Recently, the Provisions on the Responsibility for Repair, Replacement and Return of Household Automobile Products (hereinafter referred to as the "New Regulations on the 'Three Guarantees' of Automobiles") were officially implemented. It is understood that the new regulations on the "three guarantees" of automobiles are based on the "Provisions on the Responsibility for Repair, Replacement and Return of Household Automobile Products" implemented in 2013, and modify the obligations of operators, "three guarantees" responsibility, dispute handling, legal liability and other contents, strengthen the protection of consumer rights and interests, and also put forward stricter "three guarantees" responsibility requirements for operators.

The revision puts forward new highlights of rights protection from seven aspects, such as the main body of responsibility, expanding the scope of adjustment of the "three guarantees" of household cars, vehicle return and replacement, the scope of consumer loss fees, the content of the "three guarantees" voucher, the prohibition of "compulsory maintenance", and the simplification of the conditions for enjoying the "three guarantees", especially in terms of increasing the protection of the legitimate rights and interests of consumers.

According to the relevant person in charge of the Nanning Municipal Market Supervision Bureau, the supervision of the market supervision department will be implemented from two aspects: strengthening quality responsibility and increasing penalties. When the car finds a quality problem, the merchant shall not deliberately delay, refuse the assistance requested by the consumer without a legitimate reason, recover compensation and other issues. For those who deliberately delay or refuse to bear the responsibility of the "three guarantees" without a legitimate reason, the maximum fine can be raised to 500,000 yuan, and the punishment information is recorded in the national enterprise credit information publicity system, and announced to the public.

In 2021, the 12315 institutions of the Nanning Municipal Market Supervision Department received a total of 1559 complaints about passenger cars and 211 complaints about passenger car after-sales service. The main problems reflected are: in the process of automobile sales, some merchants did not provide vehicles as agreed, temporary price increases, promises were not fulfilled, delayed refunds, etc.; during the "three guarantees" period, the vehicle had quality problems such as engine shaking, transmission noise, and body leakage.

The Nanning Municipal Market Supervision Department reminds consumers that when signing a car purchase contract, the rights and obligations of both parties should be clearly stipulated; when picking up the car, it should be carefully inspected to check whether the appearance, accessories, mechanical parts and interior decoration of the vehicle are in line with the commitment; the performance of the important parts of the vehicle should be checked to ensure that there is no problem before signing and receiving to avoid unnecessary trouble. At the same time, it is also necessary to pay attention to carefully checking the condition of the vehicle, understanding the information such as the after-sales service point of the vehicle, the price of accessories and services, and saving the relevant written materials such as invoices, documents, certificates of conformity, warranty certificates, maintenance records, etc., to provide effective evidence for the protection of rights afterwards.
