Punish! Hundreds of drug inspection reports were forged, and the Municipal Supervision Bureau issued 1 million fines
The Qujing Municipal Market Supervision and Administration Bureau recently issued an administrative punishment decision. Qujing Municipal Supervision Office Zi [2021] No. 5 disclosed that on April 8, 2021, the Qujing Municipal Market Supervision Bureau received the "Letter of Transfer of Problem Clues" from the 13th Review Office of the Qujing Municipal Commission for Discipline Inspection, informing the Qujing Municipal Commission for Discipline Inspection and Supervision that during the review and investigation, it was found that Yunnan Jianjian Inspection and Testing Technology Co., Ltd. (hereinafter referred to as the "Parties") was suspected of forging drug inspection reports. After preliminary verification by the law enforcement personnel of the Qujing Municipal Market Supervision Bureau, the suspected issuance of false drug inspection reports by the parties was basically true, and the case was approved for investigation on April 12, 2021.
After investigation, the parties concerned are third-party testing institutions that have obtained relevant inspection and testing qualifications such as drugs, and are mainly engaged in drug inspection and testing and medical testing services. The parties, in carrying out drug inspection and testing activities for the chinese medicine tablet branch of Yunnan Baiyao Group Co., Ltd. (hereinafter referred to as "Yunnan Baiyao Chinese Medicine Tablet Branch"), the party concerned, collected the relevant drug inspection and testing fees of the other party according to the agreement, but did not carry out the inspection and testing and issue the relevant drug inspection report in full.
In order to achieve the same purpose as the inspection and testing related materials and the inspection and testing fees that have been collected, in December 2020, Yuan Jianping, the general manager of the parties, arranged for the relevant personnel to sort out the testing fees that have been collected from the partner "YunbaiYao Chinese Medicine Tablets Branch" in 2020, and did not actually carry out the inspection and testing detailed list, requiring the falsification of the corresponding drug inspection report according to the detailed list, and the relevant personnel found the inspection report of the drug sample with the same name that was previously inspected according to the list. Find the corresponding inspection report in the computer to convert the word document to change the sample reception time, issuance time, product number, inspection start, end time and other content to make a new inspection report, and then print out the changed inspection report and hand it over to the relevant personnel, and write the original record according to the previous drug inspection report data of the same name, thus forming a new complete false drug inspection report. In this way, the parties actually issued a total of 119 false drug inspection reports (of which 34 were based on national standards, the conclusion was determined, and the special seal for testing and the CMA seal were affixed, involving an amount of 69998.00 yuan; 85 copies were stamped with special test seals, without CMA seals, involving an amount of 156711 yuan), and the amount of false drug inspection reports issued involved 226709 yuan.
Market supervision department: The means of issuing false reports are bad and the impact is bad
The Qujing Municipal Market Supervision and Administration Bureau believes that although the parties issued false drug inspection reports without causing actual damage, the means of conduct of the parties issuing false drug inspections were bad, and the number of false inspection reports issued was relatively large, and the impact was relatively bad, which was a situation of heavier punishment. Carrying out drug inspection and testing is to ensure the quality of drugs to prevent unqualified drugs from causing damage to the people's body and posing a threat to life safety, etc. Plays an extremely important role, the parties to obtain approval of third-party drug inspection and testing institutions, should have strictly implemented the purpose and significance of the state to set up drug inspection and testing, to ensure the quality of drugs to play an active role, but the parties ignored the national drug inspection and testing requirements and inspection and testing institutions must have the principle of truth, objectivity and justice, forged and issued false drugs 119 inspection reports, which seriously violated the relevant requirements of national drug management, and easily caused damage to the health rights and interests of the public and posed a threat to life safety.
The party's act of issuing a false drug inspection report violated the provisions of Article 138 of the Drug Administration Law of the People's Republic of China (2019), and with reference to the relevant provisions of Article 11 of the Rules for the Application of Administrative Punishment Discretion in Market Supervision and Management of Yunnan Province, the Qujing Municipal Market Supervision and Administration Bureau ordered the parties to immediately correct the illegal behavior, gave the parties a warning, and fined them 1 million yuan; and gave administrative penalties to the directly responsible supervisors and other directly responsible personnel Luo Xinyue and Yuan Jianping in accordance with law.
According to public information, Yunnan Jianjian Inspection and Testing Technology Co., Ltd. was established in July 2015 with a registered capital of 10 million yuan. The legal representative is Luo Xinyue. The scope of business includes food and drug inspection and testing; medical inspection.
