According to the judgment document, the judicial appraisal said that the patient's condition was complex when he was admitted to the hospital for delivery, the risk of diagnosis and treatment was relatively large, and he belonged to a high-risk mother, and the patient had a history of scarring uterine disease and had indications for caesarean section, and the doctor should inform the patient of the seriousness of his condition and the mode of delivery to be proposed when the patient was admitted to the hospital to give birth and obtain the written consent of the patient, but the medical record data showed that the doctor did not obtain the patient's signed informed consent until 14:40 after discovering the intrauterine death of the fetus, indicating that the doctor did not inform the patient of the pregnant woman's condition in time when the patient was admitted to the hospital. Therefore, it is believed that the doctor has not fulfilled its obligation to inform and is negligent.

The court held that there was a causal relationship between dongguan Kanghua Hospital's failure to differentially diagnose the patient's lower abdominal pain and not to continuous fetal heart rate monitoring and the patient's fetal death, which was another factor leading to fetal death, and the plaintiff was liable for 50% of the compensation.
