The Weng Niu Special Brigade of the Second Highway Detachment has repeatedly found such problems in carrying out corrective operations for traffic violations. On August 10, 2022, the police of the Weng Niu Special Brigade investigated and dealt with three cases of overcrowding traffic violations in just half an hour during the law enforcement of the Wudan toll station, all because they were carrying several more children, and the drivers did not think so, thinking that "it was okay" and "not illegal".
01 At about 9:58 a.m. on August 10, the police of the Weng Niu Special Brigade found a black car suspected of being overcrowded during the duty at the Wudan toll station, and through the window of the car, the crowds in the car could be seen, so they signaled the driver to pull over and accept the inspection. When the car door was opened, the police found that the 5-seater car was squeezed into 6 people.
After inquiry, it was learned that the driver dragged his family out for a tour, thinking that they were all family, and it was okay to squeeze in. And the child is small and does not occupy a position, and it is okay to have adult protection. The police criticized his wrong ideas on the spot and punished the driver for the illegal act of driving an overcrowded car.
02 Only four minutes later, an SUV car carrying 5 people was actually carrying 6 people, and after inquiry, it was learned that it was also a family out of the house, thinking that the children did not occupy the position. The police conduct safety education for drivers and punish them accordingly.
03 15 minutes later, the police investigated and dealt with the third violation of overcrowding again in the same place. The vehicle was carrying 5 people and 6 passengers, and in addition to the two main and co-pilots, the rear row was also two adults holding two children.
In just half an hour, the police seized three illegal acts of overcrowding in succession. In the process of investigation, the police found that these drivers all think that it is not a big deal to bring more children, and some think that children sit on the lap of adults and are held by adults, which is not overcrowded, but is this really the case?
First, how does the law stipulate that vehicle overcrowding is stipulated?
According to Article 49 of the Road Traffic Safety Law of the People's Republic of China, the number of people carried by motor vehicles shall not exceed the approved number of people, and passenger motor vehicles shall not carry goods in violation of regulations. The number of passenger cars to be loaded is calculated based on the number of passengers, and there is no provision for the height, weight and age of the passengers. Therefore, whether the vehicle is overcrowded is calculated according to whether the actual number of passengers exceeds the approved number of passengers, and does not distinguish between adults and children. Even if there are 5 adults and 1 child (or infant) sitting on a car carrying 5 people, even if the child does not occupy the seat, it is 6 people, which is overcrowded. Drivers must pay attention to riding strictly according to the number of people on board of the vehicle before leaving the car, if they can't sit down, it is recommended to travel in separate vehicles or in batches.
Is it really okay to see one more child?
Some people may say that for children, shouldn't we open up to the internet? Can't the traffic police be more humane in actual law enforcement? But if you have this 1% luck, when the accident comes, whether you are an adult or a child, it is 100% dangerous. Studies have shown that when a vehicle collides at a speed of 50km/h, a child weighing 12KG rushes forward under inertia, which is equivalent to hundreds of kilograms of weight.
