Consumers originally ordered medical masks, but after the arrival of the goods, they found that it was only ordinary masks and had a peculiar smell. So, can consumers request a return? A few days ago, the reporter visited the Municipal Consumer Association and other consumer association organizations to learn that according to relevant laws and regulations, consumers can ask operators to return goods for refunds.

Recently, mr. Yang, a consumer, purchased a medical surgical mask that the operator claimed to be "ethylene oxide sterilization, gentle and breathable" on a shopping platform, and because the operator was promoting at the time, the consumer purchased 20 packs. However, within two days after the arrival of the goods, the consumer found that the mask purchased was not the medical surgical mask claimed by the operator at all, and the mask had a more obvious odor, and Mr. Yang believed that the operator had false publicity behavior and asked the operator to return the goods for a refund. According to the Municipal Consumer Association, the Shenzhen Consumer Commission and other consumer association organizations, according to Articles 20 and 23 of the Consumer Rights and Interests Protection Law, business operators shall ensure that the quality, performance, use and validity period of the goods provided by consumers under the normal use of the goods shall have, and shall not make false or misleading publicity on the quality, performance, use, validity period and other information of the goods.

In the case, the sales contract between the consumer and the business operator was legal and valid, and the business operator should deliver to the consumer the medical surgical masks that meet the requirements such as quality, performance, and use in accordance with the contract, but the masks provided by the operators were only ordinary disposable masks, and there were odors, non-breathable, etc., and the masks provided by the operators were not consistent with what they advertised, and there were quality problems with the masks. According to Article 24 of the Consumer Rights and Interests Protection Law, consumers may request that the operator return the goods for a refund. In addition, according to Article 25 of the Law on the Protection of The Rights and Interests of Consumers, where consumers purchase goods other than custom-made goods through online means other than custom-made, fresh and perishable, etc., they have the right to return the goods without reason within seven days from the date of receipt of the goods, and the proprietor shall return the price of the goods paid by the consumer within seven days from the date of receipt of the returned goods.

Consumer Association people remind the public that when shopping online, they should choose a reputable and qualified operator for consumption, and can refer to the evaluation of the goods by the purchased consumers, or consult the purchased consumers about the goods, and pay attention to the comparison of goods. At the same time, consumers should consume rationally, polish their eyes, and improve their awareness of prevention. If the quality, performance, use, etc. of the purchased goods do not meet the regulations, the consumer should consult with the operator in a timely manner, if the two parties cannot reach a settlement, pay attention to keeping the order record, order number, payment voucher, record of consultation with the operator and other relevant materials, timely complain to the relevant departments or file a lawsuit with the people's court, and protect their legitimate rights and interests in accordance with the law.
