According to Article 35 of the Shenzhen Special Economic Zone Urban Renewal Regulations, "when the proportion of the area of the exclusive part of the signed relocation compensation agreement or the number of property owners is not less than 95%, if the market entity and the unsigned owner still fail to negotiate after full consultation, they may apply to the district people's government where the project is located for mediation, and the district people's government may also convene the relevant parties for mediation." ”

According to the Draft, it is necessary for the government to grasp the old improvement process when the contract rate reaches "double 95%" and it can apply for compulsory expropriation.

In the past, the actual operation of the "double 100%" standard was very difficult, and as long as there were individual "nail households", it was not uncommon for the entire project to be unable to advance the old improvement process.

The arrival of the "double 95%" means that the last "5%" - that is, the uncontracted part of the urban renewal has a collection procedure, and the implementation is based on the law, pressing the shortcut key for the renewal project, so as to avoid repeatedly falling into the dilemma of "losing more" by developers and owners.

Some experts pointed out that the "double 95%" protects the interests of the majority of people, as well as the overall interests of urban residents, which promotes the healthy development of Shenzhen's old reform and real estate.

Some experts believe that the government's initiation of expropriation is in line with the spirit of the provisions of the Regulations on the Expropriation and Compensation of Houses on State-owned Land on the basis of public interest, because urban renewal and transformation is an integral part of the implementation of urban planning, and one of the purposes of transformation is to eliminate relevant safety hazards or further improve urban functions, optimize the production and living environment of the area and surrounding units and residents, and we should regard "public interest" as the basis for legitimacy.

After the promulgation of relevant regulations, Shenzhen's "long-delayed" old reform project was also pressed the acceleration button. The Luohu Mutoulong project became the first urban renewal project in Shenzhen to start the administrative expropriation method, and then Haitao Garden also received the intervention of the administrative force and made a breakthrough.

On March 30, 2023, the People's Government of Nanshan District, Shenzhen issued an announcement on the administrative mediation of the urban renewal unit of Nanyuan New Village, which is also the first case of initiating an urban renewal administrative mediation project in Nanshan District, and its legal basis is the Shenzhen Special Economic Zone Urban Renewal Regulations issued on December 30, 2020.

According to the owners who have signed contracts earlier, the compensation ratio of Nanyuan New Village is 1:1.33, which is said to be the highest among the eight major renovation projects in the same period.

Industry experts once told reporters in interviews that respecting the rights of minorities should not ignore the rights and interests of the majority.
