Who will take over?
The demise of the Qing Dynasty is different from any change of dynasties in history, and the fact that the Qing Dynasty was pressed into a coffin directly meant the demise of the feudal system. The Transition from the Qing Dynasty to the Republic of China was a peaceful transition, and many of the original Qing court offices became organs of the National Government. The reason why the world is amnesty is because the change of a dynasty has brought too many wars, and the damage caused by war is huge, the establishment of a new government needs to rest and recuperate, if some measures are not taken, the people are still in the water, and the country will not develop well.
Different prisoners have different treatments and different fates.
There are many prisoners in the big prisons, and the types are diverse.
1. First of all, political prisoners.
In fact, before the overthrow of the Qing Dynasty, there were not many political prisoners, because at that time a copy of the emperor's edict was issued, so many political prisoners were released. For example, Wang Jingwei, who assassinated the regent, must be a political prisoner, he was released from prison as early as October 1911, and did not wait for Yuan Shikai to amnesty the world. At the time of Yuan Shikai's amnesty, the remaining political prisoners were also pardoned and released.
2. The new government did not spare the felons or death row in the late Qing Dynasty who committed homicide and arson. Unconditional release is impossible, and the new government is striving to create a society based on the rule of law, so it is only for them to be re-sentenced, for those with lesser crimes to be given appropriate sentence reductions, and for death row inmates to be converted to life imprisonment, etc., and not all of them have been released.
3. Then there are some petty thieves and unjust, false and wrongly decided cases.
Unjust, false and wrongly decided cases were also retried after Yuan Shikai came to power, after all, the new president also needed the support of the people, so he adopted such a way to gather people's hearts. Misdemeanors, such as petty theft, are almost directly pardoned and released. In addition, without a part of the pardon, it is possible to obtain freedom in another way, that is, to pay a certain amount of bail and thus obtain the opportunity to reduce the sentence or redeem one's life.
In 1913, the government of the Republic of China implemented the Prison Rules, and according to the guidelines, those convicts who met the conditions for parole were allowed to be released from prison on parole. The first prisoner to be granted parole was Jia Wanhe. In 1902, he was sentenced to "beheading and waiting for robbery", and later because of his meritorious reporting, the sentence was changed to dispatch at the autumn trial, and after the implementation of the policy of commutation of sentence in the Republic of China, the sentence was changed to 12 years in prison. In 1913, he was granted parole for doing well in prison.
