Fairness and justice are not only the professional ethics that judicial personnel need to follow throughout their lives, but also an important yardstick for the people to evaluate the quality of justice. Ma Zhengqing, president of the First Criminal Trial Division of the Intermediate People's Court of Tongren City, Guizhou Province, spent more than ten years of intensive cultivation to write a fair and just judicial answer sheet that was recognized by his peers and satisfied by the masses: he presided over more than 420 criminal cases, participated in the collegial panel to hear more than 850 cases, and passed the review rate of many major criminal cases presiding over the trial by 100%. Ma Zhengqing is not only a senior judge of the fourth level, but also a deputy chief forensic physician, he is the only serving cadre and policeman in the Guizhou provincial court system who has been selected into the directory of forensic technicians of the Supreme People's Court's temporary execution of the diagnosis work outside of prison, and has won the advanced individual in the criminal trial work of the national courts, the advanced individual of the provincial court to eliminate organized crime and eliminate evil, and the third class of the personal merit of the Individual, and the heroic model of Tongren Municipal Law.
Be proficient in trial and be a "three haves" judge:
There is a way to work. When Ma Zhengqing undertook the case of illegal trade and transportation of explosives, there were as many as 102 participants in the litigation, which was the largest number of defendants in the city's criminal trial history. He fought for more than three months, extracted more than 500 pieces of evidence, wrote more than 80,000 words of the reading record, and more than 70,000 words of the case trial report, because his pre-trial preparation work was very sufficient, and it took only 3 days to successfully complete the trial of the whole case, providing a reference and replicable trial experience for the city's courts to efficiently try a large number of major criminal cases.
The trial has a skill. When Ma Zhengqing tried the case of intentional injury, the prosecution and defense successively provided three diametrically opposed appraisal opinions, resulting in an unclear causal relationship in the case. In order to conclude the case with high quality in accordance with the law, Ma Zhengqing accurately controlled the direction of the trial, organized 7 appraisers and personnel with specialized knowledge to effectively debate, he made full use of his forensic science, legal expertise and trial work experience, successfully concluded the case, and was highly affirmed by the procuratorates and defenders at the provincial and municipal levels.
There is a conscience in the heart. When Ma Zhengqing undertook the case of the defendant's murder of his mother and father-in-law, he repeatedly read the file and found that the defendant had no motive or purpose for committing the crime, and believed that the appraisal opinion on the defendant's limited criminal responsibility capacity was inaccurate, and suggested a new appraisal. Later, after another appraisal, it was determined that the defendant had no capacity for criminal responsibility at the time of the crime, and the public prosecution organ withdrew the indictment accordingly. In the defendant's intentional injury case, he found that the result of the victim's minor injury had no causal relationship with the defendant's behavior, and under pressure urged the defendant to be innocent, and actively communicated patiently with the public prosecution organs, and after the provincial forensic expert group argued, ma Zhengqing's inference was confirmed, prompting the case to be withdrawn from the indictment charges.
Have the courage to innovate and be a "three noes" judge:
Down-to-earth and not afraid of suffering. Ma Zhengqing was examined by the organization committee for the cause of death of the victim of the intentional homicide case, and he found that the conclusion of the body examination of the public security organ did not match the objective signs contained in the photos of the autopsy, and the victim met the characteristics of the body that was burned after death, which effectively prompted the public security organ to open the coffin for autopsy, and organized forensic experts to discuss, determining that the victim was burned after death, which pointed out the direction for the re-investigation of the case. Later, the defendant was changed from the original charge of intentional homicide to the crime of intentional injury, from the possibility of the defendant being sentenced to death to the final sentence of imprisonment, effectively correcting the incorrect conviction and sentencing of the defendant. Another example is that during the trial of the rape and murder case of defendant Yao X, in order to ensure that the facts of the crime were foolproof, he personally visited the scene of the crime where feces was piled up eight times and reconstructed the crime through evidence, so that the case could be successfully approved.
Follow the facts and don't follow them blindly. When the Songtao and Miao Autonomous County People's Court tried the case of defendant Ran X and others intentionally injuring himself, the victim fang went around petitioning with a written certificate. When the court of first instance encountered difficulties in forensic science, Ma Zhengqing reviewed the forensic evaluation of the case, and after his discovery and written submission that the fall was the main cause of death, changing the previous consistent understanding of the investigation organs and the public prosecution organs. After re-appraisal, the appraisal opinion finally confirmed Ma Zhengqing's inference. Because of its major discoveries, the case underwent a major transformation, and the people's court finally made a judgment exempting the defendant from criminal punishment according to the size of the causal relationship, which calmed down the dispute and won praise.
Reverence for medicine does not compromise. The Tongren City Intermediate People's Court tried a case of gathering a crowd to attack a state organ and intentionally injuring a state organ, which had a bad impact in the local area, because the defendant requested medical parole due to illness, the procuratorial organs had objections to the medical parole, Ma Zhengqing was entrusted to analyze and determine the defendant's condition, which did not fully meet the provisions of medical parole, but was in danger of life, so it was promptly recommended that the defendant be changed for compulsory measures, and the defendant died of illness shortly after changing the compulsory measures. The case benefited from Ma Zhengqing's accurate grasp of the condition, the full use of forensic science and medical knowledge to change the compulsory measures in a timely manner, and the serious consequences of the defendant's unnatural death caused by improper compulsory measures were avoided.
Can fight a hard battle to be a "three first" judge:
Take the lead in sweeping away organized crime and eliminating evil. Ma Zhengqing undertook 3 cases involving 53 people in triad-related cases and handled 10 cases involving 102 people. The case involving Zhou Mou and others was the first triad-related case in Tongren City since the special struggle was launched; under the leadership of Ma Zhengqing, the case was successfully pronounced as scheduled during the supervision of Tongren City by the Central Supervision Group for the Special Struggle to Eliminate Organized Crime and Evil Forces, and was highly affirmed and praised by the Central Supervision Group.
Scramble to be the first in trial execution. From 2020 to March 2021, Ma Zhengqing was assigned to the Dejiang County Court as a member of the party group and vice president, in charge of criminal trial and enforcement work, he led by example, united comrades, and encouraged morale, and the cadres and policemen of the Dejiang Court Criminal Division and the Executive Bureau worked hard and united to raise the quality and effectiveness of the dejiang court's criminal trial from the third to the third in the city and the first to last in the case closure rate to the third and second places; and the quality and effectiveness of the enforcement work from the second to the second to the fourth in the province.
Be the first in the fight against stubborn diseases. In the work of education and rectification of the political and legal contingent, Comrade Ma Zhengqing shouldered the heavy responsibility of temporarily carrying out case investigation, rectification and rectification outside of prison by the courts at both levels in the city, took the initiative to contribute weekends and rest time after work, worked overtime for a long time until late at night, and stayed in the office many times because of work. Under the leadership of Ma Zhengqing's organization, the investigation and rectification of 352 cases of 352 people in the city's two-level courts in 30 years was completed on time and with high quality, and the "stubborn and chronic disease" for 30 years was effectively rectified. He was rated as a heroic model of Tongren Municipal Law by the Tongren Municipal Law Team Education and Rectification Work Leading Group, gave the city a commendation, and called on political and legal cadres and policemen to study.
