In the case of the enforcement of Xu's application for the execution of the equity transfer dispute between Li Moutao, Li Mouli and a trading company in Henan, the court ordered Li Moutao and a Henan trading company to pay Xu an equity transfer payment and a dividend of 1.426 million yuan for the withdrawal of shares, and Li Mouli was jointly and severally liable for the above payment. However, in the face of the effective judgment of the court, the person subject to enforcement failed to fulfill the payment obligation on time. So Xu applied to the Guancheng Court for enforcement.
After the enforcement of the case, the Guancheng court served the enforcement notice, the property report order and other enforcement documents to the judgment debtor in accordance with the law, and checked and controlled the bank card, real estate and other property information under the name of the judgment debtor through the Network. After investigation and prosecution, the enforcement officers learned that there was only 20,000 yuan in the bank card under the name of the executor Li Moutao, and a house of property had a joint mortgage with a mortgage amount of 4 million yuan, and it was sealed by 5 courts.
The executive turnaround stems from a lead from the applicant. During the understanding of the situation with the applicant, the applicant mentioned to the enforcement officer that the executor Li Moutao was in the liquor business, and he had rented a warehouse for the storage of liquor at a logistics company in Zhongmu, but it was not clear whether he was still leasing. This clue immediately attracted the attention of the enforcement officers.
On January 26, Zhang Chunfu, captain of the three major enforcement teams of the Guancheng Court, Guo Weibo, executive officer, and Wang Xingxing, clerk, and their party immediately drove to a logistics company in Zhongmu to investigate the warehouse situation on the spot. At the execution site, after the enforcement officer found the warehouse that the executor had leased, because a logistics company in Zhongmu was initially reluctant to cooperate, the enforcement officer saw through the wall of another warehouse next to it that the warehouse was indeed stored in liquor.
Subsequently, the enforcement officers negotiated with a logistics company in Zhongmu for a long time, and the logistics company finally submitted a lease termination agreement between a trading company in Henan and a logistics company, and a warehousing service contract between a liquor company and a logistics company in Zhengzhou. According to the investigation of the situation, the enforcement officers learned that a certain liquor company in Zhengzhou was owned by the son of the executor Li Moutao, and the executor Li Moutao was suspected of transferring property, so he posted a seal on the warehouse where more than 100 pieces of liquor were stored on the spot, sealed it first, and informed the executor Li Moutao's father and son that they could raise an objection to the execution.
However, on the night after the court's seizure, the judgment debtor Li Moutao contacted the court to request that the seizure be lifted, and he agreed to pay more than 1.4 million yuan to the applicant Xu to resolve the dispute in the case, and transferred more than 1.4 million yuan to the court account that night.
The next day, the enforcement officers came to the bank to handle the procedures for transferring deposits, and transferred more than 1.4 million yuan of execution funds to the applicant's account. The case was successfully concluded.
