In this regard, Yang Baoquan, an expert in the Law Daily Lawyer Database and a senior partner of ZhongYin Law Firm, introduced that Article 266 of the Criminal Law of the People's Republic of China stipulates that if the amount of public or private property is relatively large, the person shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention or surveillance, and shall be fined concurrently or alone; where the amount is very large or there are other serious circumstances, a fixed-term imprisonment of not less than three years but not more than ten years shall be imposed, and a fine shall be imposed; Where the amount is particularly large or there are other particularly serious circumstances, a fixed-term imprisonment of not less than 10 years or life imprisonment shall be imposed, and a fine or confiscation of property shall be imposed.

So, for such ticket scalping chaos, does the ticketing platform need to be liable?

Lawyer Yang believes that ticketing platforms should bear some responsibility for transactions on their websites. If the ticketing platform does not take appropriate security measures to prevent fraud and other illegal activities, or fails to provide transparent information and customer support, resulting in harm to customers, then the ticketing platform shall be responsible for this. For example, if the ticketing platform fails to publicly prompt on the website, or fails to provide detection or prevention of fraudulent activities, or fails to provide transparent fare information, resulting in customers being defrauded or charging unreasonable fees, the ticketing platform shall bear certain responsibilities.

However, if the platform has fulfilled the above obligations, and the fan purchase of tickets is not through the platform, but is traded privately, the platform is not liable.

"Consumers' performance tickets should be purchased through regular ticketing websites or mobile apps, and should not trust private ticketing channels such as 'internal employees' and 'scalpers' to avoid being deceived." If you really need to buy second-hand tickets, it is recommended to choose a transaction website that requires real-name authentication and relies on a third-party payment platform, and do not trade with strangers on social platforms such as WeChat and Weibo. If you have any questions about the booking information, you should contact the regular ticketing company in time, and once you find that you have been deceived, you should report to the police in time, and keep WeChat communication, payment transfer records, audio recordings and other evidence.
