Recently, the Huichang County People's Court of Jiangxi Province concluded a case of bribing abducted and trafficked children, and the defendant Sun Moumou was sentenced to eight months in prison for the crime of buying abducted and trafficked children.
Summary of the case
Defendant Sun Moumou, because his wife ran away and had no heirs, in order to continue the incense, he had the idea of holding a child.
On September 28, 2019, defendant Sun XX, introduced by Du XX, Qiu XX, and others, went to Ye XX's home in a certain town in Nanxiong City, Guangdong Province, and negotiated with Ye XX to use 100,800 yuan to buy a baby boy born to Ye XX and his wife (Ye XX, male, born on August 17, 2019), and agreed to complete the transaction in Xinfeng County.
On October 1, 2019, the two sides met in a certain town in Xinfeng County, and defendant Sun XX took the baby boy back to his hometown in a certain township in Huichang County to raise him after paying the money. In February 2021, defendant Sun X registered the baby boy and changed his name to Sun X.
It was also found that Sun Moumou voluntarily surrendered to the Huichang County Public Security Bureau on October 18, 2021.
The court held
In order to establish his own relatively stable family relationship, defendant Sun XX bribed the abducted child after being led by others when he did not have heirs, and his conduct has constituted the crime of bribing the abducted and trafficked child. The charges charged by the public prosecution were convicted. Defendant Sun X voluntarily surrendered himself to the public security organs after the incident, and may be given a lenient punishment in accordance with law. Defendant Sun X signed an affidavit admitting guilt and accepting punishment during the review and prosecution stage, and may be given a lenient punishment in accordance with law. The Huichang County People's Court then rendered the above judgment.
According to article 241 of the Criminal Law of the People's Republic of China, the crime of buying abducted women and children refers to the act of buying abducted women or children without the purpose of selling. The object of the violation of this crime is that the persons of the murdered women and children are not allowed to be bought and sold, and the objective aspect is manifested as the act of bribing women and children who have been abducted, sold or kidnapped. According to the provisions of the Criminal Law, whoever buys an abducted woman or child shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention or public surveillance.
