The Yiling Circuit Court tried Deng's case of illegal hunting of precious wild animals

According to the allegations, on December 27, 2018, defendant Deng X, located in his residence in Sanyukou Village, Wuduhe Town, Yiling District, Yichang City, found that his free-range chickens were bitten to death by a bird commonly known as "Harrier Eagle", so he captured and chained the bird, and demanded that the village committee compensate for its losses, otherwise it would not be released. On the 29th of the same month, the bird died. According to the identification of the Wildlife Conservation Station of Yiling District of Yichang City, the eagle bird is a crested eagle and belongs to the national second-level protected wild animals.

After the case was transferred for review and prosecution, the Yiling District Procuratorate and the District Court of Yichang City, taking into account the typical significance of ecological justice, decided to try the case at the place where the case occurred, in order to better deter crimes and carry out publicity on the rule of law, to achieve the effect of "handling a case, educating one side, and governing one party", and to better protect the ecological environment and animal and plant resources.

"Protecting the environment and wildlife resources is the responsibility and obligation of every citizen, which is of great significance for maintaining ecological balance, improving the natural environment, promoting harmony between man and nature, maintaining biodiversity, and sustained and coordinated development of comprehensive economic and social development." During the trial, the prosecutor pointed out in his public prosecution opinion that especially as a resident of the northwest mouth reservoir area, he should protect his homeland.

The prosecutor said that the state's protection of environmental resources is increasingly strengthened, and the Supreme People's Procuratorate has carried out three consecutive years of special supervision activities for environmental resource crimes, and will not tolerate the crackdown on environmental resource protection crimes. However, in this case, defendant Deng moumou hunted the crested eagle because he pecked at his poultry, which was excusable, and the law took into account both jurisprudence and reasonableness. At the same time, it is pointed out that the purpose of criminal punishment is prevention, hoping that the defendant can realize the serious harm caused by his behavior to the environment, and become a good citizen who abides by discipline and law in the future, and hopes that other villagers can take this as a warning, jointly establish a sense of ecological civilization, and protect our beautiful homeland.

The case was pronounced in court, and the defendant Deng Moumou was sentenced to one year in prison, suspended for two years, and fined 1,000 yuan for the crime of illegally hunting precious wild animals. The defendant pleaded guilty and repented in court, promised not to commit the crime again, and would use his lessons to persuade other villagers to consciously abide by the law.

After the trial, the villagers said they had benefited a lot.
