Announcement No. 66 [2022] of the General Administration of Customs
In accordance with the relevant laws and regulations of the mainland and the Protocol between the General Administration of Customs of the People's Republic of China and the Ministry of Agriculture and Rural Development of the Socialist Republic of Vietnam on the Phytosanitary Requirements for the Export of Fresh Durian from Vietnam to China, from now on, the import of fresh durian from Vietnam that meets the following relevant requirements is allowed:
1. Basis for inspection and quarantine
(1) The Biosecurity Law of the People's Republic of China;
(2) The Law of the People's Republic of China on the Quarantine of Animals and Plants Entering and Leaving china and the Regulations on the Implementation of the Law of the People's Republic of China on the Quarantine of Animals and Plants Entering and Leaving the Country;
(3) The Food Safety Law of the People's Republic of China and the Regulations for the Implementation of the Food Safety Law of the People's Republic of China;
(4) Measures for the Supervision and Administration of Inspection and Quarantine of Imported Fruits;
(5) Protocol between the General Administration of Customs of the People's Republic of China and the Ministry of Agriculture and Rural Development of the Socialist Republic of Vietnam on Phytosanitary Requirements for the Export of Fresh Durian from Vietnam to China.
2. The names of commodities allowed to enter the country
Fresh durian (hereinafter referred to as "durian"), scientific name Durio zibethinus Murr., English name Durian.
3. Permitted places of origin
Durian producing area of Vietnam.
4. Approved orchards and packing plants
Orchards and packaging plants exported to China must be registered by the Ministry of Agriculture and Rural Development of Vietnam (hereinafter referred to as "MARD") and jointly approved by the General Administration of Customs of the People's Republic of China (hereinafter referred to as "GACC") and MARD. Registration information includes name, address and registration number for the purpose of accurate traceability in the event that the exported goods do not comply with the relevant provisions of this Protocol. Before the start of trade, MARD shall provide GACC with a list of registrations, which shall be published on the official website and updated periodically after approval by GACC.
5. List of quarantine pests of concern

6. Pre-export management
(1) Orchard management.
1. Orchards exported to China should establish a sound quality management system and traceability system under the supervision of MARD, implement good agricultural operation practices, maintain sanitary conditions in orchards, such as no pollution sources affecting fruit production around, timely cleaning up of fallen fruits, rotten fruits, etc., and implement comprehensive treatment of harmful organisms, including pest monitoring and investigation, physical, chemical or biological control, and agricultural operations and other prevention and control measures.
2. MARD shall formulate a management plan for quarantine pests of concern to the Chinese side in accordance with the requirements of International Standard for Phytosanitary Measures No. 6 (ISPM 6), and organize orchard monitoring throughout the year. In addition to visual inspection, a variety of physical or chemical methods should be used to induce pest attraction monitoring.
3. For guava fruit flies, it is necessary to hang a solid fly pheromone trap in the orchard, and use the yellow armyworm board for physical monitoring; For insect pests, focus on the branches, stems, leaves and fruits. If pests or corresponding symptoms are detected in surveillance, timely measures, including chemical or biological control, should be taken to control the occurrence of pests or to maintain low levels of pest prevalence.
4. The monitoring and prevention of harmful organisms in chinese orchards should be carried out under the guidance of professional and technical personnel. Technicians should be trained by MARD or its authorized agency.
5. MARD shall keep records of pest monitoring and control in orchards and provide them to GACC when necessary. The control record should include information such as the name of the chemical agent used during the growing season, the active ingredient, the dosage and the time of use.
(2) Packaging plant management.
1. The processing, packaging, storage and shipment of durian to China shall be carried out under the quarantine supervision of MARD or its authorized officials.
2. The packaging plant should be clean and hygienic, the ground should be hardened, and there should be raw material yards and finished product warehouses.
3. The storage, processing, processing, storage and other functional areas of Chinese durian are relatively independent, have a reasonable layout, and take isolation measures and have an appropriate distance from the living area.
4. If the packaged durian needs to be stored, it should be stored immediately and stored separately to avoid re-infection by pests.
5. The packaging plant should establish a traceability system to ensure that the durian exported to China can be traced back to the registered orchard, and record the date of processing and packaging, the name of the source orchard or its registration number, quantity, export date, quantity, import to the country, container number and other information.
