Regarding the new toothpaste supervision model, Xiang Jianqiang, chairman of the China Oral Cleaning and Care Products Industry Association and director of the National Oral Care Products Standardization Technical Committee, said that on June 16, 2020, the state promulgated the "Regulations on the Supervision and Administration of Cosmetics", which stipulates that toothpaste products are managed with reference to ordinary cosmetics. According to the Measures for the Supervision and Administration of Toothpaste, on September 25, 2023, the State Food and Drug Administration issued the Announcement on Matters Concerning the Implementation of Toothpaste Regulatory Regulations and the Simplification of the Requirements for the Filing Materials of Listed Toothpaste (No. 124 [2023]), which clarifies that the content of the label of the toothpaste products that have been simplified for filing shall comply with the Regulations on the Supervision and Administration of Cosmetics, the Measures for the Supervision and Administration of Toothpaste and the Measures for the Administration of Cosmetics Labels If only the format of the label needs to be adjusted in a standardized manner, the sales packaging label that has been marketed can be used when simplifying the filing, and the product label update can be completed as required before July 1, 2024.

On September 25, 2023, the State Food and Drug Administration issued the "Provisions on the Administration of Toothpaste Filing Materials (Draft for Comments)" for public comment, and on the basis of sorting out and adopting reasonable opinions, the "Provisions on the Administration of Toothpaste Filing Materials" was officially issued on November 22, clarifying a series of specific requirements for the filing of toothpaste products. At this point, the regulatory model of toothpaste has been formally established (although some supplementary guidance documents may be issued later, but the specific model has been determined), and the filing of toothpaste has been officially implemented on December 1.
Gao Wenying, deputy secretary-general of the China Oral Cleaning and Care Products Industry Association, told the "China Consumer Daily" reporter that according to the requirements of the "announcement", before the official implementation of the "measures", the toothpaste products sold on the market have a certain history of production, sales and use. It also clarifies that for toothpaste products with simplified filing, the listed sales packaging label and the revised label labeling packaging design draft can be uploaded at the same time when the simplified filing is simplified.

It is understood that in practice, when simplifying the filing, the relevant provincial drug regulatory departments are allowed to sell toothpaste products that have been marketed before November 30, 2023, in order to minimize the waste of resources, corporate losses and environmental pollution, taking into account the quality, safety and reliability of the products that have been marketed and in line with the original regulations. However, Gao Wenying pointed out that enterprises, as the first person in charge of product quality and safety, have the obligation to ensure the safety of relevant products and the reasonableness and scientificity of claims.
Toothpaste is not the same as cosmetics
"The new regulations have made the development of the toothpaste industry more standardized, but it should be clear that toothpaste is not a cosmetic. Xu Chunsheng, deputy director of the Science and Technology Working Committee of the China Oral Cleaning and Care Products Industry Association and president of the Guangzhou Dental Doctor Oral Care Research Institute, told the reporter of China Consumer Daily.

Gao Wenying pointed out that the "Provisions on the Administration of Toothpaste Filing Materials" clarifies the classification of efficacy claims of toothpaste in different user groups:
First, the toothpaste used for the general population can be claimed: cleaning, anti-caries, anti-dentin sensitivity, anti-plaque and alleviating gum problems;
Second, children's toothpaste refers to the toothpaste that is claimed to be suitable for children under the age of 12 (including 12 years old), and the efficacy categories that can be claimed by children's toothpaste are limited to cleaning and caries prevention.
Xiang Jianqiang said that for those toothpaste producers and operators who illegally produce and sell and declare in violation of regulations, we call on everyone to jointly supervise and report and crack down, maintain a good atmosphere in the industry market, and promote the sustainable and healthy development of the industry.
