reform of online car-hailing approval

◆ Implement the requirements of optimizing the business environment, establish a licensing system for online car-hailing platforms, and those engaged in online car-hailing operations in the city do not need to apply for licenses from Jiangyin and Yixing again after applying for a license at the municipal level, so as to reduce the burden on market entities and support the development of the platform economy.

◆ Abolish restrictions on the local household registration of online ride-hailing drivers, and fully protect citizens' equal employment rights and the reasonable, smooth and orderly flow of labor elements.

◆ Implement the requirements for public security management of public transportation, and clarify that online car-hailing vehicles should be equipped with driving positioning, emergency alarm, and on-board video equipment.

◆ Stipulate that the results of the cruising car and online car-hailing test can be mutually recognized under the same circumstances, promote the integration of patrol and network, and facilitate employees.

Consolidate the responsibilities of online ride-hailing platforms

◆ Online ride-hailing platforms are required to implement the responsibilities of carriers, standardize the dispatch of orders, and strengthen driver training and education, so as to ensure that service vehicles have operational qualifications, drivers have professional qualifications, and that the technical conditions and safety performance of the vehicles are good.

◆ In view of the situation of "one vehicle with multiple platforms", it is stipulated that if the online car-hailing platform reports on multiple platforms, the platform that reports for the first time bears the daily management responsibility, and the dispatching platform bears the management responsibility during the order service, so as to fill the blind spot of daily management responsibility.

◆ Require aggregator platforms to implement verification responsibilities for online ride-hailing platform companies, urge online ride-hailing platforms to ensure that vehicles and drivers obtain corresponding permits, and must not directly participate in vehicle scheduling and driver management, and establish and improve the first-question responsibility system for consultation and complaints.

◆ Regulate the carpooling of private passenger cars and clarify the specific requirements.

Strengthen the protection of the rights and interests of drivers and passengers

◆ The platform is required to sign various forms of labor contracts or written agreements with drivers, improve the rules for dispatching orders and the driver's rest system, and reasonably set the percentage of commission to protect the rights and interests of drivers.

◆ It is stipulated that before the platform company adjusts the tariff structure, dispatch algorithm and apportionment ratio, it shall solicit the opinions of the driver and other stakeholders, and the adjustment of the pricing and price increase mechanism shall be announced to the public in advance.

◆ In response to the personalized needs of passengers, guide the platform company to safeguard and protect the legitimate rights and interests of passengers, optimize the dispatch rules to meet the diversified service needs of passengers.

◆ Clarify the code of conduct for drivers and passengers, and guide all parties to jointly protect the civilized driving order.
