In June 2020, Li Gang (pseudonym) and Gu Li (pseudonym) divorced, and the two sides agreed that their son would live with his mother, Gu Li. In August of the same year, the two sides agreed again that the father Li Gang would raise the son.

Gu Liben hoped to give her son to her ex-husband to improve the relationship between the two sides, but their relationship did not improve. In a fit of anger, Gu Li left Wuxi with her son without the consent of her ex-husband and went to live in another province for a period of time. During this period, she repeatedly sent extreme remarks to her ex-husband through WeChat.

Li Gang believes that Gu Li's behavior is extreme and may not be suitable for raising children. During her life in the province, Gu Li did not send her children to school in time, depriving her children of their right to education. As a result, Li Gang sued the court and formally requested that the child be changed to be raised by him.

Article 20 of the Law of the People's Republic of China on the Promotion of Family Education stipulates that where a minor's parents are separated or divorced, they shall cooperate with each other in performing their family education responsibilities, and neither party may refuse or neglect to perform; unless otherwise provided by law, the other party must not be obstructed from carrying out family education.

In the course of the lawsuit, Gu Li said, "What I said at the time was all angry, and now that I realize my mistake, I will not repeat it." For the child's reading thing, because the incident happened suddenly, I was not ready. Now that I've brought the kids back, the kids can keep going to school. ”

In order to fully protect the rights and interests of the child and respect the child's choice, the judge communicated with the child in depth and learned that the mother usually loved him very much, "I still want to be with the mother."

In the end, after the court's investigation and presidency, Gu Li and Li Gang reached a mediation: it was determined that the child was raised by Gu Li. Taking into account Gu Li's past inappropriate behavior, the court issued a family education order to Gu Li based on the Family Education Promotion Law of the People's Republic of China, which came into effect on January 1, 2022.

This ruling with temperature reads: Of course, we must admit that most mothers love their children, care about their children, and are willing to grow up with their children. However, my mother is also a first-time mother, and there are often times when I am at a loss.

The family education decree ruled that Gu Li should pay attention to the child's physical and psychological conditions, ensure the child's legitimate right to education, and not frequently change the child's learning and living environment without legitimate reasons; require Gu Li not to use the child's health and safety as a threat to make inappropriate speech and behavior. The ruling is valid for one year from the date of its making.

Judge Gu Mei told reporters that Gu Li and her ex-husband Li Gang are both highly educated and have a good family income, and she sent a picture and text to her husband that threatened the child's health out of a momentary anger, which may cause harm to the healthy growth of the child. At the same time, the court's investigation also found that the mother and son had a very deep relationship, and her excessive words and deeds were a temporary "mistake".

The Xinwu Court Damei Judge Studio cooperated with the "Smart Parents" Salon of the Wuxi Women's Federation to combine family education and learning with the warm communication organized by the Women's Federation. The court held that Gu Li lacked experience in educating children and asked Gu Li to participate in family education guidance so that she could better raise her children in the future.

Gu Mei hopes to change "preaching" to "communication", and guide parents like Gu Li to learn to examine themselves, find problems and correct mistakes through a more warm and peaceful way. In the future, the Xinwu District People's Court will continue to strengthen family trial work and juvenile trial work in the new era, actively carrying out social investigation, psychological counseling, family education, judicial aid, and other such work on the basis of the case situation, so as to provide legal guarantees for promoting the healthy growth and all-round development of minors.
