Previous indecent assault verdicts show that between September 2018 and May 2022, Liu Aiye, principal of Boai Special School in Suixian County, Hubei Province, repeatedly touched and kneaded the breasts and other private parts of several minor students in the principal's office and students' dormitories. According to the identification of the Judicial Appraisal Center of the Suizhou Municipal Public Security Bureau, mixed genotypes were detected in the inner cloth on the left side of the victim's bra, including the DNA typing of Liu Aiye and the victim.
The prosecuting organ held that the defendant Liu Aiye, as the principal of Suixian Boai Special Education School, took advantage of his special status and status to repeatedly molest minor students at school against the will of others, and should be investigated for criminal responsibility for the crime of forcible indecency. Liu Aiye's voluntary admission of guilt and punishment may be treated leniently in accordance with law. It is recommended that he be sentenced to three years and six months in prison.
The litigation representative of the murdered student pointed out that the victim repeatedly stated that the defendant Liu Aiye had committed rape, and according to the provisions, it can be determined that the defendant Liu Aiye's behavior constitutes the crime of rape and forcible indecency, and in addition, according to the law, the defendant has heavier and harsher punishment circumstances, and his behavior is a crime in a "public place", and he should be given a heavier punishment.
Judgment of first instance
The court held that the evidence in the case could not confirm the fact that the defendant Liu Aiye had committed rape, and finally accepted the prosecution's recommendation. In December 2022, the Suixian People's Court ruled that the defendant Liu Aiye had committed the crime of forcible indecency and was sentenced to three years and six months in prison. At the same time, according to the time, frequency, target, means and subjective attitude of the criminal act, in order to prevent the occurrence of recidivism and ensure a healthy and educational environment for minors, they are prohibited from practicing in accordance with the law.
The court ruled that Liu Aiye, as the principal of a special education school, should have put teacher morality first, knew glory and shame, was strict with himself, and taught and educated people, but in the process of teaching, he seriously violated teachers' professional ethics and committed criminal activities, and according to relevant regulations, Liu Aiye was severely punished according to law. At the same time, the court pointed out that Liu Aiye voluntarily admitted guilt and accepted punishment, and can be lenient according to law.
The reporter noted that in 2013, the Supreme People's Court and other four departments issued the "Opinions on Lawfully Punishing Crimes of Sexual Assault of Minors", which stipulated that those who committed rape or indecent assault crimes against minors should be given heavier punishments; Those who have any of the worst circumstances shall be severely punished in accordance with law.
In its judgment, the court pointed out that there were a number of circumstances listed in the above-mentioned judicial interpretations in Liu Aiye's molestation case, which "must be severely punished according to law": rape or indecent assault committed by persons with special duties for minors; Entering the residence of a minor or student dormitory to commit a crime of rape or indecency; Committing the crime of rape or indecency against minors with serious illness or mental retardation; Indecent assault on multiple minors, or multiple crimes of rape or indecency.
After the first-instance verdict in the indecent assault case was handed down, several family members of the victims submitted a protest application to the procuratorate, which rejected it, believing that the sentence was "too light."

In June this year, the case aroused social attention after being reported by the media. On the 17th of the same month, the Suixian People's Court issued an announcement saying that in response to the relevant information published on the Internet about the forced indecency case of Liu Moumou of Suixian Boai Special School, the court was conducting a full case review of the case. At the end of June, the local police arranged for the three victimized students to retake the transcript and went to the hospital for a gynecological examination. In late July, the father of the third victim, Zhang Moumou (surname changed), told reporters that the video video of the child describing his sexual assault by Liu Aiye had been handed over to the police officers handling the case as supplementary evidence.
Like other children with intellectual disabilities, Zhang Moumou does not have a clear understanding of terms such as "indecency" and "rape", and does not know what they mean. In the self-report video obtained by the reporter, the events described by Zhang Moumou are suspected to go beyond the indecent plot.
Recently, the reporter learned from the families of the victimized students that Liu Aiye's case of rape will be tried in closed court at the Suixian People's Court on the morning of September 4. Regarding the trial, Suixian People's Court staff told the families of the victimized students that Liu Aiye's suspected rape case was re-prosecuted "in the form of a missed crime."
On August 28, the reporter contacted the Suixian People's Court to learn about the progress of the review of the whole case of "Suixian Boai Special School Liu Moumou's forced indecency case", but did not receive a reply.
