In recent years, the rapid development of generative artificial intelligence technology has brought new opportunities for economic and social development, but also generated problems such as the dissemination of false information, infringement of personal information rights and interests, data security and bias discrimination, and how to coordinate the development and security of generative artificial intelligence has attracted attention from all parties.
Recently, the Cyberspace Administration of China and other seven departments jointly promulgated the Interim Measures for the Management of Generative Artificial Intelligence Services (hereinafter referred to as the Measures), which will come into force on August 15, 2023.
The relevant person in charge of the Cyberspace Administration of China said that the Measures are aimed at promoting the healthy development and standardized application of generative artificial intelligence, safeguarding national security and social public interests, and protecting the legitimate rights and interests of citizens, legal persons and other organizations.
The Measures put forward that the state adheres to the principle of attaching equal importance to development and security, promoting innovation and governance according to law, takes effective measures to encourage the innovative development of generative artificial intelligence, and implements inclusive, prudent, categorical and hierarchical supervision of generative AI services.
The Measures point out that the innovative application of generative AI technology in various industries and fields is encouraged, high-quality content is generated to be positive, healthy and upwardly good, and application scenarios are explored and optimized, and an application ecosystem is built.
The Measures stipulate that industry organizations are supported to collaborate in areas such as generative AI technology innovation, data resource construction, transformation and application, and risk prevention.
The Measures stipulate that the provision and use of generative AI services shall respect intellectual property rights and business ethics, keep trade secrets, and shall not use the advantages of algorithms, data, platforms, etc. to carry out monopolistic and unfair competition behaviors.
The Measures emphasize that providers must not collect unnecessary personal information, must not illegally retain input information and use records that can identify users, and must not illegally provide users' input information and use records to others.
The Measures provide that those providing generative AI services with public opinion attributes or social mobilization capabilities shall carry out security assessments in accordance with relevant national provisions, and perform the procedures for algorithm filing, modification, and cancellation in accordance with the "Provisions on the Administration of Internet Information Service Algorithm Recommendations."
The Measures stipulate that providers shall establish and complete complaint and reporting mechanisms, set up convenient portals for complaints and reports, publish handling procedures and feedback time limits, and promptly accept and handle public complaints and reports, and feedback the handling results.
