On the afternoon of July 28, the Macao SAR Government officially announced that it will launch a new round of public bidding for gaming business approval (hereinafter referred to as gambling licenses) from July 29, and the submission of bids will be from July 29 to September 14, for a period of 48 days. The HKSAR Government expects to complete the relevant bidding procedures by the end of this year to enable newly approved companies to operate from 1 January 2023.

The betting will revolve around seven criteria

Nancai reporter learned that on July 5, the Macao Executive Council completed the discussion of the draft administrative regulations (hereinafter referred to as the "Bill") amending Administrative Regulation No. 26/2001 "Regulating the Public Bidding and Granting Contracts Approved by Casino Lucky Gaming Operators, as well as the Appropriate Qualifications and Financial Requirements for Participating Bidding Companies and Approved Companies", which took effect from the next day of promulgation.

The Macao SAR Government stated that in view of the fact that the policy direction for the future development of the gaming industry is very different from that of the first public bidding in 2001, the administrative regulations mainly amend the requirements for tenders, documents and materials submitted when participating in the bidding, etc., especially adding the approval company's plan to open up foreign tourist markets, the benefits brought by the investment in gaming projects and non-gaming projects to the Macao SAR, and the social responsibilities assumed by the investment in gaming projects and non-gaming projects as the criteria for approval.

According to the Bill, when selecting bidding companies and evaluating bids, the HKSAR Government will give special consideration to seven major factors, including the amount of the variable portion of the proposed premium; Plans to develop foreign source markets; Experience in operating casino Lucky Bets or related aspects; the benefits of investment in gaming and non-gaming projects to the Macao SAR; Manage the casino's program; Programmes to monitor and prevent illegal activities in casinos; Proposed social responsibility.

Nancai reporters learned from the Information Bureau of the Macao Special Administrative Region that on the afternoon of 28 July, the chief executive of the Macao Special Administrative Region issued an instruction announcing the launch of a new round of open bidding for gambling cards, the number of which was approved was six, the maximum period of approval was ten years, and the time for submitting bids was from July 29 to September 14.

According to the chief executive's instructions, companies that intend to participate in the bidding must bid by 5:45 p.m. on 14 September. In order to be admitted to the bidding, the company concerned must submit the eligibility documents and tenders required under the Act, comply with other conditions stipulated in the bidding scheme and provide a guarantee in the amount of not less than MOP10 million.

According to the Chief Executive's instructions, in the selection and evaluation of participating bidding companies, particular consideration should be given to factors such as the plan to open up foreign source markets, the experience in operating casino lucky gambling or related aspects, the benefits of investment in gaming projects and non-gaming projects to the Macao SAR, the plans to manage casinos, the plans to monitor and prevent illegal activities in casinos and the proposed social responsibilities.

It is reported that the SAR government has set up relevant committees to be responsible for implementing a new round of open bidding for gambling cards. The Official Gazette of the Macao Special Administrative Region published The Chief Executive's Directive No. 135/2022 on 27 July to establish a casino lucky gaming operation approval to the Public Bidding Commission (hereinafter referred to as the "Bidding Committee"), which includes the Secretary for Administration and Justice of Macao, Mr Matthew Cheung Wing Chun, the Secretary for Economy and Finance, Mr Lee Wai Nong, the Secretary for Social and Cultural Affairs Ouyang Yu, the Secretary for Executive Council Hui Lai Fong, the Secretary for Economic and Technological Development, Tai Kin Ye, the Secretary for Tourism, Senna Manuel Manuel Fernandes, the Secretary for Gaming Supervision and Coordination, Chief of the Judicial Police, Xue Zhongming, and Secretary for Land and Public Works, Lai Wing-leung.

Under section 44 of the Bill, the Competition Commission has the competence to analyse and decide on all matters relating to public bidding and the conclusion of a contract for grants, except for provisional or definite awards relating to the operation of gambling and acts for which the law provides for the responsibility of other entities. The committee is chaired by Zhang Yongchun and Secretary by Ho HoHan.

The results of the bidding are scheduled to be announced by the end of this year

Cheung Wing Chun stressed at the meeting that according to the Amendment to the Legal System for The Operation of Lucky Gambling in Casinos (hereinafter referred to as the "New Gaming Law"), which has been passed by the Legislative Council, the number of grants is up to six, but it does not mean that six gambling cards will be granted in the end, and the SAR Government will strictly judge whether the qualifications of bidders, financial review, investment in non-gaming and the development of overseas markets meet the requirements, especially whether the objectives of promoting macao's moderate diversification of the economy and building an international tourism and leisure center are in line with the requirements, so as to determine the number of licenses.

Nancai reporter learned that the new round of gambling card open bidding adopts the same method as the first public bidding in 2001, using a simple bidding method. The bidding process is mainly divided into two stages, one is the submission period from July 29 to September 14, 48. The second is that the bidding committee deliberates the bid and, according to the acceptance, can participate in the bidding company to negotiate the bid.

"We are confident that the relevant procedures will be completed by the end of this year, so that the newly approved companies can operate in accordance with the conditions of the new Gambling Law from 1 January 2022." Zhang Yongchun said that whether it is the examination of bids, the negotiation of bids, as well as the selection of temporary approval lists, and the agreement on the terms of the approval contract with the temporary approval company, it will be completed step by step by the end of this year.

Zhang Yongchun pointed out that the bidding committee will negotiate bids with the bidding companies, and if it is deemed that the requirements are not met or the standards are not met, it will request supplementary bidding content. At that time, there will be a provisional grant list, and the companies on the list can obtain temporary grant status.

At the same time, the HKSAR Government has also established the Gaming Commission as a permanent organization to discuss policies in the field of gaming on a daily basis.

On 27 July, the Macau Executive Council completed discussions on the draft administrative regulations of the Gaming Commission. The HKSAR Government has redefined the organisation and operation of the Gaming Commission, whose duties include studying the development of the gaming industry and assisting in the formulation of policies; Assist in formulating the norms and guidelines governing the gaming industry; To make recommendations on the formulation of measures to regulate the development and operation of the gaming industry; To express opinions on other matters on which the committee's views are required by law.

The Gaming Commission is chaired by the Secretary for Economy and Finance of Macao and comprises one representative each from the Office of the Chief Executive, the Office of the Secretary for Administration and Justice, the Office of the Secretary for Economy and Finance, the Office of the Secretary for Security, the Office of the Secretary for Social and Cultural Affairs and the Office of the Secretary for Transport and Public Works, as well as the Secretary for the Supervision and Coordination of Gambling.

In the future, it will operate in plenary, with ordinary meetings held at least twice a year and requiring the attendance of a majority of the members of the Committee.

Affected by the announcement by the SAR government of a new round of open bidding for gambling cards, the stock prices of the six major gambling companies have generally risen. On July 28, Wynn Macau (01128. HK) rose 5.52%, galaxy entertainment (00027. HK) rose 3.83%, SJM Holdings (00880. HK) rose 2.44%, with Melco International Development (00200.