(3) Packaging requirements.
1. The packaging materials should be clean and hygienic, unused, and meet the relevant phytosanitary requirements of China. If wood packaging is used, it must comply with the requirements of International Standard for Phytosanitary Measures No. 15 (ISPM 15).
2. In the packaging process, the durian should be manually selected, graded and cleaned, etc., to remove diseased fruits, insect fruits, rotten fruits, deformed fruits, branches and leaves, fruit stalks or other plant residues and soil, etc., and use effective measures such as brushing or high-pressure air gun purging to clean the surface of the fruit, if necessary, the appearance of the durian can be manually wiped with a fine and clean cotton cloth, especially the fruit handle and other parts, in order to effectively remove the insect eggs, pathogen spores and so on attached to the surface of the fruit.
3. Each box must be marked in English or Chinese with information such as the name of the fruit, the country of export, the place of origin, the orchard or its registration number, the packing plant or its registration number. Each box and pallet is marked "Exported to the People's Republic of China" in Chinese or English.
4. Containers containing durians for export to China must be checked for good sanitary conditions at the time of packing. Containers should be sealed and sealed at the Chinese port of entry.
(4) Quarantine before export.
1. MARD shall conduct a sampling inspection of each batch of durians exported to China in the proportion of 2% of each batch of goods. If no phytosanitary problems occur within two years, the sampling rate is reduced to 1%.
2. If live quarantine pests, branches, leaves or soils of quarantine pests of concern to the Chinese side are found, the entire batch of goods shall not be exported to China, and the export of durian from relevant orchards and packaging plants in this export season shall be suspended as appropriate. MARD should identify the causes and take measures to improve them. At the same time, the inspection record is saved and provided to GACC upon request.
(5) Requirements for plant quarantine certificates.
Phytosanitary certificates are issued by THE MAD, indicating the name or code of the orchard and packing plant, and filling in the following additional statement: "This consignment of durian fruits complies with the requirements specified in the Protocol of Phytosanitary Requirements for Export of." Fresh Durians from Vietnam to China, and is free from quarantine pests of concern to China.” (The shipment complies with the protocol on phytosanitary requirements for the export of fresh durian from Vietnam to China, and does not bring quarantine pests of concern to the Chinese side.) )
Before the durian export project is launched, MARD should provide GACC with a sample of the phytosanitary certificate for confirmation and filing.
7. Entry inspection and quarantine and unqualified treatment
When durian arrives at the Chinese port of entry, the Chinese customs implements quarantine in accordance with the following requirements.
(1) Verification of relevant certificates and logos.
1. Verify whether the imported durian has obtained the "Quarantine Permit for Imported Animals and Plants".
2. Verify whether the phytosanitary certificate complies with the provisions of Article 6 (5) of these Requirements.
3. Verify whether the markings on the box comply with the provisions of Article 6 (3) of these Requirements.
(2) Entry inspection and quarantine.
1. Durians exported to China should be imported from all gacc ports where the import of fruits is permitted.
2. In accordance with the relevant laws, administrative regulations, rules and other provisions of the implementation of inspection and quarantine of imported durian, after inspection and quarantine passed, it is allowed to enter the country.
(3) Handling that does not meet the requirements.
1. If it is found to come from an unapproved orchard or packing plant, the durian is not allowed to enter the country.
2. If quarantine pests of Chinese concern or live quarantine pests newly recorded in Vietnam are found, or soil, plant residues, etc. are found, the batch of durians will be dehumized, returned or destroyed.
3. If it is found that it does not meet China's national food safety standards, the durian will be returned or destroyed.
If the above non-compliance is found, GACC will notify MARD and suspend the import of durian from relevant orchards and packaging plants in this export season as appropriate. MARD should find out the cause and urge the relevant orchards and packaging plants to rectify until the relevant rectification measures are effectively implemented and recognized by GACC.
VIII. Conformity review
Before the start of the trade, with the assistance of MARD, GACC will send experts to conduct field visits or remote video inspections of the durian producing areas exported from Vietnam to ensure that they meet the requirements of this plant quarantine.
Retrospective review
Based on the development and interception of durian pests in Vietnam, the GACC will conduct further pest risk assessments and consult with MARD to adjust the list of quarantine pests of concern to the Chinese side and related quarantine measures.
