On June 26, the Xinghua Court heard a pension fraud case in public in accordance with the law. Lu and 38 other defendants defrauded more than 460 victims of a total of more than 1.03 million yuan in the name of selling "pension products".
Brief Facts of the Case
Between October 2021 and March 2022, the defendants Lu, Xia, He and others, after planning, summoned the defendants Pan Moumou, Lu Moumou, Xia Moumou and other "team leaders" to rural areas in Xinghua, Dongtai and other places in the name of publicizing and promoting the dendrobium products of a certain Jiangsu Biotechnology Co., Ltd. (hereinafter referred to as "a company"), and the actual value was only about 400 yuan, consisting of dendrobium wine, dendrobium powder, dendrobium flowers or barley green juice drinks, "silk quilts" and other itemsThe "gift package" is priced at RMB 1,900 to RMB 2,600, and uses a "4+1" model to defraud the elderly in rural areas.
Defendant Lu and others went to the rural area four days in advance to attract the elderly to attend the scene by means such as sending eggs for free, and promised on the spot that as long as they presented a certain amount of cash, they could participate in the lottery for free. In addition, the "host" also specially selected some elderly people with potential purchasing ability, fooling them into organizing groups to visit Xinghua for free as long as they carry a certain amount of cash, and they can also visit the company's production base.
After 4 consecutive days of uninterrupted publicity, it successfully attracted a large number of elderly people. On the 5th and most important day, Lu and others brought the elderly with a certain amount of cash to Xinghua to play for free. In the afternoon, the elderly group came to a company's production base "as promised", and Lu, who had been waiting here, finally showed his "fangs".
Subsequently, according to the preparation in advance, Lu continuously promoted dendrobium products to the elderly on site as a "health lecturer", deliberately exaggerated the health care function of the product, and used the means of buying goods first and then returning money, so that the elderly fell into the wrong understanding that the products were given away for free, and they all paid to bring the "big gift bag" home.
According to statistics, the fraud gang led by Lu defrauded more than 460 victims of a total of more than 1.03 million yuan through the above methods in just six months.
During the trial, the court conducted a court investigation around the facts of the crimes alleged in the indictment. The prosecution and defense presented and cross-examined evidence on the facts of the defendant's crime, and fully expressed their opinions on the facts, evidence, and application of law in the case.
Due to the large number of victims and the complexity of the case, the verdict will be pronounced at a later date.
The judge said
In recent years, fraud cases against the elderly have occurred from time to time, and the fraud routines in some cases have been widely known to everyone, but criminals have chosen different routines for different regions and different groups of people, and carefully designed scams and tactics, making the elderly unpreventable. This case was committed by a fraud gang, with as many as 38 defendants, and each member had a clear division of labor and meticulous fraud steps. Criminals seize the psychology of the elderly to attach importance to health, use "free experience", "free gifts" and "free play" as bait, exaggerate the efficacy of dendrobium products through "personal experience" of health care lecturers, and deceive and induce the elderly to buy health products worthy of the name at a high price.
In the face of all kinds of scams, the elderly should establish an awareness of anti-fraud, not trust others, be vigilant against "pension products" scams, and promptly consult with their families or report directly to relevant departments when encountering suspicious situations.
