The full record of the case of Hu Yi v. Kunlun Wanwei IV

author:honesty4dignity

The court opened its case on 11 January 2021 and held its first hearing on 9 June 2021. This trial process subverted my cognition.

"You have the right to remain silent, but everything you say will be used as evidence in court," I have never been to court, even if I am ignorant, this sentence is always remembered. However, Kunlun Wanwei's lawyers lied arbitrarily in court without punishment. It is strongly recommended that the court arrange the swearing-in process to upset the liar. For a job, it's not worth taking legal risks.

The first lie was punctured in court, so let me describe the process at that time and let the reader feel immersed.

When we showed evidence of the resignation email and the defendant's lawyer questioned it, he slowly walked up to me, leaned over, did not look directly at me, as if to say to himself, please show the original email on the computer. I turned the computer to him, and he looked down and said, slightly surprised, "Please show me the departure email from the company's mailbox." I said that the company mailbox can not be logged in, can only display the saved mail. He turned to the judge and said that he only recognized the email from the company's mailbox, and the email I showed could not recognize its authenticity.

The judge asked if he had contacted Zhou Yahui to confirm the authenticity of the email. He said that he had been contacted, and Zhou Yahui did not remember this. Treacherous, Zhou Yahui could not run away with this hat on his head.

It doesn't matter what I retorted, the point is that the judge himself later found out that something was abnormal. When the defendant's lawyer presented the evidence of the separation list, the judge saw that there was a note on it, and the email account needed to be cleared when leaving, with my signature and the signature of the person in charge. When the judge questioned the defendant's lawyer, the other party had nothing to say. Before the trial ended, the judge asked the defendant's lawyer to go back and reconfirm the authenticity of the resignation email. This is why the first-instance judgment "Kunlun Wanwei Company recognized the authenticity of the evidence after verification".

The second lie is about Zhou Yahui's secretary, Liu Mou. The defendant's lawyer did not deny the contents of Liu's and mine's phone calls, but said that Liu was only an ordinary employee of the company and could not represent the company. I retorted in court, saying that she had issued all the company's notices. She was one of the company's first entrepreneurial elders. Cloud.

The real evidence was found after returning from the trial, and I found the "Explanation on the Evolution of the Equity Capital since the Establishment of the Company and the Confirmation Opinions of its Directors, Supervisors and Senior Management" issued by Kunlun Wanwei Company on January 6, 2015, and on page 5, it was clearly written that Liu was a limited partner of the company.

The third lie is very important and completely changes the nature of the whole event. What was originally Zhou Yahui's renegade of his personal promise to me has now become his deception of all the employees of the company.

The defendant's lawyer said that according to the legal requirements of the CSRC, it is impossible for the company to hold shares on behalf of the company before listing, so it is impossible for the company to give us shares before listing. What I'm talking about granting stocks and things like that don't exist.

This statement fundamentally erases Zhou Yahui's various remarks in the company. In the company's middle and senior management meetings, in response to some people complaining about low wages, he said that if the company gave stocks, it had to accept low wages. You can apply to him for a salary increase, but don't want to get stock at the same time. With so many witnesses, how could this lawyer be so brazen. Maybe he already knew that it was difficult for me to find witnesses, or that witnesses weren't that important.
